RESOLUTION DETERIVlINING THAT NEED FOR
TEMPORARY HOUSING PROJECTS H1�5 PAS�ED
AND INVITATION FOR PROPOSALS TO PURCHASE LAND
WH�REA�, by Q,uitclaim Deed c�ated �eptember 23, ZgS� the
City of Chula Vista acquired from tne United States of America,
acting throug,h the Housing and Home Finance Agency, Public Housing
Administration under and pursuant to the powers and authority
contained in the provisions of the Lanham Act (5� Stat. 1125;
�2 U�C 1521� , as amended, and Reorganiza�ion Plan No. 3 of 19�+7
(12 F.R. �98i) � certain temporary housing projects identified as
Tract 1 (Cal-�-259), Tract 2 {Cal-�+259) and Tract 3 (Cal-�+o99) �
Tract 1 as presently constituted is hereinafter described and
referred to as Parcel C and tne legal descr:Lption thereof for the
purpose of this resolu�ion is attached hereto and marked Exhibit C
and made a part hereof tne same as though fully set forth here at
length; Tract 2 as presently constituted is hereinafter described
and rez"erred to as Parcel B and th4 legal description thereof for
the purpose of this resolution is attached hereto and marked
E�ibi.t B and made a part hereof the same as tn.ough fully set forth
here at length; Tract 3 as presently consta.tuted is hereinafter
described and referred to as Parcel A and the legal description
thereof for t:�e purpose of this resolution is attached hereto and
marked Exhibit A and made a part hereof' the same as though fu1�
set forth here at length; and
WHEREAS, since its enactment into law, the Temporary
Housi.ng Pro jects Lava, Healtn and Safety Code, State of Cali.fornia,
�ection 35�+50 to 355�6, inclusive, as amended, provides for tne
acquisition, ownership, operation, main�enance and disposal of
temporary housing projects acquired from the United States of
America; arid

yJHERE��, pursuant to �ection 355�0 t�ereof the City Council
of the City of Chula Vista finds and determines that the need for
the aperation of said temporary housing projects in whole or in part
has passed; and
'�HEREA�, the land comprising said temporary housing
projects is not required for other public uses; and
�4�tH�R:EA5, as of March l, 1959 �wart W. Goodwin, M o A o I.
and Richard B, Miller have made an appraisal of the fair market value
of Parcel A and Parcel B as of said date as follows:
Parcel A - Nine Hundred Thirty Thousand Seven
Hundred Dollars (�930,700.00);
Parcel B - Two Hundred Forty Four Thousand
Dollars ($2�+�+,000.00); and
�HF.RF.A�, the City Council of the City of Chula Vista desires
to invite proposals for the purchase of Parcel A and Parcel B at the
app raised faiz° market values and will cansider the giving of an option
to purchase Parcel C at its fair market value as fixed by an appraisal
to be made by Ewart Vd. Goodwin, M.A.I. and Richard B. Miller in the
event bidders submitting wri�ten proposals indicate in their written
proposals that tney be given an option to purchase said Parcel C a�
the priee specified;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
Cif;y of Chula Vista that the need for the operation of temporary
housing projects, Tract 1 (Cal-�+25g) , Tract 2 (Cal-�+259) and Tract 3
(Cal-�+099) , in whole or in part, has passed; and
RE iOLVED FUR'l��iER that the land comprising Parcels A and B
in said temporary housing projeets are not required for other public
purposes and that the land comprising Parcel C will not be required
for other public purposes on or after three (3) years f rom the date
hereof; and
RESOLVED FURTHER that any remaining dwellin.g structures in
said temporary housing projects shall be demolished; and

I�E�OLVED FU�THER tha� prospec�ive bidders interes�ed in
purchasing the land comprising Parcels A and B described herein
be invited ta submit written proposals for the purchase of same
upon tne �ollowing general terms and conditions:
l . Description of property and price:
(a) Parcel A is described in E�ibi� A attached
hereto and made a part hereof and contains 35038
acres, more or less, and subject to the other
terms and conditions con�ained herein, shall be
sold for Nine Hundred Thirty Thousand Seven
Hundred Dollars (�930,700,00) ;
(b) Parcel B is described in Exhibit B attached
hereto and made a par� hereof and contains 11.30
acres, more or less, and subjec� to the other
terms and conditions contained herein, shall be
sold for Two Hundred Forty Four Thousand Dollars
(�2�4,000,00) ;
(c) Parcel C is described in Exhibit C attached
hereto and made a part hereof and contains 3 .16
acres, more or 1ess� P�rcel G is p resently used for
city shops by the City of Chula Vista and will not
be available for passage of title or possession
prior �o three (3) years from the date hereof.
Bidders shall state in their bid proposals whe�her
they desire an option to purchase Parcel C three
(3� years from the date hereaf, in which event the
City of Chu1a Vista will cause to be prepared a
fair market value appraisal of said Parcel C by
Ewart �^T. Goodwin, M.A.I. and Richard B. Miller,
which appraisal when made shall constitute the
option price for said Parcel C.

2. All bid p roposals shall include an offer to purchase
Parcel A� Offers to purchase Parcel B and/or an option Lo
purchase Parcel C shall be optional with the bidder but the
bid proposal shall clearly set forth the intent of the bidder.
3. tidritten proposals shall be filed with the City Clerk
of �he City of Chula Vista on or before 5:00 o 'clock P .M. on
the first day of �eptember, 1959.
�+. The written proposals shall also include the follow-
ing information:
(a) Tentative design and layout of developmen� for
shopping cen�er purposes on Parcel A, subject to
modification if necessary or desirable;
(b) Complete description of the proposed shopping
center development (this will vary for each bidder
as ii; is contemplated that each bidder will have a
different approach to the development and reasonable
discretion is given to each bidder therefor);
The description should include the element of design
and the type of s�ores that bidder contemp].ates will
be in the shopping center. The design shall include
modern shopping center specifica�cions of square
foo�age store space in ratio to parking.a
(c) Bidders ' performance record wi�h par�icular
emphasis on past participation in shopping centers
shall be specified in detail . The bid proposal shall
state in detail the proposed methad of financing and
payment for Parcel A and Parcel B and shall state in
detail the proposed method of financing of the
shopping center improvemen�s.
(d) The bid proposal sha11 detail the time schedule
of development of the shopping center as planned by
the bidder;

(e) The bid proposal shall list the major stores
that the bidder proposes to bring into the shopping
center;
(f) The bid p roposal shall state in detail the
financial responsibility of the bidder.
5. The City of Chula Vista reserves the right to reject
any and all bid proposals for the purchase of all or any par�
o£ said real property, without cost or e�ense to the City of
Chula V�sta.
6. No real estate brokers ' commission vaill be paid by the
Gity of Chula Vista in connection with any sale of Parcels A,
B and/o.r C hereof; and
R.E�iOLVED FURTHER that within thirty (30) days after the
filing of said bid proposals the City Council of 'che City of Chula Vista
shall signify its intention to accept one of said bid proposals and/or
reject any or all of said bid proposals and in the event one oi said
bid praposals is accepted a written agreement wwill be entered into
between the City of Chula Vista and the successful bidder contingent
upon the zollowing:
(a) The deposit by said successful bidder at the time
of the execution of said agreement of the sum of Fifty
Thousar�d Dollars (y�50,000,00) same to be consideration for �he
execution os' said agreement and as security for the faithful
perforrriance by the successful bidder within a period of six (6)
months and to the satisfaction of the City of Chul.a Vista
of the matters contained in the written proposal of the
successful bidder and said written agreement shall
incorpc�rate therein and contain a reference to said wri�ten
proposalo In the event such successful bidder has not
comple'ced ti,�ithin a period of �ix (6) monLhs from the date
after �the execution of said agreement, or any extension
thereo:f granted by tne City of Chula Vista at its sole and
exclusive option, final plans and specif:ical:ions of said

p roposed shopping center, secured t��e f irm leases referred
to in tn� written proposal, furnished proof satisfactory
�o the City of Chula Vista of the successful bidder' s
financia:l ability to pay �or tne land and construct the
improvem�nts provided for and other matters detailed in
the written proposal and/or provided for in tlze contract,
then the City of Chula Vista shall have tne rignt to cancel
said agreement and to retain said sum as consideration for
the execution oz" said agreement and for �ne failure of the
successful biclder to comply wi�h the terms of the bid
proposal and the written agreement. In the event the
succ�ssful. bidder within said period of time or any extension
thereof provided for herein has complied witn the terms of the
bid proposal and said writ�en agreemen'c, then a final agreement
of purchase and sale of Parcel A or Parcel P. and Parcel B
and/or �n option on Parcel C shall be executed by the Ci�y of
Chula Vi.sta and the successful bidder; and
RE�>OLVED FURTHER that a nota.ce inviting proposals for the
purchase of said real property shall be published at least once prior
�o September 1, 1959 1n the following newspapers: The Chula Vista 5tar,
The �an Diegc� Union and The Evening Tribune and all editions for one
{1) day of The Wall �treet Journal and an affidavi� of due publication
thereof shal�. be filed wi�h the City Clerk oi the City of Chula Vista
v�lithin thirty (30) days after said publication; and
RE�OLVED FURTHER that sa3.d notice inviting proposals for �he
purchase of ,�aid real property shall be in �he following form:

1, Notice is hereby given that written proposals
ar� invited for the purchase from �he City of Chula Vis�a,
a municipal corporation located in tne County of �an Diego,

City of Chula Vista far shopp3.ng center purposes and
purposes incidental thereto.
2. The real p roperty referred to is described
gen.erally as follows:
Parcel A consists of approximately 35•38
acres, more or 1ess, and is bounded by Sroadway,
H. Street, I. S�reet and Fif�h Avenue in
Chula Vista, Californiao The sales price of
said Parcel A, subject to o�her terms and
conditions to be contained in a written proposal
submitted by bidders, is Nine Hundred Thirty
Thousand �even Hundred Dollars (�930,700,00)
which is a fair marke� value appraisal of said
Parcel A as of March 1, 1.959�
Parcel B consists of app roxima�ely 11v30
acres, more or less, on the i,asterly side of Fifth
Avenue between H, and I. Streezs, Chula Vista,
Galiforniao The sales price of said Parcel B,
subject to other terms and conditions to be con�ained
in a written proposal submitted by bidders, is �i'wo
Hundred Forty Four Thousand Dollars (�2��F,000,00)
which is a fair rnarket value appraisal of said
Parcel � as of March l, 1959�
Parcel C cansists of app roximately 3.16 acres ,
more or less, on �he Easterly side of Fifth Avenue at
H, �treet, Chula Vista, California, presently used
for ci.ty shops and availabl.e to successful bidd�rs
as to ownership and possession on an op�ion basis
three (3) years from the date hereof, the option

price to be a fair market value appraisal thereof
to be made by Etivart ��. GoodtiJin, M,A.I. and
Richard B. l��iller,
3. The City Council of the City of Chula Vista has
by resol.ution outlined the information to be submitted by
bidders for Parcels A, B and C, which parcels are more
particul.arly described in said resolution passed and -°
adopted by the City Council of the City of Chula Vista
on Tuesclay, the l�th day of July, 1959 �d to which
resolution further reference is hereby made. Persons
interesi;ed in submitting bids may secure detailed
informaf;�.on thereof, legal description of the property
and map:� from F, S, Fulwiler, Chief Administrative 0�'i.cer,
City of Chula Vis�a, 276 Guava Avenue, Chula Vista,
Califor�nia.
�+. No real esta�e brokersa commission tivill be paid
by the ��ity of Chu1a Vista for any sale which may be made
of said real proper�y described in said resolutinn or �his
notice.
5. The City of Chula Vista reserves the right to
reject any and all bid proposals as to all. or any part of
said real property referred to in Parcels A, B or C.
