HomeMy WebLinkAboutAgenda Statement 1987/01/06 Item 23 • C D3 COUNCIL AGENDA STATEMENT Item 23 Meeting Date 1/6/87 ITEM TITLE: Public hearing to consider the vacation of a portion of Broadway at the northwest corner of its intersection with Anita Street �y�/ SUBMITTED BY: Director of Public Works/City Engineer /J/Y REVIEWED BY: City Manager (4/5ths Vote: Yes No X ) The Council adopted Resolution No. 12856 at its meeting on December 16, 1986, declaring its intention to vacate a portion of Broadway (formerly National Avenue) at the northwest corner of Broadway and Anita Street and setting a public hearing to consider the matter. All proper notices have been posted and property owners within a 300-foot radius of the site have been notified by mail . RECOMMENDATION: That the Council hold its subject public hearing and direct staff to return with a resolution vacating the property after a determination • is made regarding the disposition of the land after vacating. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: Mr. William Perkins, owner of the property at 1550 Broadway, submitted an application to this department requesting that the City vacate a portion of Broadway right-of-way along the frontages of his property and the property to the north. (Lots 2 and 3 of Starfire Sports Subdivision, Map No. 8017, recorded September 11 , 1974. ) The reason given for the request is that his property is substandard in terms of parking capacity. In order for the applicant to fully use the lot in accordance with the zoning, additional parking area is necessary. Presently, there is a one-way travel lane aligned with Silvas Street (see Exhibit "B"), a north-south substandard street which extends south from Anita Street to Main Street, approximately 1 ,400 feet in length. It has been determined that this travel lane is unnecessary and the deletion would not cause a hazardous situation at the intersection. It would also encourage southbound traffic to use Broadway instead of Silvas Street for those drivers ultimately wanting to go west on Main Street. In order to facilitate right-turn movements from southbound on Broadway to westbound on Anita Street, we proposed to require incorporation of a 35-foot radius return in the curb design instead of the standard 30-foot radius. ' C (, Page 2, Item 23 Meeting Date 1/6/87 Subsection 8324(b) of the California Streets and Highways- Code states that if the Council finds from evidence submitted by all interested persons that the subject portion of the street described in the resolution of intention is unnecessary for present or prospective public use, the Council may adopt a resolution vacating said street. That paragraph also includes the provision that the resolution of vacation may be conditioned so that the vacation does not become effective until certain requirements have been fulfilled. In this case, the following conditions will be imposed and shall be met before the City Clerk is instructed to have the resolution recorded: 1. A site plan is to be submitted and approved by the Planning Department showing how the vacated land is to be used. 2. A complete set of improvement plans for the reconstruction of the Broadway and Anita Street improvements shall be prepared by the applicant's private engineer and the plans approved by the Director of Public Works/City Engineer. Depending on how the right-of-way was acquired by the County of San Diego, the disposition of the land subsequent to vacating may be either by quitclaim in case it was a grant of easement or by sale, if it was granted in fee title. The applicant has not provided the City sufficient evidence of ownership of the right-of-way. Once the determination of ownership is made, if directed staff will return to Council with a resolution ordering the vacation. All utility companies owning franchises in our rights-of-way have been contacted regarding the proposed vacation. We are reserving "blanket easements" for SDG&E, Sweetwater Authority and Pacific Bell . Defined easements, if necessary in the future, may be coordinated between the owner and the respective utility. The Planning Department has been contacted regarding this matter and staff has no objections to the proposed vacation. Transparencies and slides are available for Council ' s viewing. FISCAL IMPACT: Minimal savings in maintenance costs and minimal increase in tax revenue due to more land added to tax rolls if street is vacated.
