V�'"I-IEREAS, in November of 2008, the residents of the City of Chula \jista approved
Proposition Q, �;�hich amended Sections �00 and �03 of the Chula Vista Cit�- Charter to mal:e the
office of Cit�� Attomev an elected office of the Cirv: and
WHEREAS. Proposition Q amended Section �03(c) of the Cit�� Charter to establish a
minimum compensation for the Cit�� .Attornev based upon a formula that considered the
compensation of the cit� attome}�'s in similazl�� situated cities; and
R'HEREAS. on December 8, 2009. the Cit}� Council approved the addition of Chapter
2.11 to the Chula Vista Municipal Code to implement the requirements of Section �03 of the
Charter. includine the formula for the minimum compensation of the Cit�� Attomev; and
�Y7-IEREAS, this formula requires that the Cin� Council shall. as of Februar}� of each
veaz. use the most current annual population estimates published b}� the Califomia Department of
Finance to determine the six California cities ���hose populations are closest to the Cit}� as
specified by the measure; and
\�'HEREAS, the Human Resources Department has eathered the information and in
accordance ���ith the Cin� of Chula Vista Municipal Code Section 2.11.0.030, the Cih� Attome��
minimum salan� is set at �214.244 for Fiscal Year 2014/201�: and
V�'HEREAS, staff requested clarification from outside legal counsel on the manner in
which the minimum compensation of the Cin� Attome�� required b}� Section �03(c) of the Cit��
Charter must be implemented; and
�1'HEREAS. a memorandum dated October �. 2011 from outside leeal counsel is
contained in Attachment 2 of the report that accompanies this resolution states that the salan�
�iill be effective from June 27. 2014 to December l. 201�: and
WHEREAS, in June 2012. voters approved an amendment to the Cit�� Charter that set the
annual salary of the elected Cit}� Attomev to be equi��alent to the salary of a Judge of the
Superior Court of the State of California: and
WHEREAS.this salarv chanee �vill be effecti��e upon the start of the ne« term of the Citv
Attornev. which is scheduled to beein December 2. 2014.

\'ista. that it set the annual salan� for the elected Cit�- Attornev effective on June 27. 2014 at
�214?44 and effective December 2. 2014 at $184.610.
