APPROVING THE SECTIONAL PLAI�'I�'II�'G AREA (SPA)
PLA1`TI�TED COMMLINITY DISTRICT REGULATIONS FOR
OTAY RANCH VILLAGE EIGHT EAST
VJHEREAS. the propem� ���hich is the subject matter of this Ordinance is identified as
Exhibit "1" attached hereto and incorporated herein b�� this reference and commonl�� I:noNm as
Otav Ranch Villaee Eieht East. N�hich consists of approximatel�� �7�..i acres located primaril}�
south of Main Street and west of SR-12� (the "Propem�'); and
WHEREAS. an application (PCA4-12-04) to consider a ne�� Sectional Plannine Area
(SPA) Plan, including Planned Community District Regulations for Villaee Eieht East (the
"ProjecP') N�as filed ���ith the City of Chula Vista Development Sen�ices Department on March 8,
2012; b}� SSBT LCRE V, LLC (the "Applicant" and "O��ner"); and
' WHEREAS, the Project is intended to ensure that the Otay Ranch Villaee Eight East
SPA Plan is prepared in accordance ti�ith the Otay Ranch General Development Plan (GDP) to
implement the Citv of Chula Vista General Plan for Eastem Chula Vista to promote the orderh�
planning and long term phased development of the Otay Ranch GDP and to establish conditions
��fiich ��ill enable Ota}� Ranch Villaee Eight East to esist in harmonv �;�ithin the community; and
N'HEREAS, the development of the Propem� has been the subject matter of a General
Plan Amendment GPA-10-02, and Otav Ranch General Development Plan Amendment GDPA
09-28; approved by the Cirv Council on December 2. 2014, b}� Resolution No. 2014-233; and
VdHEREAS, the development of the Propert}� relied on the Otay Ranch Universiri�
Villages Project Emironmental Impact Report No. li-01. SCH Y 2014071077 (EIR-li- Ol); and
the Findines of Fact and Mitigation Monitorin2 and Reporting Proeram, Certified by the Cih�
Council on December 2. 2014: and
WHEREAS, the Project is established pursuant to Title 19 of the Chula Vista Municipal
Code, specifically Chapter 19.48 Planned.Community (PC) Zone. ���hich is applicable to the Ota}�
Ranch Villaee Eieht East SPA Land Use Plan: and
R'HEREAS, the Project establishes a Planned Community District Reeulation Code
applicable to the Residential, Mi�ed Use, Open Space and Pazks, and Community Purpose
Facilitv Districts. located in the Ota�� Ranch Villase Eieht East SPA Land Use Plan: and
R'HEREAS. the City's Development Sen�ices Director has review�ed the Project for
compliance �+-ith the Califomia Em�ironmental Quality Act (CEQA) and determined that the
Project could result in a significant impact to the environment. and therefore, the Uni��ersity
Villases Project Em�ironmental Impact Report (EIR 13-01) has been prepazed and addresses the
Village Eieht East Sectional Planning Area Plan and Tentative Map; and

WHEREAS, the Planning Commission set the time and place for a hearing on said
Project and notice of said heazing, together with its purpose, was given by its publication in a
newspaper of general circulation in the City and its mailings to property owners within 500 feet
of the exterior boundaries of the Project site at least ten days prior to the hearing; and
WHEREAS; the hearing was held at the time and place as advertised, namely 6:00 p.m.
November 19, 2014 in the City Council Chambers located at 276 Fourth Avenue, and said
hearing ��as thereafrer closed; and
WHEREAS; a duly noticed public hearing was scheduled before the City Council of the
City of Chula Vista to approve the Project; and
WHEREAS; the proceedings and any documents submitted to the City Council as the
decision makers shall comprise the entire record of the proceedings.
NOW, THEREFORE, the City Council of the City of Chula Vista does hereby order and
ordain as follows:
I. PLANNING COMMISSION RECORD
The proceedings and all evidence introduced before the Planning Commission at their
public hearing held on November 19, 2014 and the Minutes and Resolutions resulting
therefrom are hereby incorporated into the record of this proceeding. These documents,
along H�ith any documents submitted to the decision-makers, shall comprise the entire
record of the proceedings for any CEQA claims.
Il. COMPLIANCE WITH CEQA
Immediately prior to this aciion, the City Council reviewed and certified EIR- 13-01 and
adopted the Findings of Fact; Statement of Overriding Considerations, and Mitigation
Monitoring and Reporting Program, pursuant to Resolution No. 2014-232.
III. ACTION
The City Council hereby adopts an Ordinance approving the Otay Ranch Village Eight
East SPA Planned Community District Regulations, finding that they are consistent with
the City of Chula Vista General Plan, the Otay Ranch General Development Plan and all
other applicable Plans; as set forth in Resolution No. 2014-233 adopting the Village Eight
East SPA Plan, and that the public necessity; convenience, general welfare and good ,
planning and zoning practice support their approval and implementation.

IV. SEVERABILITI'
If an�� portion of this Ordinance, or its application to an�- person or circumstance, is for
anv reason held to be. in��alid, unenforceable or unconstimtional; bv a coun of competent
jurisdiction, that portion shall be deemed se��erable, and such invalidity_ unenforceabilin�
or unconstitutionalin shall not affect the ��alidit�� or enforceabilitv of the remainin2
ponions of the Ordinance. or its application to anv other person or circumstance. The
Cit�� Council of the City of Chula Vista hereb�� dedares that it ���ould have adopted each
section, sentence, clause or phrase of this Ordinance, irrespective of the Fact that an�� one
or more other sections, sentences, clauses or phrases of the Ordinance be declazed
invalid. unenforceable or unconstimtional.
V. CONSTRUCTION
The Cit�� Council of the Cin• of Chula Vista intends this Ordinance to supplement. not to
duplicate or contradict, applicable state and federal law and this Ordinance shall be
construed in li2ht of that intent.
VI. EFFECTIVE DATE
This Ordinance shall tal:e effect and be in full force on the thiRieth dav from and afrer its
adoption.
