HomeMy WebLinkAboutReso 2014-225 RESOLUTION NO. 2014-22� RESOLUTIOI�T OF THE CITY COUI`'CIL OF THE CITY OF CHULA VISTA ADOPTING THE CITY OF CHULA VISTA C.AFETERIA BENEFITS PLAI�' FOR 201� �l'HEREAS. the Internal Revenue Code requires that the Section 12� Cafeteria Benefits Plan offered b�� the Cin� to its emplo}�ees be in a �vritten document and that the document be formall�� adopted by the Cin� Council on or before the first da�� of the plan }�ear; and �1%HEREAS. in June 1998. the Cit�� established its first Section 12� Cafeteria Benefits Plan: and WHEREAS, in compliance �vith Intemal Re��enue Code y 12�(d) the Cit�� Council annuall�� adopts a w�ritten plan document prior to the first da}� of the plan }�ear; and R%HEREAS, tbe first da}� of the Citv's plan }�ear is Januar�� 1. 201�; and ��%HEREAS, this Plan Document lays out ho��� the Cit}� offers eligible emplo��ees the choice ben��een cash and certain nontasable benefits (such as health insurance). thereby allo�aine emplo}�ees to pa�� for the benefits thev choose on a pre-ta� basis; and A'HEREAS, the specific health plans offered and their structure are not part of this Cafeteria Plan Document: and WHEREAS. the�� are induded in ���hat is knowm as the Summarv Plan Document that ���as eiven to elieible emplo��ees as part of their open enrollment materials to assist them in makine their benefit choices: and li'HEREAS; the plans offered and their structure aze determined afier our broker, Bame}- and Barnev, eztensi��el}� markets and neeotiates with providers to provide coveraee compazable to the prior }�ear while keeping the increase in costs to the Cit�� and its benefited emplo��ees to a minimum: and V�'HEREAS, all employee groups are ad��ised of the of�ers and the plan structures that will pro��ide the least increase in premium costs; and WHEREAS, under current cafeteria plan regulations having an appro��ed ��ritten plan is critical: and VIHEREAS. «�ithout a ���ritten plan or if the �ti7itten plan does not comph� �i•ith applicable requirements regazdine content and timing of adoption. then the plan is not a cafeteria plan and emplo}�ees' elections H�ill be taxable; and Resolution No. 2014-225 Page No. 2 WHEREAS, the Cit}� has timed its open enrollment period for 2015 to comply with these regulations and to meet provider cutoff deadlines for enrollment to ensure employees are covered ��ithout interruption; and WHEREAS. the City's Plan includes the follo��ing required information: description of available benefits, participation rules, election procedures, manner of contributions, maximum amount of convibutions, the plan year, and the plans provisions for complying with fleaible spending arrangements (FSAs). NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby adopt the City of Chula Vista Cafeteria Benefits Plan for 2015, a copy of which is attached ro the related Staff Report and on file with the City Clerk's Office.
