TER VALLEY INDUSTRIAL PARK IT IS HEREBY AGREED by and between the CITY OF CHULA VISTA a municipal corporation, and TROUSDALE CONSTRUCTION COMPANY, hereinafter called Second Party, as follows: W I T N E S S E T H: WHEREAS, second Party is the owner of the real property in the City of Chula Vista, County of. San Diego, State of • California, as shown on the map of Sweetwater Valley Industrial Park; +HEREAS, Second Party has petitioned for the conduct of appropriate special assessment and assessment bond proceedings • by the City to finance the cost of said acquisitions and improve- , . . • ments and of the incidental expenses in connection therewith; WHEREAS, Second Party proposes to create a subdivision of the property above described, to be known as Sweetwater • Valley Industrial Park, and to effect the same as heretofore filed with the proper authorities of the said City of Chula Vista the necessary maps and improvement plans and other data in con- . • • ' formity with the laws of the State of California and the ordinance- , of the City of Chula Vista applicable thereto; WHEREAS, the said proper authorities of said City have found the proposed subdivision plan'.;to be acceptable and in actor• with the best interests of said City; and • WHEREAS, the City of Chula Vista is entitled to require from the Second Party, and does require from Second Party, as a condition precedent to the acceptance of any and all streets and easements and other improvements, assurances for the comple- tion of the public improvements, in said subdivision as is .rovid ed therefore in said plans and attendant specifications as save • • heretofore been approved , pproved as aforesaid; NOW, THEREFORE, IT IS HEREBY AGREED by and between the City of Chula Vista and the Second Party, as follows: • 1. Said Second Party agrees to undertake and complete, and to pay for all labor and materials in connection therewith, within • a period of one (1) year from the date hereof, all the necessary • • work and installation of improvements in the hereinabove described subdivision in full conformity with the improvement plans desig- nated Sweetwater Valley Industrial Park and bearing Nos. 60-62L through and inclusive of 60-74L, a set of which is on file in the • office of the City Engineer, and the ordinances of the City of • Chula Vista, the laws of the State of California and the direction- of proper officials of the City of Chula Vista, California, as may be applicable thereto. • • 2. Said improvements are more particularly described as . follows: (a) The improving of Cypress Lane, Glover Avenue Frontage Road, Trousdale Drive, Willow Street, the portion of Highland Avenue east of the existing .pavement between Frontage Road and Trousdale Drive by grading, including the removal of existing structures and obstructions, and the construction therein of a.select material base pave- ment and asphalt concrete surf acing, and Portland cement concrete curbs, gutters and street signs, and a barricade • at the northerly and southerly ends of Glover Avenue. • (b) The construction of a catch basin at the easterly end of-the easement between Lots 8 and 9, Block II, as shown on the Map of Sweetwater Valley Industrial-Park; a corrugated metal pipe storm drain thence westerly in said • ,: easement to and across Cypress Lane; and catch basin on • either side of Cypress Lane, and an outlet structure on the westerly side thereof; a gunnited open ditch storm drain thence westerly along an easement between Blocks III and IV, said Map, to the easterly side of Glover Avenue, a concrete headwall inlet structure on the east side of Glover Avenue, a reinforced concrete junction box on the west side thereof connected by a corrugated metal pipe with catch basins; a corrugated metal pipe storm drain westerly in an easement between Lots 13 and 14, Block VI, said Map, to the westerly line thereof; a headwall outlet - structure at said point, and thence in a gunnited open ditch storm drain to be constructed in an easement between .. Blocks I and VI to Lot 31, Block VI, and thence in an arc• to the left to terminate at a point adjacent to the north- erly extension of the westerly line of Lot 42, Block I, being located in Lot A and adjacent to the subdivision boundary, said Map, a cross gutter across the intersection • of Willow Street and Frontage Road and thence westerly in a concrete drainage ditch to rip rap adjacent to the • easterly line of Highland Avenue, and the construction of an inlet structure at the intersection of Trousdale Drive and Highland Avenue, the removal of the existing ditch and berm along the easterly side of Highland Avenue and the • „ ofoll�tinr nfl nnrrnrnmfarl ma4al Hint. ef.nrm drain in place • • • . • thereof between the northerly side of the intersection of Highland Avenue and Trousdale Drive and the northerly side of the intersection of Frontage Road and Highland Avenue, the construction at said intersection of a gravity type • headwall and thence between Highland Avenue and .Frontage • Road in a concrete •ditch to the rip rap describedabove. (c) The construction and installation of sanitary sewerage facilities .consisting of sewer mains together with standard manholes and manhole frames and covers in Willow Street from Frontage Road to the cul- de sac and fro Glover Avenue to its easterly terminus, in Cypress Lane, • Glover Avenue, Trousdale Drive and Frontage Road for their entire lengths within Sweetwater Valley Industrial Park and in an easement across the westerly end of Lot 25, Bloc I and along the easterly side of Lot 13, Block I to a sani- tary sewerage pump. station site .in the southeasterly corner of Lot 13, Block I, the construction and installa- tion of a sanitary sewage pumping. station complete, upon . said site, and the construction of a sanitary sewerage . . force main from said pump station site to and in Trousdale • • • Drive and across Highland Avenue to the existing sanitary • sewer manhole on the westerly side of Highland Avenue opposite its intersection with Trousdale Drive. • (d) The acquisition and construction of all lands, easements, facilities and works auxiliary to any of the above and necessary to complete the same. • 3. Second Party further agrees to indemnify, protect and hold harmless the said City of Chula Vista ,from any and all claims of liability for personal injury, property damage, labor or • • material claims which may be made against said •City.by reason of said Work and installation of improvements. as herein provided. • • • 4. As .a guarantee and as security for its full and faith- • ful performance in complying with all the requirements. for the • completion of said subdivision as aforesaid, the. said Second • Party shall deliver to the City of Chula Vista, upon the executio • • of this agreement, a good and sufficient bond executed by an • authorized surety company satisfactory to the said City of Chula Vista in the sum of $ 280,000.00 • 5. As a guarantee and as security for the payment of all • material and labor claims for the completion of all said improve- ments, the Second Party shall deliver to the said City of Chula Vista a bond in the sum of $ 140,000.00 by its tents made to inure to the benefit of laborers and materialmen, for labo' and material performed or furnished in the performance of this agreement. - 6. Upon the execution by Second Party of this contract and the posting of the bonds as herein provided, the City agrees • to approve the final map of said subdivision and accept the same for recordation.
