HomeMy WebLinkAboutReso 1956-1817 • RESOLUTION No. 1817 RESOLUTION APPROVING LEASE OF REAL PROPERTY TO THE SWEETWATER UNION HIGH SCHOOL DISTRICT BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CHULA VISTA AS FOLLOWS: 1. The City Council of the City of Chula Vista does hereby approve that certain agreement providing for the leasing of a portion of certain buildings to the Sweetwater Union High School District for a rental of $50.00 per month, a copy of which is attached hereto and made a part and parcel hereof, and the Mayor and the City Clerk of said City are hereby authorized and directed to execute the same on behalf of said City. • • ADOPTED AND APPROVED by the CITY COUNCIL of the CITY OF CHULA VISTA, CALIFORNIA, this 14th day of February 19 56 by the following vote, to wit: AYES: COUNCILMEN Rader, DeGraaf, Smith, Mansell, DeWolfe NAYS: COUNCILIEN None ABSENT: COUNCIL EN None oro e iyo u : ATTEST !'L • //i y C er• • 'd. City Hall Chula Vista, California Dear Mr. Wade: Reference is made to the "Lease of Real Property for School Purposes" dated June 29, 1955, between the City of Chula Vista and the Sweetwater Union High School District, which lease covers the use of two rooms, two toilet rooms and the connecting corridor in the Youth Center Building of the Vista Square Housing Project. Said lease was approved by the City Attorney of Chula Vista and approved as to form by the District Attorney and County Counsel of San Diego County. Said lease was approved by the City Council of Chula Vista under Resolution No. 1745 on July 19, 1955. Subsequently, the said school district arranged with your office for the lease for school purposes of additional space in the same building, namely, the auditorium room, at the agreed rental rate of $50.00 per calendar month. The school district, with your approval, began occupancy of this additional room on October 10, 1955. It is now desired to cover this new arrangement with a new lease, identical in form to the existing lease already approved by the City Attorney and the District Attorney and County Counsel. The enclosed lease, in triplicate, is drawn in the same form as the existing lease, the only changes being the rental rate and the length of term. It is requested that this additional lease be approved and adopted by the City Council by proper resolution and then returned to this office for signature of the governing board of the Sweetwater Union High School District. LEASE OF REAL PROPERTY FOR SCHOOL PURPOSES THIS INDENTURE of lease made this 1st day of October,, 3955, by and between the City of Chula Vista, hereinafter called the City, and the Sweetwater Union High School District of San Diego County, California, hereinafter Galled the District: WITNESSETHi That for and in consideration of mutual promises, covenants and agreements here- inafter set forth and the payment of the rent herein provided, the parties hereto agree as follows :, That the City is the owner of the Youth Center Building of the Vista Square Housing Project, on Fifth Avenue and H Street, Chula Vista, California, which is a one story wood structure. A portion of the said building, consisting of the auditorium, the City agrees to rent to the District. 2, The term of this lease shall be fresu October 10, 3955 to dune 30, 1956: 3, The District agrees to pay and the City agrees to accept as rent the sum of Fifty Dollars ($5000) per calendar month, payable an the last day of June, 1956. 14.. The District agrees that said premises shall be used for school classroom purposes. -5; The City further covenants and agrees to pay ell utilities furnished the premises. 6, The District agrees to assign a teacher to have charge of the auditorium, and also to provide the custodial service needed for the areas used by the District; 7. During the term of this lease, the District shall have the right to install, at its out expense, and with the approval of the City, fixtures and equipment needed by the District for its operationss'and will remove such fixtures and equipment at the expiration of this lease.
