Misdemeanor Penalties. Initiative Statute. -- has qualified for the I`'ovember 4. 2014 StateH�ide General Election; and V�'I-IEREAS, Proposition 47 proponents concede that the measure �+�ill make up to 10,000 felons elieible for earl�� release: and WHEREAS. ��ith the implementation of Public Safetv Realienment in 2011, �;�hich altered sentencing polic}� by shifring ne��l}� convicted non-��iolent, non-serious, non-ses offenders to count}� supervision. the population of non-violent offenders in CaliFomia's prisons has significantly diminished, and there is a leeitimate question as to ho��� many of the ]0;000 inmates elieible for eazlv release could be classified as high-risk for committing subsequent violent offenses: and WIIEREAS_ Proposition 47 contains pro��isions re-classifi�ing a host of felony offenses or felon}�/misdemeanor offenses as simple misdemeanors, representing s��eepine sentencing reform that ���ould be better accomplished through legislative processes; and �l'HEREAS. Proposition 47 ti�ould redefine erand theft in such a ���a�� that theft of a firearm would be considered a misdemeanor unless the ��alue of tbe eun ���as areater than �9�0, and the over��helmine majority of ne�v handguns sold in Califomia retail for sienificantly less than that amount: and� �1'HEREAS. Proposition 47 would reduce the penalty for possession of illicit drues, includino drugs used to facilitate date-rape, to a simple misdemeanor; and WHEREAS. Proposition 47 further burdens local criminal justice s}�stems by shiftine responsibilit}� for additional categories of offenders to alread�� o��ercro���ded countv jails. NOA'. THEREFORE. the Cih� Council of the Citv of Chula Vista resol��es as follows: SECTIOI�' 1. The Cin- Council of the Cit�� of Chula Vista by the adoption of this resolution herebv opposes Proposition 47 on the \o��ember 4, 201� ballot.
