ITEM TITLE: Resolution/¢2t 5 Releasing liens against the property
located at the southwest corner of Industrial Boulevard and
Anita Street

A recent title search of the property at the southwest corner of Industrial
Boulevard and Anita Street revealed the existence of liens against the
property in the respective amounts of $27,600.00 and $18,000.00. This was
accomplished by lien agreements between the County of San Diego and Henry
Johnson and Grace N. Johnson (former owners) recorded July 25, 1975, as
File/Page Nos. 75-194800 and 75-194801 . These liens were placed against the
property to guarantee the installation of public improvements along Anita
Street and Industrial Boulevard in conjunction with Parcel Map 3987.
Subsequent to placement of these liens, the improvements have either been
completed or have been sufficiently bonded against by Gerard and Jeanette
Redon (current owners) .
RECOMMENDATION: That the Council adopt the subject resolution and release
the liens.
BOARDS/COMMISSIONS RECOMMENDATION: Not applicable.
DISCUSSION:
In 1975 the owner of the property located on the southwest corner of
Industrial Boulevard and Anita Street, Mr. Henry Johnson, submitted a parcel
map to the County of San Diego in order to split his property into four
parcels. In accordance with the County of San Diego's Code, Mr. Johnson was
required to install public improvements on Industrial Boulevard and Anita
Street frontages. The County Engineer determined at the time that the
construction of those improvements required to be constructed by the owner
could be postponed. The owner was required to execute an agreement to
construct said improvements in the future and to grant a lien to the County
upon said property to secure the cost of construction of said future
improvements.
Mr. Johnson sold the property to Mr. Redon who then had Parcel 1 of Parcel Map
3987 resplit into three lots by Map No. 11377. In conjunction with this map,
the County required him to construct the public improvement along the south
side of Anita Street. Said improvements have been completed and accepted by
the County on April 29, 1982.

The rest of the improvements covered in the lien agreements are partially on
Anita Street and Industrial Boulevard. The plans for these improvements have
been approved by the City and sufficient bonds have been posted. There is no
longer a need to have the existing liens against the property since part of
the required improvements has been completed and the other part has been
covered by a substitute bond. (Properties affected: Assessor' s Parcel Nos
622-10-22, 23, 33, 34, 35. )
