S DATED: May 13. 1958 y erk4.4, • ti • - ---` E -., :� 3�i THE CITY OF CsHULA VISTA AND HE CHuLA VISTA CHAMBER OF COMMERCE The City of Chula Vista, hereinafter referred to as the City, •and the Chula Vista Chamber of Commerce , herein-. after referred to as the Chamber, do hereby enter into the following lease agreements 1. The City agrees to the following: a. To lease to the Chamber thereinafter described " real property, hereinafter referred to as the property, . on the following terms and conditions: • (1) That the Chamber shall comply with all laws , ordinanoos and regulations in the oeoupaney and use of the property; (2) That the Chamber shall not transfer this lease nor sub-let the whole or any part of the .property without the written permission of the City; • (3) That the Chamber shall be responsible for and shell promptly pay for •services and utilities furnished to the property; , (4) That the Chamber maintain, the property, r • and any building or structure which it places upon the • • property, in good •oo.ndition; (5) That the Chamber landscape the property . to the same degree and quality as the landscaping in the area of the City Hall of the City; • (6) That the City may re-enter the property and terminate the lease if the Chamber is in default in the performance of any of the provisions and conditions of . this lease. • (7) That the Chamber shall conform the architectural design of any building or structure which • it places on the property to the architectural dssigg of other Civic Center buildings, o s - • F` *«, yy � ` 2. The real property referred to hereinabove , and which property is being leased by the City to the Chamber in this lease , is situated in the City of Chula Vista, County of San Diego, State of California, and is more particularly described as follows: The Easterly 54.39 feet of the Southerly 116.00 • .feet of Lot 13 in quarter-Sec-tion 149 of•Chula Vista.; being-in the Rancho de la Nacion, County • of. San Diego, State of California, according to • • Map No, 505 filed in the°aftioe• .of •the Recorder of said San Diego County, March 13, 1888. . EXCEPTING the pitiptioa described as follows: Regina- ing at the Southeast corner of. the above described • land, thence Westerly along the Southerly line of said Lot 13 a distance of 12 feet to a point of • tangency with a curve .concave Northwesterly having a radius of 12 feet and a central angle of 900. `:% thence Easterly and Northerly along the are of said curve 18.85 feet to the point of tan •ency with the Easterly line of Lot 13; thence Southerly along- the Easterly line 12' feet to the point of, • beginiing. 3, The - term of this lease shall be for a period of • ten years commencing with the data of the ;execution of this lease by both parties hereto, which date is written below; and this lease shall automatically be extended for a period of five years beyond said ten year period, . unlosa the City shall give the Chamber,• in writing, written notice that said five year extension shall not come into effect, which written notice shall be given to the Chamber at least four months prior to the end of said ten year period; and this lease shall automatically . be extended for a period of five years beyond said five year period mentioned above, but, at any time during this • latter five year period this lease may be terminated by either party giving to the other six months' written notice of intention to terminate. Any of the automatic extensions of this lease mentioned above presuppose that the lease has not been terminated by ana pursuant to its own terms at an earlier date. 1 • 4, The Chamber agrees to the following: - a, To abide by all of the terms and conditions contained in this lease; • b. To pay to the City as rent for the property the sum of Fifty and no/100 ($50,00) Dollars. per month, . • per month, payable in advance each month, with the first months rent due and payable on the date thia lease is executed by -both parties hereto; • e. That in the event that it does not remove any building or struture which it hes or does place • upon said property prior to the termination of its term of lease, then in that event any building` or • structure placed on the property by the Chamber shall • become the property of the City as of the date of • termination of this lease; • • d. That in the event that it does. remove • the buildings or structures which It -has placed upon said property prior to -the termination of its term of lease , it will put the property in substantially the sane condition as the property was in at -the • time of the commencement of the lease except that it shall leave all improvements, other than. the build- ' '; • • , • . . lags and structures which it has chosen to remove, which the City requests .that it leave' and in the • condition that the City requests.
