HomeMy WebLinkAboutReso 1992-16688 CITY COUNCIL RESOLUTION NO. 16688 REDEVELOPMENT AGENCY RESOLUTION NO. 1260 RESOLUTION OF THE CITY COUNCIL AND REDEVELOPMENT AGENCY OF THE CITY OF CHULA VISTA APPROVING THE FIRST AMENDMENT TO LEASE AGREEMENT AND FIRST AMENDMENT TO MEMORANDUM OF LEASE WITH THE HOMART DEVELOPMENT COMPANY FOR THE LEASE OF CERTAIN REAL PROPERTY LOCATED AT THE CHULA VISTA CENTER IN THE CITY OF CHULA VISTA, CALIFORNIA The City Council and Redevelopment Agency of the City of Chula Vista do hereby resolve as follows: WHEREAS, the City and Agency entered into a certain Lease Agreement with the Homart Development Company ("Homart") dated September 1,1987 (lithe Lease") for certain real property located at the Chula Vista Center, 555 Broadway, within the City of Chula Vista, California; and, WHEREAS, Homart and the Agency executed a Memorandum of Lease date September I, 1987, pertaining to the Lease which was recorded in the San Diego County Recorder's Office on September 23, 1987; and, WHEREAS, Secti on 4.7 of the Lease provi des that Homart sha 11 have the ri ght to substitute for the leased parcel in whole or in part any other parcel situated within the site provided that certain conditions set forth in said Section 4.7 are satisfied; and, WHEREAS, Homart now request to substitute a portion of this site for a portion of the leased parcel in order to accommodate the second expansion of the Chula Vista Center; and, WHEREAS, the conditions in Section 8 of the Lease Agreement have be~n satisfied and Homart and the Agency desire to amend the Lease and the Memorandum to modify the leased parcel as herein set forth. NOW, THEREFORE BE IT RESOLVED by the City Council and Redevelopment Agency of the City of Chula Vista that the First Amendment to the Lease Agreement and First Amendment to the Memorandum of Lease with the Homart Development Company, said documents known as document number C092-097, a copy of which is on file in the office of the City Clerk, and also known as Document RACO-16-92 and on file in the Office of the Secretary to the Redevelopment Agency, is hereby approved -- -- ------- Resolution No. 16688 Page 2 and the Mayor of the City of Chula Vista and Chairman of the Redevelopment Agency of the City of Chula Vista is hereby authorized to execute said Agreement.
