HomeMy WebLinkAboutAgenda Statement 1987/01/27 Item 13 COUNCIL AGENDA STATEMENT Item 13 Meeting Date 1/27/87 ITEM TITLE: Public Hearing: Consideration of the annexation of approximately 111 acres located at the easterly terminus of East Naples Street, known as the "Telegraph Canyon South Reorganization" Resolution, f%/ Approving the proposed "Telegraph Canyon South Reorganization" SUBMITTED BY: Planning Director ( REVIEWED BY: City Manager (4/5ths Vote: Yes No X ) An application was filed by the Rancho del Sur Corporation with the Local Agency Formation Commission in September 1986 for the detachment of approximately 111 acres from the unincorporated area of the County and its subsequent annexation to the City of Chula Vista. The subject territory is a triangularly-shaped County island located at the easterly terminus of East Naples and bordered by Telegraph Canyon Road to the north and the current City boundaries to the south. The proposed reorganization is within the adopted Sphere-of-Influence of the City of Chula Vista. An Initial Study IS-87-19 of the possible adverse environmental impacts of the project was conducted as part of the prezoning by the Environmental Review Coordinator on October 24, 1986, who concluded that there would be no significant environmental effects. The City Council of the City of Chula Vista adopted the Negative Declaration on December 2, 1986. On January 5, 1987, the Local Agency Formation Commission adopted a resolution approving the proposed reorganization (Reference No. CA866). In accordance with the regulations of the Cortese/Knox Local Government Reorganization Act of 1985, the Local Agency Formation Commission has referred the matter to the City of Chula Vista for its action. RECOMMENDATION: That Council adopt a resolution approving the annexation known as "Telegraph Canyon South Reorganization." BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. The land is primarily vacant with the exception of the 10-acre area at the easterly terminus of East Naples Street which contains nine (9) single-family dwellings. The eastern portion of the property is traversed by Medical Center Drive and the SDG&E transmission line right-of-way crosses the site from southwest to northeast. Access to the property can be gained from Telegraph Canyon Road via Medical Center Drive and East Naples Street. General Plan The Land Use Element of the General Plan designates the project area as Medium Density Residential 4-12 dwelling units per acre. This area was prezoned R-1 -P-4 (single family at 4 dwelling units per acre) and R-1-10 (single family with 10,000 sq. ft. minimum lot size). Municipal Services The purpose of the annexation is to provide the full range of municipal services such as sewer and police and fire protection. FISCAL IMPACT: Pursuant to the Master Property Tax Transfer Agreement with the County, Chula Vista will receive $2,304 in base property tax revenue annually and will receive 13.9% of future taxes generated from the area. The annexation is not expected to have an adverse economic impact on the City. If the conducting authority adopts a resolution ordering a change of organization or a reorganization without election, or a resolu- tion confirming an order for a change of organization or reorgani- zation after confirmation by the voters, the clerk of the conducting authority forwards six (6) certified copies of that resolution (plus copies for each affected agency if a reorganization) and the State Board of Equalization fee to LAFCO. 2. The conducting authority' s resolution is checked for conformity with LAFCO's resolution. The conducting authority's resolution cannot contain any term and condition that was n t included in LAFCO's resolution and must include the legal description and map stamped "Approved" by LAFCO. If the conducting authority's resolu- tion is not in compliance, a notice will be sent specifying the points of noncompliance. 3. When the conducting authority' s resolution is in compliance, the Executive Officer will execute a Certificate of Completion. The change of organization or reorganization is considered "complete" from the date of execution of the Certificate of Completion. 4. The Executive Officer files the original Certificate of Completion, the original Certificate Re: Terms and Conditions and Indebtedness signed by the. conducting authority, and a copy of the conducting ) authority's resolution w/legal description and map with the County Recorder. 5. When acknowledgment of receipt is received from the Recorder, a postcard is sent to the conducting authority advising of the date of recordation and the document number. A change of organization or reorganization is considered "effective" from the date of re- cordation, unless a different date was stipulated in the resolution (and approved by LAFCO) , subject to the provisions of Government Code Section 57202 (a) . 6. The Executive Officer also files copies of the Certificate of Com- pletion and Certificate Re: Terms and Conditions and Indebtedness w/the conducting authority' s resolution, legal description, and map w/the .County Assessor and the State Board of Equalization. 7. When the original, recorded documents are returned by the Recorder, they are- returned to the conducting authority w/copies of the ac- knowledgments from the Assessor and State Board of Equalization. It takes approximately 30 days to receive the oricinal documents from the Recorder, as they must first be microfilmed. The conducting authority should allow at least 45 days from submission of its resolution to LAFCO before inquiring about the return of all docu- ments. However, since it should have already received the postcard (item no. 5) advising of the date of recordation and document number, that information should be sufficient for many purposes. •
