HomeMy WebLinkAboutReso 1959-2339 • RESOLUTION Noe 2339 RESOLUTION GIVING NOTICE OF THE PROPOSED ANNEXATION TO THE CITY OF CHULA VISTA AND CHULA VISTA CITY SCHOOL DISTRICT, IN THE COUNTY OF SAN DIEGO, STATE OF CALIFORNIA TO BE KNOWN AS CUNNINGHAM ANNEXATION WHEREAS on the 14th day of October 19 59p there was filed in the office of the City Clerk of the City of Chula Vista a written petition for the annexation top incorporation and inclusion in, the City of Chula Vista of certain uninhabited territory particularly described in said petitions and hereinafter described, located in the County of San Diego, State of California, pursuant to the Annexation of Uninhabited Territory Act of 1939, as amended; and WHEREAS said petition was signed by the owners of all the land in such territory by area and by value as shown on the last equalized assessment roll of the County of San Diego, in which such territory is situated; and WHEREAS said petition was also accompanied by the written consent of the owners of more than two-thirds of the value of said un- inhabited territory that the same may be taxed to pay its proportionate share of any indebtedness or liability of the City of Chula Vista con- tracted prior to or existing at the time of the annexation thereof. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Chula Vista, as follows: THAT pursuant to the terms. and provisions of the Annexation of Uninhabited Territory Act of 1939, as amended; NOTICE IS HEREBY GIVEN of the proposed annexation top ineorporation and inclusion in, the City of Chula Vista and Chula Vista City School District of certain uninhabited territory in the County of San Diego contiguous to the City of Chula Vista. The boundaries of the territory so proposed to be annexed to the City of Chula Vista and Chula Vista City School District are more particularly described as follows: CUN Ni I NG lAM ANNE XA T I .N All that unincorporated area in the County of San Diego, State of California, Rancho de is Nacion according to map thereof No 166 filed in the office of the County Recorde: of said County May II , 1869, described as follows : Beginning at center of Quarter Section 89, thence N 38° 39' 20" a distance of 659.88 feet to the TRUE POINT OF BEGINNING. 1 . Thence S 71° 15' 50" 1 a distance of 132 feet; 2. Thence N !3° 396 20" j a distance of 330. 1 feet; 3. Thence N 71° 15' 50" E a distance of 132 feet; 4. Thence, S 18° 39' 20" E a distance of 330. 1 feet to the TR!JE POI IT OF BEGIN`JING. Said Annexation contains 1 acre. 11/2/59 That said territory is hereby designated as Cunningham Annexation NOTICE IS FURTHER GIVEN that on the 15th day of December 1959 at the hour of 7:00 P.M. o'clock in the Council Chamber at the City Hall, Civic Center, Chula Vista, California, at a regular meeting of the City Council of said City, any person owning real property within such territory proposed to be annexed and having any objections to the pro- posed annexation, may appear before the City Council and show cause why such territory should not be so annexed. At any time not later than the said hour set for hearing objections to the proposed annexation, any owner of property within the territory proposed to be annexed may file written protest against the proposed annexation. Such protest shall state the name or names of the owner or owners of the property affected thereby and the description and area of such property in general terms, BE IT FURTHER RESOLVED, that the City Clerk of said City beg and he is hereby directed to cause a. copy of this resolution to be published at least twice, but not oftener than once a week, in the official newspaper of said City, to-wit: The Chula Vista Star-News, a .newspaper of general circulation published in said City, and also in a newspaper of general circulation published outside of the City but in the County in which is located the territory proposed to be annexed; said publica- tion to be complete at least 20 days prior to the date set for the hearing. In the event any land within the territory proposed to be annexed is owned by the County of San Diego, said City Clerk shall also cause written notice of such proposed annexation to be mailed to the Board of Supervisors of such County.
