PROVEMENTS THE .CITY COUNTIL OF 1HE CITY OF CHULA VISTA, DOES HEREBY RESOLVE AS FOLLOWS: SECTION I . That certain agreement between the CITY OF CHULA VISTA, a municipal corporation, and LLOYD L. LEE, INC. , and dated Awl, 195$ a copy of which is attached hereto, and incorporated herein, the same as though fully set forth herein, be, and the same is hereby approved. SECTION 2. Lot 21, of Quarter Section 123 of Chula Vista, in the City of Chula Vista, County of San Diego, State of California, according to Map thereof No. 505, filed March 13, lgg$ in the office of the CollAty Recorder of said. San Diego County, . Excepting therefrom the Easterly 1110 feet thereof '"•HEREAS the Second 'arty proposes to create a subdivision of the . iroperty above described, to De known as HILLTOP GLEN , and to effect the same as heretofore filed rith the- proper authorities of the said City of Chula Vista the necessary saps and improvements plans and other data in conformity with the laws of he State of California and the Ordinances of the City of Chula Vista ;ppi icable thereto, and WHEREAS the said proper authorities of said City have found the ` Iroposed subdivision plan to be acceptable and in accord with the best -nterests of said City, and \9-IEREAS the City of Chula Vista is entitled to require from the ;econd Party, and does require from Second Party, as a condition prece- lent to the acceptance of any and all streets and easements and other mprovements, assurances for the completion of the public improvements • n said subdivision as is provided therefore in said plans and attendant specifications as have heretofore been approved as aforesaid, and • Ct - 03� ' HEREAS the Second Party is desirous of supplying such assurances, r \V/, THEREFORE, IT IS HEREBY AGREED BY and between the City of Chula V ista, and Second Party as follows: 1 . Said Second Party agrees to undertake and complete, and to pay for all labor and materials in connection therewith, within a period of days from the date hereof, all the necessary work and installation of ilprove- . meats in the hereinabove described subdivision in full conformity with the ordinances of the City of Lhula Vista, the laws of the State of California and the directions of proper officials of the City of Chula Vista, California as may be applicable thereto. Said improvements are more particularly des- cribed as follows: The construction of the following items of work as shown on the improvement plans for Hilltop Glen of file in the office of the City Engineer of the City of Chula Vista. 1. Remove exist. banjo and restore d±veways 1.x.500 500.00 Sub—total 24,672.20 Plus 10% for contingencies _ = 2,46/.22_ _ BOND TOTAL $27,139.42 The Second Party further agrees to indemnify, protect and hold harmless the said City of Chula Vista from any and all claims of liability for per- sonal injury, property damage, labor or material claims which may be made against said City by reason of said work and installation of improvements as herein provided. 2. As a guarantee and as security for its full and faithful per— formance in complying with all the requirements for the completion of said subdivision as aforesaid, the said Second Party shall deliver to the City of Chula Vista, upon the execution of this agreement, a good and sufficient bond executed by an authorized surety company satisfactory to the said City of Chula Vista in the sum of $ 27,139,42 3: As a guarantee and as secuity for the payment of all material and labor claims for the completion of all said improvements, the Second Party shall deliver to the said City of Chula Visa a bond in the sum of $ 13,569.71 , by its terms made to insure to the benefit of laborers and materialmen, for labor and material performed or furnished in the performance of this agreement . A. Upon the execution by Second Party of this contract and the post— ing of the bonds as herein provided, the City agrees $o approve the final map of said subdivision and accept the same for recordation.
