HomeMy WebLinkAboutReso 2015-019 RESOLUTION NO. 2015-019 RESOLUTIOI�' OF THE CITY COUI`'CIL OF THE CITY OF CHlJLA VISTA APPROVII�G A T�tiO-PARTl' AGREEn4EI�TT BETWEEN THE CITY AI�iD NII�'YO cC MOORE GEOTECHI�'ICAL AND ENV'IRONMENTAL SCIEI�'CES CONSULTANTS TO PERFORI�9 A PHASE 11 EI�T�'IROI�TMENTAL SITE II�'VESTIGATIOI�' AI�TD WAIVII�'G THE FORI�4AL COI�'SULTAI�'T SELECTIOI�i PROCESS �'HEREAS; the City of Chula Vista is the recipient of a BroNnfields Assessment Grant from the US Environmental Protection Agenc�� (EPA) to identify and characterize Brownfield sites in �;�estern Chula Vista: and V�'HEREAS; usina EPA Bro�mfields erant funds, a Phase I environmental site assessment (ESA) �vas completed in June 2013 for the property located at 1130 Fifth Avenue and o�med b}� the Sti�eetwater Union Hieh School District (SUHSD); and R'HEREAS; the Phase I ESA for this property identified potential petroleum contaminants and underground storage tanks (USTs) on the property. The property o�mer, SUHSD; concluded that a Phase II Environmental Site lnvestigation H-as necessary to verif}� the presence of contaminants, determine the characteristics and extent of those elements. and make recommendations for remediation: and WHEREAS. Ninvo & Moore Geotechnical and Environme�tal Sciences Consultants (I�'im�o R Moore) was selected to prepare a proposal to perform a Phase II En��ironmental Site InvestiQation (SI) on the subject property referenced above; and l�'HEREAS. the City has determined that \'inyo & Moore is uniquel} qualified to perform under the Agreement, due to its recent e�perience in preparine em�ironmental assessments through the EPA's Bro«�nfield Assessment erant proeram and iu familiarin� with the Cin�'s consultant agreement processes: I�iin��o & Moore is currently under an on-call aereement ���ith Chula Vista's Public �l'orks Department. The timeframe to complete the H�ork is short, so Ninyo R Moore's I:noH�ledge of the EPA requirements and process will be kev to a timeh� completion of the project. All of�i�hich �vould better materialh� serve the Cit}�'s interests. Therefore, the formal selection process for the scope of�i-ork has been ���aived; and WHEREAS, Consultant ���arrants and represents that it is e�perienced and staffed in a manner such that it can deliver the sen�ices required of Consultant to Cit}� in accordance ���ith the time frames and the temts and conditions of this Aareement: and �1'HEREAS, the De��elopment Services Director has revie�i�ed the proposed amendment for compliance with the Califomia Environmental Qualin- Act (CEQA) and has determined that the project is exempt; pursuant to Section 1�061(b)(3) of the State CEQA Guidelines. Thus, no further em•ironmental re��ie�i� is required. Resolution No. 20]�-019 Page No. 2 NOW; THEREFORE. BE IT RESOLVED by the City Council of the City of Chula Vista. that it: 1. Find that Ninyo R Moore Geotechnical and Environmental Sciences Consultants, is uniquely qualified to perform under the Agreement, due to its recent ehperience in preparin� environmental assessments through the EPA's Browmfield Assessment grant program and its familiarity with the City's consultant agreement processes: Nin}�o & Moore is currently under an on-call agreement �+�ith Chula Vista's Public Works Department The timeframe to complete the work is short, so Ninyo & Moore's knowledge of the EPA requirements and process will be key to a timely completion of the project. All of which would better materially serve the City's interests. Therefore, the formal consultant selection process far the scope of work is hereby waived: and 2. Approve the Agreement beriveen the City of Chula Vista and Ninyo & Moore Geotechnica] and Environmental Sciences Consultants, in the form presented, with such minor modifications as may be required or approved by the City Attorney, and authorize and direct the Mayor or her designee to eaecute the same.
