HomeMy WebLinkAboutReso 1962-2850 • RESOLUTION No. 2850 Y !~ RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ORDERING THE VACATION OF A PORTION OF 7HE STREET RIGHT-OF-WAY LOCATED AT THE NORTHgEST CORNER OFTRY C B DR VEt ND FIRST AVENUE WHEREAS, the City Council of the City of Chula Vista df,_d on the 22nd day of May 19 62 , adopt Resolution of Intention N p 2833 , whereby said City Council did declare its intention to order the 'vacation and closing to public use of that certain street within said City of Chula Vista known • as a portion of the northwest corner of Country Club Drive and .First Avenue. which is more particularly described as follows : That portion of Lot, 2, Quarter Section 121, according to Map No. 505, filed in the office of the County Recorder, County of San Diego, State of California, more particularly described as follows: Commencing at the northeasterly corner of said Lot 2; thence south 18 degrees 22'00" East, along the Easterly line of Lot 2, a distance of 31.56 feet to the TRUE POINT OF BEGINNING; thence continuing South 18 degrees 22'00" East, along said Easterly line a distance of 51.09 feet to a tangent curve to the right; thence along the arc of said curve having a radius of fifteen (15) feet and a central angle of 127 degrees 50'40", a distance of 33.47 feet; thence North 70 degrees 31'20" West, tangent to said curve a distance of 51.09 feet to a point; thence Easterly along the arc of a curve concave North- westerly, with a forth (40) foot radius and a central angle of 127 degrees 50'40", whose center bears North 19 degrees 28'40" East, from last mentioned point, a distance of 89.25 feet to the TRUE POINT OF BEGINNING. y ✓b. • . \ ♦ . WHEREAS, there was posted a notice of the passage of said Resolution by the person, within the time and in the manner and form, all as required by law, and said Resolution was , in the manner required by law, published in the Chula Vista Star News , a newspaper of general circulation, printed and published weekly in said City; and WHEREAS, affidavits of the said Street Superintendent and the publisher of said newspaper showing the posting of said notices and publication of said Resolution in the manner and form required by law, have been filed with the City Clerk of the City of Chula Vista; and WHEREAS.. the said City Council did by said Resolution set the 12th day of June , 1962_, at 7:00 o'clock P.M. in the City Council Chambers at the City Hall, Chula Vista, California, as the time and place for hearing all persons interested in and objecting to the proposed vacation of said described street; and -WHEREAS, the City Council did hear the evidence offered by all persons interested; and WHEREAS, the City Council finds from the evidence Submitted that said street as described in the Resolution of Intention is unnecessary for present or prospective public street purposes ; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF `CHt LA VISTA AS FOLLOWS: That the City Council of the City of Chula Vista hereby finds that the street more particularly described hereinabove is unnecessary for present or prospective street purposes ; and That it is hereby ordered that said street as specifically described in said Resolution of Intention and as hereinabove specifically described in this Resolution is hereby ordered vacated and closed to public use, subject to the reservations and exceptions contained in the above description. • ADOPTED AND APPROVED by the Cit!
