RESOLUTION OF THE CITY COUNCIL APPROVING AGREEMENT
FOR THE CONSTRUCTION OF IMPROVEMENTS IN
SWEETWATER VALLEY INDUSTRIAL PARK

RESOLVE AS FOLLOWS:
SECTION 10 That certain agreement between
the CITY OF CHULA VISTA, a municipal corporation, and

IT IS HEREBY AGREED by and between the CITY OF'CHULA
. • • VISTA; a municipal corporation, and TROUSDALE CONSTRUCTION
COMPANY, hereinafter called .Second Party, as follows:
W I T N E S S E T H :
WHEREAS, Second Party'is the owner of the real prop-
. ' erty in the City of Chula Vista, County of San Diego, State
of California, as shown.on the map of Sweetwater Valley Indus-
trial Park;
WHEREAS, Second Party has petitioned for the conduct
• of appropriate special .assessment and assessment bond proceed-
ings by the City to finance the cost of said acquisitions and
improvements and of the incidental expenses :in connection
therewith;
WHEREAS, Second Party proposes to create a subdivision
•
of the property above described, to be known as Sweetwater
•
Valley Industrial Park, and to effect the same as heretofore
• filed with the proper authorities of the said City of Chula
• Vista the necessary maps and improvement plans and other data
• in conformity with the laws of the State of California and
the ordinances of the City of Chula Vista applicable thereto;
WHEREAS, the said proper authorities of said City have
found the proposed subdivision plan to be .acceptable and in
accord with the best interests of said City; and
•
WHEREAS, the• City of Chula Vista is entitled to require
• from the Second Party, and does require from Second Party, as
•
•

•
a condition precedent to the acceptance of any and all streets
and easements and other improvements, assurances for.the com-
pletion of. the public improvements, .in said subdivision as is
provided therefor in said .plane and attendant specifications
as hate heretofore been approved as aforesaid;

NOW, THEREFORE, IT IS HEREBY AGREED by and between the
•
City of Chula Vista and the Second Party, as follows:
•
1. Said Second Party agrees.to undertake and complete,
•
and to pay for all labor and materials in connection there-
with, within a period of one (1) year from the date hereof,
all the necessary work and installation of-improvements in
the hereinabove described subdivision in full conformity with
the ordinances of the City of Chula Vista, the laws of the
State of California, and the directions of'proper officials of
• the City of Chula Vista, California, as may be applicable
• thereto.
2. Said improvements are more particularly described
• . as follows:
(a) The improving of Press Lane, North Glover
Avenue Frontage Road, Trousdale Drive, Willow Street,
the portion of Highland Avenue east of-the existing
pavement between Frontage Road and Trousdale 'Drive
by grading, including the removal of existing struc-
- tures and obstructions, and the construction therein
of-.a select material base pavement and asphalt con-
crete surfacing, and Portland cement concrete curbs,
gutters, sidewalks and street signs, and a barricade
at the northerly and southerly ends of North Glover
Avenue, and at the Easterly end of Willow Street,
East of Press Lane.
. (b) The construction of a catch basin at the
easterly end:of the easement between Lots 8 and 9,
Block' II, as shown on the Map of Sweetwater Valley
Industrial Park; a corrugated metal pipe storm drain
thence westerly in said easement to and across Press
' .' Lane; a catch basin on either side of Press Lane, and
an outlet structure :on the westerly side thereof; a
gunnited open ditch storm drain, thence westerly along
• an easement between Blocks III and IV, said Map, to
• the easterly side of North Glover Avenue, a concrete
• headwall• inlet structure -on the east-side of.North
• Glover .Avenue, a 'reinforced concrete junction box on

• • the'west side thereof connected by a corrugated
•
• metal pipe •with catch basins; a corrugated metal
pipe storm drain westerly in an easement between
Lots 13 and 14, Block VI, said Map, to the westerly
line thereof; a headwall outlet structure at •said
point, and- thence in a gunnited open ditch storm
• . drain to be constructed'in an easement between Blocks
I and VI to Lot 31, Block VI, and thence in .an arc to
the left to terminate at point adjacent to the north- '
•
erly extension of the westerly line of Lot 42, Block I,
being located in Lot A and adjacent to the subdivision
boundary, said Map, across gutter across the inter-
• .section of Willow Street and Frontage Road, and thence
westerly in a concrete drainage ditch to rip rap adja-
. cent-to the easterly line of Highland Avenue, and the
construction of. an inlet structure at the intersection
of Trousdale Drive .and Highland Avenue, the removal of
the existing ditch and berm along the easterly side of
• Highland Avenue and the installation of corrugated
metal pipe storm drain in place .thereof between the
northerly side .of the intersection of Highland Avenue
and Trousdale Drive and the northerly side of the in-
tersection of Frontage Road and Highland Avenue, the
•construction ..at said intersection of a gravity type
headwall and thence between Highland Avenue and Front-
age Road in a concrete ditch to the rip rap described
above.
(c) The construction and installation of sanitary
sewerage facilities consisting of sewer mains together
with standard manholes and manhole frames and covers
in Willow Street from Frontage Road to the cul de sac
and from North Glover Avenue to its easterly terminus,
in Press Lane, North Glover Avenue, Trousdale Drive

• and Frontage Road for their-entire lengths within
Sweetwater Valley" Industrial Park .and in an easement
across the westerly end of Lot 25, Block I, and along
the westerly -side of Lot 15, Block I, to a sanitary
sewerage pump station site in the southwesterly corner '
of Lot 15, Block If . the construction and installation
of a sanitary sewage pumping station complete, upon
said site, and the construction of a sanitary sewerage
force main from said pump station site to and in Trous-
dale Drive and across Highland 'Avenue to- the existing
•
sanitary sewer manhole. on the westerly side of Highland
Avenue opposite its intersection with Trousdale Drive.
• (d) The- acquisition and construction of all lands,
• easements, facilities and works auxiliary to any of the
above and necessary to complete the same.
3. Second Party further agrees to indemnify, protect
•
and hold harmless the said City of Chula•Vista from•any and
all claims of liability for personal injury, property damage,
labor or material claims which may be .made against said City
• . by reason of said work and installation of improvements as
herein provided.

4. As a guarantee and as security. for its full and
faithful performance in complying with all the requirements
for the completion of said subdivision as aforesaid, the said
Second Party shall deliver to the City of Chula Vista, upon
• the execution of this agreement, a good and sufficient bond
• executed by an authorized surety company satisfactory to the
•
said City of Chula.Vista in the sum of $2130,000.00.
5. As a guarantee and as security for the payment pf
all material and labor claims for the completion of all said
improvements, the Second Party shall deliver to the said City
of Chula Vista abond in the sum of $140,000.00 'by its terms
made to inure to the benefit of laborers and materialmen, for
labor and material performed or furnished in the performance
• • of- this agreement.
6. Upon the execution-by Second Party of this contract
and the posting of the bonds as herein provided, the City
agrees. to approve the final map of said subdivision and accept
the. same for recordation.
