ITEM TITLE: Resolution - Approving Change Order to Contract for Remodeling
Chlorine Room at Memorial Park Pool

BACKGROUND
On March 19, 1974, the City Council, by Resolution 7248, awarded a contract
to R. W. Kurtz, General Building Contractor, in the amount of $8,236 for
the remodeling of the chlorine room at D2emorial Park pool. A change
order was approved by the Director of Public Works on May 6, 1974 which
increased the contract price to $8, 289.05.
When this project was initially advertised, bidders were requested to
submit an alternate bid to provide and install a chlorine scale. This
alternate however was rejected on all bids for financial reasons. Since
the opening of the bids and award of the contract, we have been made
aware of Title 17-7806-e-9 of the California Health and Safety Code and
the California Administrative Code which requires that "a scale for
determining weight of chlorine used shall be provided" when compressed
chlorine gas is used. Therefore, it is recommended that the required
chlarine scale be provided and installed as soon as possible.
The contractor, R. W. Kurtz, will provide and install a scale manufactured
by Western Scale Co. , Inc. for $2 , 354. A tank cradle to hold the chlorine
cylinder will be provided and installed for an additional $262. No other
contractor was contacted for this installation but by comparison with
the alternates initially bid, it seems like a fair price.

Department Head Recommendation:
le City Council approve change order in amount of $2, 616. 00 to contract
for remodeling o� chlorine room for the installation of a chlorine
scale.
2. City Council appropriate and authorize the expenditure of $2,000 for
the installation of the chlorine scale and transfer $2, 000 from
Park Development, Hilltop Phase III, Account No. SC-1-73 which shows
an unexpended balance of $28,908. 80.
City Manager Recommendation:
Concur. This will not have negative impact on Hilltop Park. This
scale is required by OSHA so we have no option. It was recently
determined that this State law did apply.
