State of California: and � R'HEREAS, cenain �+�ater conveyance facilities o��med b}� San Diego aze located H�ithin Chula \'ista and on occasion, de��elopment within Chula ��ista may be in conflict �ti�ith San Diego s «�ater transportation facilities; and WHEREAS; Otav Land, LLC (Ota}� Land), a de��eloper of a certain real propem� �+�ithin Chula Vista_ commonl�� l:no�+�n as Otav Ranch Villase 8 West ���ishes to amend the Villaee 8 W development plans; and � � W7IEREAS; the Plan Amendmen[ is in conflict «�ith certain �vater transportation facilities o«�ned and operated bv San Diego (`Ota}� Pipeline"); and WHEREAS, as a condition of the approval of Otav Land's Plan Amendment and a tentati��e map, Otay Land shall be required to relbcate Otay Pipeline into an azea described in Eshibit "A" and sho«�n on E�hibit "B" attached hereto, ti�hich eshibits are incorporated herein b�� this reference. The areas described on E�hibit "A" and shown on Exhibit "B" are hereinafrer referred to as "Joint Use Area": and �\'HEREAS.
