HomeMy WebLinkAboutReso 1962-2924 R �t RESOLUTION No. 2924 A RESOLUTION AUTHORIZING FILING OF SUIT AND EMPLOYMENT OF SPECIAL ATTORNEYS IN CONNECTION WITH UNIFIED PORT DISTRICT WHEREAS, the Board of Supervisors of the County of San Diego has authorized the calling of an election in the cities of San Diego, Coronado, Imperial Beach, Chula Vista and National City, on November 6, 1962, for the establishment of a special district to be known as the San Diego Unified Harbor District, and WHEREAS, the cities of Coronado, Imperial Beach and Chula Vista, acting by and through the City Councils of said cities, have repeatedly objected to the establishment of said District, and WHEREAS, it is the opinion of the City Council of the City of Chula Vista that the establishment of the San Diego Unified Port District is not in the best interests of the citizens of said City; that if formed it will take property of said city, it will force said City and the voters thereof to resort to a vote of other cities on the question of whether property rights owned in fee and in trust by the City of Chula Vista will be trans- _ ferred to the Unified Port District; that such an election would be unfair, illegal, inequitable and unjust, and WHEREAS, it is also the opinion of the City Council of the City of Chula Vista that if formed said District will have the power to tax the private property in said City without granting the right of equal representa- tion, and WHEREAS, the City Council has been informed and therefore believes that the establishment of the San Diego Unified Port District based upon the provisions of Chapter 67 of the Statutes of 1962, First Extraordinary Session, will be illegal and any District so established will be founded upon an unconstitutional statute, and WHEREAS, the cities of Coronado, Imperial Beach and Chula Vista and the electors, voters and citizens thereof are all affected .by any proposition which will establish a Unified District as proposed and said cities have a common interest in protecting themselves against a common danger and should join together for this purpose. WHEREAS, the services of special counsel is necessary and required to provide legal services for said City of Chula Vista in the protection of property rights of said City and the law firm of HELLER, EHRMAN, WHITE & McAULIFFE of the City and County of San Francisco is composed of persons qualified to render said sew 1 . -1- i 4 • j n :w ti NOW THEREFORE BE IT RESOLVED BY THE CITY OF CHULA VISTA as follows: 1. That is is in the best interests of the people of the City of Chula Vista to join with the cities of Imperial Beach and Coronado in a joint effort of the three cities to defeat any establishment of a Unified Port District as provided for in Chapter 67, Statutes of 1962, First Extraordinary Session. 2. That the City Attorney be and he is hereby authorized to commence an action in the Courts of the State of California to contest the establishment of the San Diego Unified Port District by an election to be held in said City on November 6, 1962. 3. That the firm of HELLER, EHRMAN, WHITE & McAULIFFE of the City of San Francisco be and it is hereby employed as special counsel to represent the City in the litigation herein referred to; that the terms and provisions of said employment are more particularly set out in a memorandum thereof contained in a letter now on file in the office of the City Clerk. 4. That this Resolution shall become effective only upon notification by the cities of Coronado and Imperial Beach to the effect that they have passed similar resolutions. 5.
