HomeMy WebLinkAboutReso 2014-181 RESOLUTION N0. 2014-181 RESOLUTIO?�' OF THE CITI' COIJ?�'CIL OF THE CITY OF CHUL.A VISTA SUPPORTII�'G SAN DIEGO`S NATION.4L POLLUT.AI�'T DISCH.ARGE ELI?�4I\ATION SYSTEA4 (NPDES) MODIFIED PERI�4IT FOR THE POI?�'T LOA4A A'ASTEV��.4TER TREATMENT PLA?�TT VdHEREAS; the Point Loma �'astewater Treatment Plant (PLR'TP) is a regional facilit�� in the A9etro Vdaste�vater S��stem, operated b}� the Cit}� of San Diego, permitted to treat 240 million gallons of�;�aste�aater per da�� to an Ad��anced Priman� Le��el, serving a 12 member Joint Po�vers Authorit�� that comprises approzimatel�� 3�% of the total flo�� in the A4etro Vl'asteH�ater S��stem/PLI�'TP: and «'HEREAS_ the Clean «'ater .4ct of 1972 requires that �iaste«�ater be treated to achie��e certain protections before ocean discharge, that ti�astewater treatment plants be permitted, and that ���aste«�ater treatment plant permits be rene�;�ed e��ery fi��e }�ears: and \�Z-IEREAS, the Ocean Pollution Reduction Act (OPRA) of 1994 allo�ved the Cit�• of San Diego to apply for modified I�TPDES permits allo�ving PLVdTP to continue operatine at an Ad��anced Priman� Treatment Le��el while meeting or exceeding all general and specifically neeotiated regulator}� obligations including ocean protection requirements; and ��'HEREAS. the Cih of San Dieeo has ZO vears of ocean monitorins data demonstratina that the Ad��anced Priman• PL«%TP consistentl}� protects the ocean en�ironment; and N�HEREAS. the Cit�� of San Dieeo has determined that instead of com�ertine the Point Loma Waste���ater Treatment Plant to a secondarv treatment plant, equi��alent results can be achieved b�� offloadine ���aste«�ater flo�e from the Plant to other e�istina and ne��� facilities (secondan� equi��alencv) for potable ���ater reuse; and WHEREAS_ the Metro Commission sees the Pure �'�%ater Program, the City of San Diego's 20-year program to produce purified �vater to supplement San Diego's drinking «�ater suppl��; as a first step to�vard realizine the possibilit}� of full�� utilizine �i�aste���ater supplies to ma�imize development of local �aater supply �+�hile acl;noN�ledging that future espansion and ability to minimize flo�vs to ���aste���ater treatment plants ��°ill depend on technological and leeislative advances. cost benefit anal}�sis, and actual flo�vs compazed to projections; and �'��HEREAS. the stratee� of achievino secondar�� equivalenc�� at the Point Loma V�'asteaater Treatment Plant through potable reuse of ���aste�vater is included ���ithin the Pure A'ater San Diego proaram; and Resolution �'o. 2014-18] Pase No. 2 VdHEREAS, the Cin of San Dieeo. the member a�encies of Metro �i'asteH�ater JPA. members of the Metro Commission. and stakeholders from the environmental communitv have a�,reed upon a definition for secondar�� equivalency and will use their best efforts to have federal legislation passed in accordance with the pmposal called the Ocean Pollution Reduction Act lI (OPRA II). Generall}�; OPRA II will alloN� the Cit��`s NPDES permit to be based on secondary equivalency that includes a commitment to implement potable reuse of wastewater and allows the PLWTP to remain operating at the Ad��anced Primary Treatment Level; and VIHEREAS, the current modified permit for the PLWTP expires on July 31; 2015, and Cit}� of San Diego staff need to submit an application to renew the NPDES permit by January 30, Z01�. NOW, THEREFORE; BE IT RESOLVED by the City Council of the City of Chula Vista as follows: Section I: That the Metro �'astewater JPA and Metro Commission support the Point Loma �l'asteN�ater Treatment Plant to remain operating at an Advanced Primary Treatment Le��el. Section 2: That Metro Vlaste���ater JPA and Metro Commission support the concept of secondar�� equivalencv for the Point Loma Wastewater Treatment Plant and support proposine the passage of federal leQislation in accordance ��ith the proposal titled the "Ocean Pollution Reduction Act lI (OPRA II)." attached hereto as Eshibit "A" and incorporated herein. OPRA II will allow the Citys I�rPDES permit to be based on secondary equivalency that includes a commitment to implement potable reuse of �vastewater and allo��s the PLWTP to remain operating at the Advanced Priman� Treatment Level. Section 3: That Metro �Vaste��-ater .IPA and Metro Commission support the City of San Diego's NPDES Modified Permit application for the Point Loma Wastewater Treatment Plant as further described in the Basis of Point Loma Permit Application, attached hereto as Exhibit "B" and incorporated herein.
