AGREED by and between the CITY OF CHULA VISTA, a3 Municipal Corporation, and Stardust Investment Co, and Corte Maria Investment Co. , both California , hereinafter called Second Party,, as follows: vi 1NESSETH: • TFIEPEAS the Second Party is the owner of real property in the City of Chula Vista, ,County of San Diego, State of California, described as foi-iows: The South Half of the NW4 of the SW4 and the SWI of the SW4 and the South Half of the SET of the SW4 ,all in 4 Section 95 of the Rancho de la Nacion according to Map thereof • " ' No 166 filed May 11, 1869 in the office of the County Recorder of said San Diego County. Barricades 40 1.f. @ 4.00 160.00 19: Conc. walls 160 1.f. © 1.00 160.00 Sub-total 120,630.24 • 10% for Contingences . 12,o63.02 • Bond Amount 132,693.26 The Second Party further agrees to Indemnify, protect and hold • ' " • harmless the said City of Chula Vista from any and all claims of liability for personal injury, property damage, tabor or material claims which may be made against void City by reason of said work and installation of improvements as herein provided. 2, As a guarantee and as security for Ifs full and faithful per• formance in complying with alt the requirements for the completion of said subdivision as aforesaid, the said Second Party shall deliver to the City of Chula Vista., upon the execution of this agreement, a good -2- good and sufficient bond caecuted by an authorized surety company satisfactory to the said City of Chula Vista in the sum of 3. As a guarantee and as security for the payment ci all material and labor claims for the completion of all said improvemants, the Second Party shall deliver to the said City of Chula Vista a bond in the sum of $ 66,346.63 , by its terms made to inure to the benefit of laborers and materialmen, for labor and material performed or furnished in the performance of this agreement, 4. Upon the execution by Second Party of this con;mact and the posting of the bonds as •herein provided, the City agrees to approve the • final map of said subdivision and accept the same for recordation.
