RECOMMENDED ACTION
Council adopt the resolution.
SUMMARY
OnMay21,2014,theDirectorofPublicWorksreceivedtwo(2)sealedbidsforthe“PhaseI-Willow
StreetBridgeReplacement(WaterLineRelocation)\[CIPNo.STL-384,FederalProjectNo.BHLS-
5203(016)\]”project.TheprojectisincludedintheCapitalImprovementProgramforFiscalYear
2013/2014.Theproposedresolution,ifapproved,wouldrejectthebidproposalsreceivedforthe
project due to various factors and direct the Director of Public Works to re-advertise the project.

DISCUSSION
Project Background
Thisprojectisthefirstphaseofatwophaseprojectthatwillultimatelyreplacetheexisting2-lane
WillowStreetBridgewithanew4-lanebridge;theexistingbridgewasconstructedin1940and
crossestheSweetwaterRiver.Theoverallproject(PhaseIandII)willbeadvertisedandawardedas
two(2)separatecontracts.PhaseIoftheprojectisprimarilyautilityrelocationprojectandPhaseII
is the actual bridge replacement work.
TheimprovementsaccomplishedwithPhaseIoftheprojectincluderelocatinganexisting32-inch
watertransmissionline(Owner-SweetwaterAuthority)andanexisting36-inchwatertransmission
line(Owner-CityofSanDiego)outsideoftheproposedbridgeenvelope.Theexistingtransmission
linesrunalongthewesterlysideoftheexistingWillowStreetBridgeandtraversethenortherlyendof
thebridge;thetwolinesrunparalleltoeachotheranddivergetowardsthenorthendoftheexisting
bridge.Relocationofthetwolinesisneededduetoconflictswiththeproposednortherlybridge
abutmentandtomitigateforthepotentialscourcausedbytheSweetwaterRiver.Theprojectalso
includesclearingandgrubbingoftheoverallprojectsite,dewatering,environmentalfencing,traffic
control, and other associated miscellaneous work items.
ThePhaseIimprovementswillbeconstructedwithinCityofChulaVista(City)andCountyofSan

Diego(County)right-of-way.Inter-agencycoordinationbetweentheCityandtheCountywas
requiredaswellascoordinationwiththeCaliforniaDepartmentofTransportation(Caltrans)dueto
their Federal oversight role for the project.
Bidding Process
CitystaffbegantheadvertisementoftheprojectonApril25,2014andheldanon-mandatoryPre-Bid
MeetingonMay9,2014,whichwasattendedbyfour(4)contractors,toreviewtheproject
requirementsandreceivequestionsregardingthebiddocuments.TheDirectorofPublicWorks
receivedandopenedtwo(2)bidsfortheprojectonMay21,2014asfollows(listedinnumericalorder
of base bid amount):

(approximately100.7%),respectively.TheEngineer’sEstimateincludedcivilworkandwater
transmissionlineitemsthatwerecompiledbyCitystaffandthedesignconsultant(Kimley-Horn),
respectively (See Attachment “1” - Bid Summary).
Analysis of Bid Proposals
Citystaffreviewedthetwo(2)bidproposalsreceivedanddeterminedtherecommendationfor
rejection based upon the following factors:
JUST Construction, Inc.
Failure to submit all of the required bid documents (did not submit Addendum #1); and
Mathematical discrepancy (A discrepancy between words and figures in bid proposal).
TC Construction, Inc.
Mathematicallyunbalancedbid(biddoesnotreflectreasonableprofit/overhead/indirectcosts);
and
Materiallyunbalancedbid(thecontractor’sbidissignificantlyhigherthantheEngineer’s
Estimate).
Additionally,staffbelievesthatbymakingcertainadjustmentstotheproject,suchaschangingthe
constructionschedule,facilitatingthesolicitationofsub-consultantquotesandincreasingallowable
shutdowndaysforutilities,theCitycouldobtainbidsclosertoEngineer’sEstimate.Itisanticipated
thattherevisedspecificationswillincludethefollowingchanges(subjecttotheapprovaloftheutility
owners - City of San Diego and Sweetwater Authority) prior to re-advertisement:
1.Increase allowable shutdown period for both water transmission lines;
2.Increase construction days to the overall project;

3.Reduce the amount of liquidated damages;
4.Provide a material supplier list for steel water pipe; and
5.Include the list of City approved environmental mitigation consultants.
Theserevisionstotheprojectspecificationsshouldresultinbidproposalsthatwillbeclosertothe
Engineer’sEstimateaswellasattractingadditionalbidders.Citystaff’sbidanalysisrevealedthatan
additionalnine(9)primecontractorsshowedinterestintheproject,butdecidednottosubmitabid
proposal.Subsequently,Citystaffcontactedseveraloftheprospectivecontractorstocollect
informationregardingdeficienciesand/orclarificationsneededintheprojectplansandspecifications.
Thisinformationwasthefocusoftheproposedmodificationstothespecificationsandshouldcreate
improved understanding and interest in the project.
DECISION-MAKER CONFLICT
StaffhasreviewedthepropertyholdingsoftheCityCouncilandhasfoundnopropertyholdings
within500feetoftheboundariesofthepropertywhichisthesubjectofthisaction.Staffisnot
independentlyaware,andhasnotbeeninformedbyanyCityCouncilmember,ofanyotherfactthat
may constitute a basis for a decision maker conflict of interest in this matter.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA REJECTING BIDS FOR THE “PHASE I –
WILLOW STREET BRIDGE REPLACEMENT (WATER LINE
RELOCATION),IN THE CITY OF CHULA VISTA, CALIFORNIA
\[CIP No. STL-384),FEDERAL PROJECT NO. BHLS-
5203(016)\]” PROJECT.
WHEREAS,onMay 21, 2014, the Director of Public Works received two (2)sealed bids
for the “Phase I –Willow Street Bridge Replacement (Water Line Relocation),in the City of
Chula Vista California\[CIP No. STL-384, Federal Project No. BHLS-5203(016)\]”project; and
WHEREAS, the sealed bids received are as follows:

WHEREAS, the bid proposals submitted by JUST Construction, Inc. and TC
Construction, Inc. are above the Engineer’s Estimate of $1,910,000 by $487,235 (approximately
25.5%) and $1,924,285 (approximately 100.7%), respectively;and
WHEREAS,City staff reviewed the two (2) bid proposals received and,based on the
significant deviation from the Engineer’s Estimate and the following factors, recommends
rejecting the bids:
JUST Construction, Inc.
Failure to submit all of the required bid documents (did not submit Addendum #1);
and
Mathematical discrepancy (Adiscrepancy between words and figures in bid
proposal).
TC Construction, Inc.
Mathematically unbalanced bid (bid does not reflect reasonable
profit/overhead/indirect costs); and
Materially unbalanced bid (the contractor’s bid is significantly higher thanthe
Engineer’s Estimate); and
WHEREAS,staff believes that by making certain adjustments to the project, such as
changing the construction schedule, facilitating the solicitation of sub-consultant quotes and

increasingallowableshutdown daysfor utilities, the City could obtain bids closer toEngineer’s
Estimate.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula
Vista does hereby rejectthe bid proposals received for the “Phase I –Willow Street Bridge
Replacement (Water Line Relocation), in the City of Chula Vista California \[CIP No. STL-384,
Federal Project No. BHLS-5203(016)\]” project due to various factors and directsthe Director of
Public Works to re-advertise theproject.
