The developer of the subdivision is required to provide for the ongoing maintenance of the pump station as a condition of approval of the Tentative Map and in accordance with a previous agreement with the City. Adoption of the above listed ordinance will enable the City to collect sufficient funds with the water bills to guarantee the continued maintenance and operation of the pump station. RECOMMENDATION: That City Council approve the resolution and adopt the ordinance listed above. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: On June 17, 1986, the City Council approved the Final Map for Chula Vista Woods Unit No. 1 and approved an agreement with Stafford Gardner Development Company, the developers of Chula Vista Woods Subdivision, in which the developers agreed to establish a maintenance district for the sewer pump station. On June 24, the City Council approved the Final Map for Unit No. 2. These actions created 110 single family lots, all of which are to be served by the sewer pump station. When the Tentative Map for Chula Vista Woods was approved, the surrounding properties were owned by United Enterprises. It was not possible for the developer to obtain the necessary easements to serve the subdivision by gravity sewer. Therefore, a sewer pump station was proposed to serve the subdivision. A condition of approval of the Tentative Map was that the developer provide for the perpetual maintenance of the sewer pump station. In the above mentioned agreement, the developer agreed to provide for said perpetual maintenance by formation of a district to allow the City to collect Page 2, Item 16 Meeting Date 1/6/87 the maintenance and operating costs from the property owners being served by the pump station. The proposed ordinance provides for the formation of a special sewer service rate area for the area currently being served by the pump station. The additional costs of the maintenance and operation of the sewer pump station can then be collected on the water bills in the same fashion as current sewer fees are collected. The Otay Water District currently charges $.25 per billing per unit to provide this service. The proposed ordinance sets a limit for the additional amount to be charged per unit at $54 per year or $4.50 per month. The developer has deposited $5000 with the City to cover the costs incurred during the first year of operation of the pump station. By the time the initial deposit is expended, the City will be collecting sufficient funds each year for continued maintenance and operation. Recently, Stafford Gardner purchased the surrounding property from United Enterprises, Inc. and is currently working on plans to eliminate the sewer pump station and serve the entire area with a gravity sewer system. An interim proposal is to allow an additional 175 units to utilize the pump station. This appears to be technically feasible. Should this occur, the cost per unit would drop proportionally. Stafford Gardner, as current owner of all lots within Chula Vista Woods, Units 1 and 2, has entered into an agreement in which they agree to formation of the special sewer rate area on behalf of the future property owners.
