RESOLUTION OF THE CITY COUNCIL APPROVING
AGREEMENT FOR THE CONSTRUCTION OF IM--
PROVFi1ENTS ITV COUNTRY CLUB VIEW NO .2.
THE CITY COUNCIL OF THE CITY OF CHULA VISTA, DOES HEREBY RESOLVE AS
FOLLOWS:
SECTION to That certain agreement between the CITY OF CHULA.
VISTA, a municipal corporation, and John B, Moran Construction Co4.1,.Inc.

`"t-iEPEAS the Second Party is desirous of supplying such assurances,
NO'', THEREFORE, I T IS HEDEEY AGREED BY and between the City of Chula
Vista, and the Second Party as follows:
1 . Said Second Party agrees fo undertake and complete, and to
pay for all labor and materials in connection therewith, within a
period of 365 days from he date hereof, ail the necessary work
and installation of improvements in the hereinabove described sub-
division in full conformity with thr ordinances of the City of Chula
Vista, the laws of the State of California and the directions of proper
officials of the City of Chula Vista, California as may be applicable
thereto. Said improvements are more particularly described as follows:
and as shown on plans 59-48L, 59-49L, 59-50L, 59-511; and 59-52L on file
in the office of the City Engineer of Chula Vista, California;

The Second Party further agrees to indemnify, protect and hold
harmless the said City of Chula Vista from any and all claims of
liability for personal injury, property damage, labor or material
claims which may be made against said City by reason of said work and
installation of improvene.its as herein provided.
2. As a guarantee and as security for its full and faithful per-
formance in complying with ail the requirements for the completion of
said subdivision as aforesaid, the said Second Party shall deliver to
the City of Chula Vista, upon the execution of this agreement, a good

and sufficient bond executed by an authorized surety company saris.'

factory to the said City of Chula Vista in the sum of$ 121,669.95
3. As a guarantee and as securtly for the payment of all material
and labor claims for the completion of all said improvements, the
• Second Party shall deliver to the said City of Chula Vista a bond in
the sum of $ 121 ,669.95 , by its terms made to inure to the
benefit of laborers and materialmen, for labor and material performed
or furnished in the performance of this agreement.
4. Upon the execution by Second Party of this contract and the
• posing of the bonds as herein provided, the City agrees to approve
the final map of said subdivision and accept the same for recordation.

Gentlemen:
At the Planning Commission meeting of May L, 1959, the final m.
of Country Club View No. 2 was considered.
The Planning Commission recommends that this map be accepted sub-
• ject to the following conditions:
1. Montclair Street be eliminated east of Oleander Avenue
to align more closely with freeway plans.
2. Sewer on Naples to be constructed on centerline by first
developer or by joint contract with adjacent developer.
3. Slope rights easement, if required due to grading plan, to
be submitted to city prior to submission of final map to
Council.
4. Surface drainage at boundaries to be provided for, to pre-
clude fill slope erosion, etc.
5. All cut and fill slopes to conform to,FHA standards and be
planted to FHA standards. ,
6. Subdivider to provide a copy of lot grading plans for use
by city engineering department.
