HomeMy WebLinkAboutReso 1960-2492 • �t - -RESOLUTION -No. 2492 - A RESOLUTION'BY THE CITY COUNCIL OF"THE CITY OF CHULA VISTA MODIFYING THE TERMS OF ORDINANCE No. 670 WITH RESPECT TO . -ENCL--OSING-SWIMMPNG-'POOLS - - WHEREAS, Section 6 of Ordinance No. . 60 gives the City Council authority to provide for specific modifications of the terms of said ordinance with respect to the enclosing of swimming pools, upon the finding of certain facts, and WHEREAS, R. S. Seabrook, Ralph Keithley, Frank Robinson, and Cy Ramage have made applications to the City Council for modification of the terms of said ordinance with respect to the swimming pools located at 385 Hilltop Dr. , 19 East Cresta Way, 365 Hilltop Dr. , and 103 Second Ave. for the reasons set forth in said applications, NOW THEREFORE, the City Council of the City of Chula Vista does hereby find as follows: 1. That strict compliance with the terms of said ordinance will not materially benefit or safeguard the public because of the follow- ing facts: The pools are located in an- isolated section of the community, surrounded by hedges and shrubs and hidden from the street, and 2. That the work of construction for the enclosure of said swimming pools, required by said ordinance, will result in undue hard- ship to the owners or occupants or persons in possession or control of said property because of the following facts: There would be no material benefit or safeguard to the 'public, lic, NOW THEREFORE, IT IS HEREBY RESOLVED AND ORDERED AS FOLLOWS: 1. That the following specific modifications of the terms of said ordinance are allowed to said applicants in connection with said swimming pools on said properties. Gentlemen, Subject: Request for exemption from Fence Ordinance 670. Recently the property owners in the area of Hilltop Drive and Cresta Way, by unanimous election, have been annexed by the city of Chula Vista. My home, at the above address:, with swimming pool was built in 1950 and is included in this annexation. This pool has had our personal supervision and an happy to day that every youngster in this neighborhood, almost without exception, has learned to swim in this pool. We do not believe that this pool is in any way a hazard to the public, as it is quite sheltered and is immediately adjacent to our living room. Mrs. Seabrook and I have spent a great deal of time and money in the preparation and maintenance of an attractive garden and a fence will detract to.a great extent the pleasure we derive from our garden. I have been advised that the members of the City Council have examined' the fence situation in connection with my pool and request that you give serious consideration to this request to exempt my pool from the requirements- of Ordinance number 670. CALIFORNIA July u y 29, 1960 City of Chula Vista City Council Chula Vista, California Gentlemen: Will your honorable body please favorably . consider the exemption of my residence at 19 East Cresta Way, Chula Vista from compliance with the requirements of Ordinance No. 670, "An Ordinance Establishing Regulations With Respect To Enclosure Of Swimming Pools. " This request for exemption is based upon Section 6, "City Council 's Authority To Modify," which states that such modification may be made "when it is determined that strict compliance with the terms of this ordinance will not materially benefit or safeguard the public and that the work to be done will result in undue hardship to the owners or occupants or persons in possession or in control of said property. " I submit that the pool located on the above mentioned property is so situated that compliance with the terms of the Ordinance would, in fact, not materially benefit or safeguard the public, and that fencing as required would, in fact, cause undue hardship to me because .of the extreme lengths of fencing necessary if detraction from the property value is to be avoided. I believe that each member of the Council and, in addition, Mr. Fred Ross , have in the recent past taken time to personally inspect the existing circumstances , for which courtesy I wish to thank you.
