HomeMy WebLinkAboutReso 1994-17375 NOT APPROVED RESOLUTION NO. 17375 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ADOPTING THE CITY OF CHULA VISTA AMERICANS WITH DISABILITIES ACT (ADA) COMPLIANCE PROGRAM WHEREAS, as mandated by the Americans with Disabilities Act, municipalities required to undertake structural modifications to existing facilities to achieve program accessibility must hold a public information meeting to discuss its proposed Transition Plan with individuals with disabilities and those representing their interests; and, WHEREAS, the City Council at its workshop meeting of January 28, 1994, provided an opportunity to interested persons to participate in the development of the Transition Plan by submitting comments; and, WHEREAS, no objections have been received regarding the adoption of the proposed Transition Plan by submitting comments; and, WHEREAS, the Human Resources Commission at its February 10, 1993 meeting - unanimously endorsed staff's proposed on-site and street related ADA compliance program. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby adopt the "Transition Plan" for on-site and street related City facilities and establishes a finding of "Undue Burden" for purposes of extending the time period for making required street related modifications (curb ramps to existing City streets). BE IT FURTHER RESOLVED that the City Council does hereby a policy for providing alternative methods of service delivery to disabled individuals, specifically at those city public counters and multi-floor buildings which do no comply with the ADA's specifications. BE IT FURTHER RESOLVED that the City Council does hereby adopt a policy establishing ADA compliant parks in major areas of the city and a compliant recreation center, allowing disabled residents from all parts of the city to use accessible facilities and recreation programs. BE IT FURTHER RESOLVED that the City Council does hereby approve in concept, funding of implementation of Americans with Disabilities Act program and directs staff to submit as Capital Improvement Project for FY 1994-95.
