DATED: City Clerk + s RULES OF INTERPRETATION AND PROCEDURE FOR ADMINISTRATION OF REQUESTS FOR VARIANCE FROM SEWER SERVICE CHARGE!: I. For the purpose of administering Section 26.82 (a) of the Code of the City of Chula Vista, hereinafter: referred to as "Ths Code", the term "average sewage" shall be used as a basis in deter- mining grounds for granting variances as well as a basis upon which to establish rates to be paid by users under variance. Normal anticipated volume of flow indicated by the t rm .•'average flow" shall include flows within the range from 53 gallons to 85 gallons of sewage for each 100 gallons of water consumed. No variance shall be granted or imposed upon any user whose flow is within said range ex- cept as specified under Item No. 2 below. Rates for users- whose flows are not within said range shall be deter~ mined on the following basis: Vim§ ai_to a S ti Od oa u 30% 70 gallons per 100 gallons water usage The resultant variance rate is a percentage which., when multiplied by by the subject water bill, is equal to the sewer service charg- for the subject billing period, No variance shall be granted or imposed upon single family dwelling units based solely upon the volume or type of flow from said units„ 2. Commercial or industrial sewage which continuously or peri- odically exceeds the amounts specified under "type" for "average sew- age" in Section 26.82 (a) of the Code, may be subject to upward ad- justment of sewer service charges by the Chief Administrative Officer. Discharges shall be of the quality and quantity permitted under any pertinent Chula Vista regulations governing industrial wastes, which are currently in force, Discharge requirements may change subject to enactment of new regulations. 3. A fire service connection (Section 26.82 8-3 of the Code), is defined as a connection feeding a system designed as prescribed by the Board of Fire Service Underwriters, and used exclusively to com- bat incendiary emergencies. No sewer service charge shall be assessed for such connection.. 4. Nerp.sewerable premises, (Section 26.82 a-4 of the Code) ineluding residential, commercial, industrial and public classifica- tions, shall be exempt from the sewer service charge so long as no connection is made to public sewer, and: a. If no public sewer line is adjacent to the property, or b. The grade of the public sewer is such as not to allow gravity flow from the property, or 4o (Continued) c. The connection to a temporary meter where all water usage from the service is used during the construction of subdivision improvements, public improvements and commercial, industrial and public buildings. b. Upon initial installation of a new meter to premises to be used for single family residential purposes;: sewer service. charges shall be imposed as of the date of said meter installation. 6. Procedure in making application: . a. Application for sewer service charge variance shall be made to the Chief Administrative Officer on the form entitled "Application for Sewer Service Charms Rate. Review" • a2. . 70 (Continued) b. The application shall be reviewed by the Chief Administrative Officer. Where the basis for a variance is clearly defined in Section 26.82 of the Codes it may be recommended for approval by the Chief Administrative Officer. Where basis for variance is not clearly defined in the Codas the application shall be referred to a Board com shall servegas chairman;ithe C tive Engis i r; and the Finance Officer. One alternate member from each of the appropriate departments (Finance-a- - Administration and Engineering) shall #. appointed by the Chief Administrative Officer. The Board may invite consumers to appear to support their retests. The Board shall determine the jus- tification of the request and shall establish the nature of the variances if any0 to be granted. co The Board shall have the authority to~acquire sub. mission of technical data by competent authority to the xtent necessary to make a determination. The Board will make recommendation on the approval or disapproval of the variance, based upon the data available. . d. Recommendation shall be forwarded to the City Council. Council actions in such cases© shall be in the. fora of a resolution and shall be final. . 8. Review and Termination of Variances: a. Variances are allowed to cover a given set of condi,: tons at one location. When any of the conditions are ebanged:9 the variance is subject to alteration. b. All variances shall be subject to annual ravioli by the Chief Administrative Officers to determine if the variance should be continued. co Any vrance receded for alteration by the Ad- . ministrative Officer will be forwarded to the City Council for action.
