RECITALS A. Project Site �i%HEREAS; the area of land �vhich is the subject of this Ordinance is dia�rammaticall}� represented in "Eshibit A" attached to and incorporated into this Ordinance, and commonl�� l:no�i�n as Villaee 2 SPA Amendment ('Projecr'); and for the general purpose ofgeneral description herein consists ofapproximatel}�32�.7 acres located south of Ol��mpic Park��a�� and west of La A4edia Road �vithin the Ota}� Ranch Villaee 2 Planned Community (`Project Site '); and � B. Projecr, Application for Discretionarv Appro��als V�'HEREAS, a duly verified application was filed ���ith the City of Chula Vista De<<elopment Sen�ices Department on Julv 9, 2012 by Baldwin & Sons(`Applicant. O��mer, and De��eloper'), requesting appro��al of amendments to the Otay Ranch Villaee 2 Planned Community District (PC) ReQulations and Land Use Districts Map; and � C. Prior Discretionan� Appro��als W"HEREAS, de��elopment of the Project Site has been the subject matter of various entitlements and agreements; including: 1) a General Development Plan, SPA Plan and associated Design Guidelines, PFFP: WCP.AQIP and Comprehensive Affordable Housing Plan pre��iousl}� approved bv Cit�� Council Resolution I�'o. 2006-1�6 on n4ay 23, 2006. amended Cin� Council Resolution No. 2012-009 on Januarv 24. 2012. and Cih� Council Resolution No. 2012-0�6 on April 3, 2012; 2)Planned Communin•District Regulations and Land Use Districts Map appro��ed by City Council Ordinance I�'o. 3036 on June 6, 2006; amended b�� Cirv Council Ordinance No. 322� on Februan� 14. 2012. and amended b�� Cih� Council Ordinance No. 3228 on April 17,2012; 3)Tentative Subdivision A4ap(CVT 06-0�) approved b}� City Council Resolution 2006-1�7 on Ma}� 23, 2006; Tentati��e Subdivision Map (CVT 11-OZ) approved by Cirv Council Resolution 2012-]0; Tentative Subdivision I�4ap (CVT 11-03)<approved b�� City Council Resolution 2012-11; Tentative Subdi��ision D4ap(CVT 11-04)approved b��Cit}�Council Resolution 2012-12:and Tentati��e Subdi��ision Map (CVT 11-0�) appro��ed b}� Cin�Council Resolution 2012-li on Januan�24; 2012; and Tentati��e Subdi��ision Map(CVT 1 1-01)approved by City Council Resolution 2012-0�7 on April 3: 2012; and Ordinance No. 3325 Page No. 2 D. Planning Commission Record of Application WHEREAS, the Planning Commission set the time and place for a hearing on the Project, and notice ofthe hearing.together with its purpose,was given by its publication in a newspaper of general circulation in the City, and its mailing to property owners��ithin �00 feet of the exterior boundan� of the Project, at least ten (]0) days prior to the heazing; and N'HEREAS; the Planning Commission held an advertised public hearing on the Project on October 8,2014,and the Planning Commission did not aci on the resolution since the Planning made a motion that the Ciri� Council reject the project by not makine certain findings of fact; not adopt a Statement of Overriding Considerations;not adopt a Mitigation Monitoring and Reporting Program and not Certify the Final Supplemental Environmental Impact RepoR(FSEIR 12-01/SCH 2O03091012)for amendments to the General Plan, Otay Ranch General Development Plan, Otay Ranch Villages Two, Three and a portion of Four Sectional Planning Area Plan, four associated Tentative Maps pursuant to the Califomia Environmental Quality Act This motion canied 5-1-0-1; and WHEREAS, the proceedings and all evidence introduced before the Planning Commission at the public hearing on this project held on September 24, 2014, and the minutes and resolution resulting therefrom, are hereby incorporated into the record of this proceeding; and E. City Council Record of Application WHEREAS, the City Clerk set the time and place for the hearing on the Project application and notices ofthe hearing,together with its purpose,was given by its publication in a ne�vspaper of general circulation in the city and its mailing to property o���ners ��ithin 500 feet of the exterior boundaries of the Project at least ten (10) days prior to the hearina; and � WHEREAS, the duly called and noticed public hearing on the Project was held before the Ciri� Council of the City of Chula Vista on November 4; 2014, in the Council Chambers in the Ciri� Hall, City of Chula Vista Civic Center, 276 Fourth Avenue, at 4:00 p.m. to receive the recommendations of the Planning Commission, and to hear public testimony with regard to the same; and F. Discretionary Approvals Resolution and Ordinance WHEREAS, at the same City Council hearing at �vhich this Ordinance was introduced for first reading on November 4,2014 the City Council of the City of Chula Vista approved Resolution No. 2014-208, by which it approved amendments to the Otay Ranch Village 2 GDP, SPA Plan,Design Guidelines,the Supplemental Public Facilities Financing Plan, the Air Quality Improvement Plan and the Water Conservation Plan, and Tentative A�ap: and Ordinance I�'o. 332� Paee No. 3 G. Environmental Determination VIHEREAS, The Development Services Director has reviewed the proposed project for compliance w-ith the Califomia En��ironmental Quality Act(CEQA)and has determined that the project may have a siQnificant effect on the en��ironment as identified in pre��ious FEIR 02-02; therefore,the Cin�of Chula V ista has prepared a Supplemental Environmenta] Impact Report. SEIR-12-01/SCH 2O03091012 pursuant to CEQA 1�163. I�'O�'. THEREFORE. the Cirv Council of the Cin�of Chula Visia does hereb��find. determine and ordain as follo���s: A. COI�'SISTENCY V�'ITH GEI�'ERAL PLAI�' The Citv Council finds that the proposed amendments to the Ota�� Ranch Villaee 2 Planned Community District Reeulations and Land Use District Map aze consistent ��ith the Cin�of Chula Vista General Plan. The residential nature of the proposed use �aould be consistent���ith the adopted residential desienations for this project site and compatible«-ith the surroundine residential and villaee-related land uses ofthe Ota�- Ranch area. B. APPROVAL OF PROPOSED AMENDMENTS The City Council approves the amendments to the Otay Ranch Village 2 Planned Communin�District Reeulations and Land Use District Map as represented in Exhibit B and Attachment 6. on file in the office of the Cin� Clerk.
