HomeMy WebLinkAboutReso 1959-2240 1 $ ■ ■ RESOLUTION No. 2240 RESOLUTION GIVING NOTICE OF THE PROPOSED ANNEXATION TO THE CITY OF CHULA VISTA AND CHULA VISTA CITY SCHOOL DISTRICT, IN THE COUNTY OF SAN DIEGO, STATE OF CALIFORNIA TO BE KNOWN AS • PALOMAR ANNEXATION WHEREAS on the 4th day of May $195% there was filed in the office of the City Clerk of the City of Chula Vista a written petition for the annexation to, incorporation and inclusion in, the City of Chula Vista of certain uninhabited territory particularly described in said petition, and he:^einafter described, located in the County of San Diego, State of California, pursuant to the Annexation of Uninhabited Territory Act of 1939, as amended; and WHEREAS said petition was signed by the owners of not less than 25% of the Said in such territory by area and by value as shown on the last equalized assessnent roll of the County of San Diego, in which such territory is situated; and WHEREAS said Petition vas also accompanied by the written consent of more than 2/3 of the value of the ownersAof said uninhabited territory that the sazre maybe taxed to pay its proportionate share of any indebtedness or liability of the City of Chula Vista contracted prior to or existing at the time of the annexation thereof. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Chula Vista, as follows: THAT pursuant to the terms and provisions of the Annexation of Uninhabited Territory Act of 1939, as amended; NOTICE IS HEREBY GIVEN of the proposed annexation to, incorporation and inclusion in, the City of Chula Vista and Chula Vista City School District of cers1n uninhabited territory in the County of San Diego contiguous to the City of Chula Vista. The boundaries of the territory so proposed to be annexed to the City of Chula Vista and Chula Vista City School District are more particularly described as follows: ,_ I I R • • That said territory is hereby designated as Palomar Annexation NOTICE IS FURTHER GIVEN that on the 23rd day of June �9 59 at the hour of 7:00 o'clock , in the Council Chamber in the City Hall, Civic Center, Chula Vista, California, at a regular meeting of the City Council of said City, ar.y person owning real property within such territory proposed to he annexed and having any objections to the proposed annexation, may appear before the City Council and show cause why such territory should not be so annexed. At any time not later than the said hour set for hearing objections to the proposed annexation, any owner of property within the territory proposed to be annexed may file written protest against the proposed annexation. -2- Such protest shall state the nane or names of the owner or owners or the property • affected thereby and the description and area of such property in general terms* BE IT FURTHER RESOLVED, that the City Clerk of said City be, and he is hereby, directed to cause a copy of this resolution to be published at least twice, but not oftener than once a week, in the official newspaper of said City, to-wit: The Chula Vista Star-News, a newspaper of general circulation published in said City, and also in a newspaper of general circulation published outside of the City but in the County in which is located the territory proposed to be annexed; said publication to be complete at least 20 days prior to the date set for the hearing. Said City Clerk shall also cause written notice of such proposed annexation to be mailed to each person to whom land within the territory proposed to be annexed is assessed in the last equalized County assessment roll available on the date these proceedings are initiated, at the address shown on said assessment roll, or as known to said Clerk, and to any person who has filed his name and address and the designation of the lands in which he has any interest, either legal or equitable, with said Clerk. In the event any land within the territory proposed to be annexed is owned by the County of San Diego, said City Clerk shall also cause written notice of such proposed annexation to be mailed to the Board of Supervisors of such County.
