RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA ORDERING THE SUMMARY VACATION OF A PORTION OF
GLOVER AVENUE ADJACENT TO 360 "H" STREET
WHEREAS, Dr. Roberto Gratianne, owner of the property at 360 "H" Street,
has requested a right-of-way vacation by the City in order to reduce the impact
on the developable area of his lot resulting from the dedication of right-of-way
for the future widening of "H" Street; and,
WHEREAS, Section 8334(a) of the California Streets and Highways Code states
that the Council may summarily vacate an excess right-of-way of a street or
highway not required for street or highway purposes; and,
WHEREAS, Section 8334.5 states that a street easement may not be summarily
vacated if public utility facilities are in place and would be affected by the
vacation; and,
WHEREAS, all utility companies that might be affected were contacted and
have no objections to the vacation and there are no facilities in the street
easement, so no utility easement reservations are necessary; and,
WHEREAS, Dr. Gratianne has dedicated the 18 feet of right-of-way along "H"
Street, which was recorded by the County on June 5, 1992 and has obtained a
permit to relocate the public sidewalk so that it falls within the new right-of-
way on Glover Avenue on September 25, 1992.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula
Vista does hereby order the summary vacation of a portion of Glover Avenue
adjacent to 360 "H" Street, more particularly described in Exhibit "B", in
accordance with the provisions of Chapter 4 of the Streets and Highways Code.
BE IT FURTHER RESOLVED that the City Clerk of the City of Chula Vista is
hereby directed to forward this resolution to the County of San Diego for
recordation upon payment of the $2,835 for a portion of the area vacated.
BE IT FURTHER RESOLVED that from and after the date the resolution is
recorded, the easement vacated no longer constitutes an easement.

THE RECORDER OF SAID SAN DIEGO COUNTY ON MARCH 13, 1888, AND FURTHER
DESCRIBED AS FOLLOWS:
BEGINNING AT THE SOUTHWEST CORNER OF LOT 16 OF L.C. OAKLAND'S
SUBDIVISION, ACCORDING TO MAP THEREOF NO. 1421, RECORDED IN SAIF'-
COUNTY RECORDER'S OFFICE ON MARCH 8, 1912, ALSO BEING A POINT ON TH
EASTERLY RIGHT OF WAY LINE OF GLOVER AVENUE AS SHOWN ON SAID MAP
NO. 1421; THENCE NORTHERLY ALONG SAID RIGHT OF WAY LINE N 19° 00' W,
125.45 FEET; THENCE LEAVING SAID RIGHT OF WAY LINE AT A RIGHT ANGLE,
S 71 ° 00' W, 10.00 FEET; THENCE SOUTHERLY ALONG A LINE PARALLEL TO SAID
