RECOMMENDED ACTION
Council adopt the resolutions.
SUMMARY
AContinuousImprovementteamcomposedofrepresentativesfromtheOfficeofCommunications,
PublicWorks,Recreation,Police,Fire,andFinanceheldathree-dayprocessimprovementevent
focusedonspecialeventsheldonpropertyowned,controlled,ormaintainedbytheCity.Thisevent
builtupontheworkofapreviousContinuousImprovementeventheldin2011.Recommendations
fromthe2014eventincludeupdatingtheCityCouncilPolicyregardingSpecialEvents(Policy
Number102-06),amendingtheSpecialEventssectionoftheCity’sMasterFeeScheduletoreflect
theproposedchangestoCouncilPolicy102-06,andrepealinganoutdatedCityCouncilPolicy
regarding Special Officer staffing at special events (Policy Number 762-02).
ENVIRONMENTAL REVIEW
TheEnvironmentalReviewCoordinatorhasreviewedtheproposedactivityforcompliancewiththe
CaliforniaEnvironmentalQualityAct(CEQA)andhasdeterminedthattheactivityisnota“Project”as
definedunderSection15378(b)(2)oftheStateCEQAGuidelinesbecauseitinvolvesonlyadoptionof
apolicythatgovernshowSpecialEventandBlockpartypermitsareissuedandthereforeisan
organizationaloradministrativeactivityofgovernmentthatwillnotresultinadirectorindirect
physicalchangeintheenvironmental;therefore,pursuanttoSection15060(c)(3)oftheStateCEQA
GuidelinestheactivityisnotsubjecttoCEQA.Thus,noenvironmentalreviewisnecessary.

Althoughenvironmentalreviewisnotnecessaryatthistime,futurespecialeventpermitswillhave
environmentalreviewatwhichtimeaCEQAdeterminationwillbecompletedpriortocommencing
with the activities associated with the permit.

Not applicable.
DISCUSSION
TheOfficeofCommunicationsintheCityManager’sOfficeisresponsibleforpermittingspecial
eventsandblockparties.OnApril1,2008,theCityCounciladoptedCouncilPolicyNumber102-06
(SpecialEventsandBlockParties)definingspecialeventsandblockpartiesandestablishinga
permitissuanceprocess,includingpreconditionsforpermitapproval.InadoptingPolicy102-06,the
CityCouncildelegatedauthoritytotheCityManagertograntSpecialEventPermitsorBlockParty
Permitstoanyapplicantwhohasdemonstratedthattheymeetthepreconditioncriteriaestablishedin
thepolicy.Policy102-06furtherestablishedthecollectionofadministrativefeesforSpecialEvent
andBlockPartypermits,includingcostrecoveryforvariousCitydepartmentsrequiredtoprovide
services to the event (e.g., street closures, street sweeping, crowd control, etc.).
Atthetimeofitsadoptionin2008,CouncilPolicy102-06wastheCity’sfirstformaldefinitionof
eventsrequiringaSpecialEventPermit.IncraftingtheproposedPolicy,OfficeofCommunications
staffconsidereddefinitionsinneighboringjurisdictionsandinputfromimpactedCitydepartments.
Sinceadoptionofthepolicy,CommunicationsOfficestaffhasreceivedfeedbackthattheapproval
processistooonerous,tooexpensive,andinconsistentlyapplied.Thecomplexityandcostof
SpecialEventPermitshaveresultedinahighnumberoffeewaiverrequestssubmittedtotheCity
Manager’soffice,aswellaspotentialandreturningeventsoptingtostagetheireventselsewhere.
Lackofconsistencyandclarityintheapplicationsubmittalprocesshasledtoconfusionand
frustrationforbothcustomersandCitystaff.AContinuousImprovementeventwasconvenedto
focus on this customer feedback, with a secondary goal of improving internal processing efficiency.
AContinuousImprovementteammetforapproximately20hoursduringthefirstweekofJune2014.
TheteamincludedrepresentativesfromtheAdministration(CityManager’sOfficeandOfficeof
Communications),Recreation,PublicWorks,Police,FireandFinanceDepartments.Theeventwas
facilitatedbyEdChewandAmandaMills,membersoftheCity’sContinuousImprovementteam.
Project goals, discussed in detail below, included the following:
1.Memorializing what constitutes a Special Event (what requires a Special Event Permit); and
2.Gain consensus on what fees are necessary and appropriate; and
3.Develop a centralized process for communication and fee collection.
Special Event Redefined
TheContinuousImprovementteamrecommendsredefiningtheactivitiesrequiringaSpecialEvent
Permit.ThepurposeofacentralizedSpecialEventPermitistocoordinatethepermittingprocessfor
organizedactivitiesonpublicpropertywhichrequiremultipledepartmentalapprovalsorservices.

Theteamreviewedtheexistingdefinitionandisrecommendingchangestobetteralignthedefinition
with the original intent of the Special Event Permit.
ThecurrentpolicyrequiresaSpecialEventPermitforanyeventthatmeetsoneoffourcriteria.The
firstcriteriaisaneventwithmorethanonehundred(100)participantsinvolvingtheuseof,orhaving
impactupon,City-owned,controlled,ormaintainedproperty.Theteamdeterminedthatthenumber
ofparticipantsalonedoesnotsufficientlycorrelatetotheneedformultipledepartmentalreviewor
services.Theteamthereforerecommendsremovingtheonehundred(100)participantcriteria.
Additionalrevisionstotheremainingthreecriteriatoimprovealignmentwiththemulti-departmental
impactframeworkarealsoproposed.ThefinalSpecialEventPermitdefinitionproposedbytheteam
is as follows:
ASpecialEventPermitisrequiredforanyorganizedactivityonpublicpropertytowhichthe
general public is invited, which results in, or requires:
1.Anymodificationtotrafficflowpatterns(e.g.,streetclosures,laneclosures,traffic
stops, etc.) or parking regulations; and/or
2.Providing or selling alcohol to the public; and/or
3.Any combination of two or more of the following:
a.Sales or distribution of merchandise/food; and/or
b.Use of City utilities; and/or
c.Single tent or connected tents greater than 700 square feet; and/or
d.Modification of facility/park hours of operation; and/or
e.PermitfromDevelopmentServicesDepartmentforgenerator(s)(greaterthan
10kw), staging, or other temporary structure(s).
Activities exempted from the Special Event Permit process include:
1.EventsthatincludeaGazebo/PicnicShelter/ArearentalorareataCityfacilitysecured
with a Facility Use Permit.
2.Funeral processions by a licensed mortuary.
3.Activities conducted by a governmental agency, acting within the scope of its authority.
4.Lawfulpicketingandfreespeechactivitiesthatdonotinvolvetheuseofvehicles,
animals, fireworks, pyrotechnics or equipment (other than sound equipment).
5.Eventsconductedbylocalelementaryschools,middleschools,highschoolsor
collegesthatareconductedontheirowngroundsandproperty,andwillnotsignificantly
impact traffic flow on surrounding public streets or pose a risk to public safety.
6.Anyreligiousactivitiestakingplaceonpremisesapprovedand/orregularlyusedfor
religious purposes.
7.Block parties, for which a block party permit has been issued.
8.Standardsportingleagues/tournamentsheldwithinaCityparkorrecreationfield,and
whereallnecessaryfacilityusepermitsandapprovalshavebeenrequestedand
granted by the Department of Recreation, Public Works, and/or Police.

9.Weddings,parties,orothercelebrationsoreventswhereallnecessaryfacilitiesuse
permitsandapprovalshavebeenrequestedandgrantedbytheDepartmentof
Recreation, Public Works, and/or Police.
10.Establishedassembly/entertainmentfacilitieswithlong-termcontractswiththeCitythat
define the conditions and requirements for conducting ongoing public events.
StaffrecommendsupdatingexistingCityCouncilPolicy102-06(SpecialEventsandBlockParties)
andChapter2oftheMasterFeeScheduletoreflectthenewSpecialEventPermitdefinition(see
Attachments 1 and 2).
Special Event Permit Fees
InlightoffeedbackfromspecialeventapplicantsandtheCity’sstrategicplangoals,theContinuous
ImprovementteamdiscussedopportunitiestoreducethefeesassociatedwithSpecialEventPermits.
Inparticular,theteamfocusedonfullcostrecoveryhourlybillingforservicesprovideddirectlytothe
event.Theteamidentifiedtwomeansofreducingthesefees:(1)reducingtheactualcostsincurred
by the City; and (2) reducing the level of cost recovery pursued.
OpportunitiestoreducecostsincurredbytheCityincludeallowingspecialeventstohireprivate
securityandprivatetrafficcontrol,ortobringinportablerestrooms.Additionaloptionsdiscussed
includeassigninghourlystaffandconsolidatingCitystaffinspections.TheContinuousImprovement
teamwillcontinuetomeetanddiscussopportunitiestoreducethecostofprovidingSpecialEvent
Permit services. This improvement can be implemented administratively.
InadditiontoreducingthecostsincurredbytheCity,theteamalsodiscussedthepossibilityof
settingacostrecoverylevelforSpecialEventPermitstaffingthatislessthanfullcostrecovery.The
CitywideCostRecoveryPolicy(seeAttachment3)setsatargetcostrecoveryrangeof30%-70%
fortheSpecialEvents,BlockParties,andFilmingPermitsprograms.Staffrecommendsamending
theMasterFeeScheduletoallowforcostrecoveryconsistentwiththeCostRecoveryPolicyrangeof
30% - 70%.
AdditionalanalysiswillbeconductedinconjunctionwiththeRecreationDepartment’spending Cost
Recovery,ResourceAllocationandRevenueEnhancementStudy,includingupdatestotheCitywide
Cost Recovery Policy.
StaffrecommendsupdatingChapter2oftheMasterFeeScheduletoreflectcostrecoveryforCity
staff services provided to Special Event Permits consistent with the Citywide Cost Recovery Policy.
InadditiontoamendingtheMasterFeeSchedule,staffrecommendsrepealingCityCouncilPolicy
762-02(seeAttachment4),relatingtotheuseofSpecialOfficersforpolicingspecialevents.This
policyreferstotheuseofSpecialandReservepoliceOfficers.TheSpecialOfficerclassificationno
longerexistsandrepealofthepolicyisrecommended.Repealwillhavenoimpactonfuturespecial
eventstaffing;thisisanadministrativecleanuptaskidentifiedinacomprehensivereviewofallCity
Councilpoliciesaddressingspecialevents.Additionalpolicyupdatesareanticipatedtobebrought
forwardtotheCityCouncilinconjunctionwiththeRecreationDepartment’spending CostRecovery,
Resource Allocation and Revenue Enhancement Study.

TheContinuousImprovementteamdiscussedanumberofopportunitiestoimprovethecustomer’s
experience.Countermeasuresidentifiedincludedevelopingacentralwebsitethatwillserveasa
“one-stop-shop”forallspecialeventsintheCity.Fromthiscentralizedpoint,theapplicantwillhave
accesstoallnecessaryinformationandforms,withouthavingtounderstandtheorganizational
structureoftheCity.Thiscountermeasurewillbeimplementedwiththependingredesignofthe
City’s website.
Inadditiontoconsolidatinginformationatthebeginningofthespecialeventprocess,theteamalso
identifiedtheneedtoconsolidatetheeventclose-outprocess.Effectiveimmediately,theFinance
DepartmentwillworkwiththeOfficeofCommunicationstoconsolidateallbillingsassociatedwith
eachevent,ensuringthateacheventreceivesasinglepost-eventinvoicereflectingalloutstanding
charges and fees.
DECISION-MAKER CONFLICT
Staffhasdeterminedthattheactioncontemplatedbythisitemisministerial,secretarial,manual,or
clericalinnatureand,assuch,doesnotrequiretheCityCouncilmemberstomakeorparticipatein
makingagovernmentaldecision,pursuanttoCaliforniaCodeofRegulationsTitle2,section18702.4
(a).Consequently,thisitemdoesnotpresentaconflictunderthePoliticalReformAct(Cal.Gov't
Code87100,etseq.).Staffisnotindependentlyaware,andhasnotbeeninformedbyanyCity
Councilmember,ofanyotherfactthatmayconstituteabasisforadecisionmakerconflictofinterest
in this matter.

CURRENT YEAR FISCAL IMPACT
ReducingtheadministrativeeffortassociatedwithissuingSpecialEventPermitswillfreeupexisting
staffresourcestofocusonotherCitypriorities.StreamliningtheSpecialEventpermittingprocess
andreducingtheassociatedfeesisprojectedtoincreasethevolumeandqualityofspecialevents
heldintheCity.Actualfiscalimpacts,includingdirectGeneralFundimpactsandindirecteconomic
impacts,willvarybaseduponfuturespecialeventactivity.Noadjustmenttothefiscalyear2014-15
operating budget is recommended.

BACKGROUND:
Numerous public events are held in the City of Chula Vista each year including bicycle and running
races, community festivals, recycling events, block parties and more. The Office of Communications
coordinates with event planners to ensure a well-planned and organized event.
PURPOSE:
The City of Chula Vista invites the use of City facilities for public events. This policy outlines the
types of events, requirements, and process for securing a Special Event or Block Party Permit.
POLICY:
SPECIAL EVENTS
general
A Special Event Permit is required for any organized activity on public property to which the
public
is invited, which results in, or requires:
1.Any modification to traffic flow patterns (street closures, lane closures, traffic stops) or
parking regulations; and/or,
2.Providing/selling alcohol to the public; and/or,
3.Any combination of two or more of the following:
a.Sales or distribution of merchandise or food; and/or,
b.Use of City utilities; and/or,
c.Single tent, or connected tents, greater than700 square feet; and/or,
d.Modification of facility/park hours of operations; and/or,
e.Permit from the Development Services Department for generator(s) greater than 10kw,
staging, or other temporary structure(s).

6.Filmmaking activities,for which a filming permit has been requested and granted.
7.Block parties, for which a block party permit has been requested and granted.
8.Standard sporting leagues/tournaments held within a City park or recreation field and where
all necessary Facility/ParkUsePermits and approvals had been requested and granted by the
Department of Recreation, Public Works, and/or Police.
9.Weddings, parties, or other celebrations or events where all necessary Facility/ParkUse
Permits and approvals have been requested and granted by the Department of Recreation,
Public Works, and/or Police.
10.Established entertainment facilities that have long-term contracts with the Citythat define the
conditions and requirements for conducting ongoing public events.

Permits for special events on City owned, controlled, or maintained property shall be issued upon
proof the established special Special event Event criteria and certain preconditions have been met and
subject to certain preconditions being met as follows:
1.A Special Event Permit must be completed and submitted to the Office of Communications at
least 45 days before the start date of the event in question.
2.A nonrefundable administrative fee must be submitted to the Office of Communications with
the special Special event Event permitPermit.
3.Late and incomplete applications may not be processed.
4.All insurance requirements must be filed and processed with the City’s Risk Management
Department 20 business days prior to the event in order to receive a final, approved special
Special event Event permitPermit.
5.The applicant will receive a conditional notice of approval or notice of denial within 20
working days of submission of the special events permit application. Final, full approval is
contingent on completion of all outstanding paperwork, fees, deposits, and insurance
requirements, noted on the conditional approval.
6.A Special Event Permit shall be required for the following activities:
a.An organized formation, parade, processional or assembly of more than one hundred (100)
participants (may include people, animals, vehicles or any combination thereof); that assemble
or travel in unison on any public street, highway, alley, sidewalk or other public walk.
b.Any organized formation, parade, procession or assembly which either (1) may impede,
obstruct impair or interfere with free use of a public street, highway, alley, sidewalk or other
public way owned, controlled or maintained by the City or (2) does not comply with normal or
usual traffic regulations or controls.
c.Any activity on public property that could reasonably be expected to require provision of
public safety or clean up services.
d.Any activity on public property that involves the placement of a tent, canopy, or other
temporary structure (e.g. stages, bleachers) if that placement requires a permitfrom the City’s
Fire Department or Building Division.

d.Events conducted by local elementary schools, middle schools, high schools or colleges that
are conducted on their own grounds and property and will not significantly impact traffic flow
on surrounding public streets or pose a risk to public safety.
e.Any religious activities taking place on premises approved and/or regularly used for religious
purposes
f.Filmmaking activities for which a filming permit has been requested and granted
g.Community/neighborhood block parties, where a block party permit has been requested and
granted
h.Standard sporting leagues/tournaments held within a City park or recreation field and where
all necessary facilities use permits and approvals had been requested and granted by the

Department of Recreation
i.Established entertainment facilities that have long-term contracts with the Citythat define the
conditions and requirements for conducting ongoing public events.
8.5.Insurance Requirements
The City of Chula Vista requires liability insurance for all special events on City-owned,
controlled or maintained property. The event organizer must procure insurance against claims
for injuries to persons or damages to property that may arise fromor in connection with the
permitted event, including those arising from the actions of the event organizer, his agents,
representatives, employees or subcontractors and must provide documentation of the same
before a final permit will be issued. Event organizers must meet the following minimum
requirements:
a.Provide a Certificate of Insurance evidencing General Liability insurance for bodily injury,
property damage, and personal injury on a per occurrence basis. Limits to be determined by
the City’s RiskManager based upon an analysis of the risks associated with the permitted
activity.
b.Any deductibles or self-insured retentions must be declared to and approved by the City.
c.The City of Chula Vista, its officers, officials, employees, agents and volunteersare to be
named as additional insureds with respect to liability arising out of the event.
d.Insurance is to be placed with licensed insurers admitted to transact business in the State of
California with a current A.M. Best’s rating of no less than A-V.
e.Provide that policy is primary and non-contributory to any other insurance available to the
City.
f.Provide minimum of thirty (30) days written notice of cancellation of the policy for any
reason, other than non-payment of premium.
g.Provide other insurance as deemed necessary by the City’s Risk Manager to address the risk
associated with the event (i.e. Liquor Legal, Fireworks, Automobile, Aviation, etc.)
h.If the event organizer is unable to meet the above requirements, it may be possible to purchase
event specific liability insurance via the City’s Officeof Risk Management. Issuance of the

insurance will be subject to underwriting criteria of the insurer and may not be available for
all types of events.
9.6.Common Grounds for Denial of Application
a.Application is submitted less fewerthan fifty forty-five(5045) days prior to scheduled event

i.If the Office of Communications denies a special event application, an appeal may be
submitted in writing to the City Manageror his/her designee.If the City Manager’s Office
upholds the denial of the application, a final appeal may be presented in person at the next
City Council meeting, by filing a speaker request in advance with the City Clerk’s Office.

BLOCK PARTIES
Permits for block parties on City owned, controlled, or maintained property shall be issued upon
proof the established special event criteria have been met and subject to certain preconditions being
met as follows:
1.A request to the City for closing of a street for a block party will be referred to the City
Manager’s Officefor investigation and approval.
2.The City Manager’s Officewill determine feasibility of the requested closing by checking
with the Departments of Public Works, Police, Fire and other affected public utility agencies.
3.The closing of a street for block parties is permissible for local residential streets only.
4.No street shall be closed for a block party more than once in a three-month period.
5.Signatures for 80% of all households within the party area indicating their consent for the
closure must be submitted with the application on the Signature Authorization Form found

BACKGROUND:
As the City continues its efforts toward a sustainable budget that will withstand uncertain economic
times in the long term, it is appropriate that cost recovery levels be established for services for which
a fee is charged.The foundation ofeffective cost recovery is a well conceived, regularly reviewed
policy.Such a policy providesa guideline for setting fees given the full cost of each service, allowing
optimum cost-recovery rates for certain services and alleviating unintended subsidization of these
services from General Fund resources.
A cost recovery policy provides guidelines for setting fees given the full cost of service. It does not
bind policy makers to increasing or decreasing fees, but provides a rationale for doing so. The lower
fees are set relative to full cost recovery, the more General Fund dollars are required to maintain the
service. This additional support must then be weighed against the other needs for General Fund
resources, including needs which may not have similar cost recovery options.
While a primary mission of government is to satisfy community needs, many city services solely benefit
specific individuals or businesses. It has been the general policy of the City Council that the public at
large should not subsidize activities of such a private interest through general tax revenues. Therefore,
the City has established user fees to best ensure that those who use a proprietary service pay for that
service in proportion to the benefits received. With few exceptions, such as those services provided for
low-incomeresidents, fees have been set to enable the City to recover the full cost of providing those
services.
PURPOSE:
The purpose of this Policy is to establish a citywide cost recovery policy, including:
1.Provisions for ongoing review;
2.Process for establishing cost recovery levels(including factors to be considered and general
concepts); and
3.Target cost recovery levels for each program offered by the City.

Provision for Ongoing Review
Fees willbe periodically reviewed in order to keep pace with changes in the cost of living and
methods or levels of service delivery. In order to facilitate a fact-based approach to this review, a
comprehensive analysis of the city’s costs and fees should be madeat least every five years. In the
interim, fees will be adjusted annually each October 1, by either:
1.Annual change in the City’s operating budget; or
2.Annual change in the San Diego area’s Consumer Price Index for all Urban Consumers
All updates will be based upon the July to July change in the subject index for the prior year(or
portion thereof in the instance of mid-year fee updates).
Process for Establishing Cost Recovery Levels
Factors to be Considered
The following factors will be considered when setting cost recovery levelsforuser fees.
1.Community-wide versus special benefit
The use of general purpose revenue is appropriate for community-wide services while user
fees are appropriate for services that are of special benefit to easily identified individuals or
groups. Full cost recovery is not always appropriate.
2.Service recipient versus service driver
After considering community-wide versus special benefit for the service, the concept of
service recipient versus service driver should also be considered.
Particularly for services associated with regulated activities (development review, code
enforcement), from which the community primarily benefits, cost recovery from the ‘driver’
of the need for the service (applicant, violator) is appropriate.
3.Consistency with City public policies and objectives
City policies and Council goals focused on long term improvements to community quality of
life may also impact desired fee levels as fees can be used to change community behaviors,

promote certain activities, or provide funding for pursuit of specific community goals. For
example, the City has historically subsidized building permits for photovoltaic systems in
order to promote their use in the community.
4.Elasticity of demand
Pricing of services can significantly impact demand. At full cost recovery, this has the
specific advantage of ensuring that the City is providing services for which there is a genuine
market, and that it is not over-stimulated by artificially low prices.
Conversely, high levels of cost recovery may negatively impact the delivery of services to
lower income groups. This negative feature can work against public policy, especially if the
services are specifically targeted to low income groups.
5.Feasibility of collection
Although it may bedetermined that a high level of cost recovery may be appropriate for
specific services, it may be impractical or too costly to establish a system to identify and
charge the user. The method of assessing and collecting fees should be as simple as possible
in order to reduce the administrative cost of collection.
General Concepts
1.Revenues should not exceed the reasonable cost of providing the service.
2.Cost recovery goals should be based on the total cost of delivering the service, as calculated
using the fully burdened hourly rates developed in the City’s Cost Allocation Plan (CAP),
including direct costs, departmental administration costs and organization wide supports costs
such as accounting, personnel, informational technology, legal services, fleet maintenance and
insurance.
3.The method of assessing and collecting fees should be as simple as possible in order to reduce
the administrative cost of collection.
4.Rate structures should be sensitive to the ‘market’ for similar services as well as to smaller,
infrequent users of the service.
5.A unified approach should be used in determining cost recovery levels for various programs
based on the factors discussed above.

Determination of Cost Recovery Levels
Level I: 0% -30%
Low cost recovery levels (0%-30%) are appropriate under the following circumstances:
1.There is no intended relationship between the amount paid and benefit received. Almost all
‘social service’ programs fall into this category.
2.Collecting fees is not cost effective or will significantly impact the efficient delivery of the
service.
3.There is no intent to limit the use (or entitlement to) the service. Again, most ‘social service’
programs fit into this category as well as many public safety services. Historically, access to
neighborhood and community parks would also fit into this category.
4.The service is non-recurring, generally delivered on a ‘peak-demand’ basis, and is not readily
available from a private sector source. Many public safety services also fall into this category.
5.Collecting fees would discourage compliance with regulatory requirements and adherence is
primarily self-identified, and as such, failure to comply would not be readily detected by the
City. Many small-scale licenses and permits fall into this category (hot water heaters, garage
sale permits, etc.)
6.The public at large benefits even if they are not the direct users of the service.
Level II: 30% -70%
Services with factors associated with both Level I and Level III costrecovery levels would be
subsidized at a mid-level of cost recovery (30%-70%). See Level I and Level III sections of this
Policy for a description of these factors.
Level III: 70% -100%
Highercost recovery levels (70%-100%) are appropriate under the following circumstances:
1.The service is similar to service provided through the private sector.
2.Other private or public sector alternatives could or do exist for the delivery of the service.
3.For equity or demand management purposes, it is intended that there bea direct relationship
between the amount paid and the level and cost of the service received.
4.The use of the service is specifically discouraged. Police responses to disturbances or false
alarms might fall into this category.
5.The service is regulatory in nature and voluntary compliance is not expected to be the primary
method of detecting failure to meet regulatory requirements. Building permit, plan checks,
and subdivision review fees for large projects would fall into this category.

WHEREAS, City Council Policy 102-06 (Special Events and Block Parties) identifies the
characteristics of activities requiring Special Event Permits and Block Party Permits and
establishes the permit issuance processes; and
WHEREAS, a cross-departmental Continuous Improvement team was assembled to
improve the Special Event Permitting process; and
WHEREAS, the Continuous Improvement team recommends refining the characteristics
of activities requiring a Special Event Permit and simplifying the permitting process by
amending City Council Policy 102-06; and
WHEREAS, the proposed policy amendments will streamline the Special Event
and
WHEREAS, the Council wishes to amend City Council Policy 102-06 (Special Events
and Block Parties), as set forth in Exhibit 1, attached hereto and incorporated herein by reference

coordinates with event planners to ensure a well-planned and organized event.

The City of Chula Vista invites the use of City facilities for public events. This policy outlines the
types of events, requirements, and process for securing a Special Event or Block Party Permit.

A Special Event Permit is required for any organized activity on public property to which the

1.Any modification to traffic flow patterns (street closures, lane closures, traffic stops) or
parking regulations; and/or,

3.Any combination of two or more of the following:
a.Sales or distribution of merchandise or food; and/or,
b.Use of City utilities; and/or,
c.Single tent, or connected tents, greater than700 square feet; and/or,

a.An organized formation, parade, processional or assembly of more than one hundred (100)
participants (may include people, animals, vehicles or any combination thereof); that assemble
or travel in unison on any public street, highway, alley, sidewalk or other public walk.
b.Any organized formation, parade, procession or assembly which either (1) may impede,
obstruct impair or interfere with free use of a public street, highway, alley, sidewalk or other
public way owned, controlled or maintained by the City or (2) does not comply with normal or
usual traffic regulations or controls.
c.Any activity on public property that could reasonably be expected to require provision of
public safety or clean up services.
d.Any activity on public property that involves the placement of a tent, canopy, or other
temporary structure (e.g. stages, bleachers) if that placement requires a permitfrom the City’s
Fire Department or Building Division.

8.5.Insurance Requirements
The City of Chula Vista requires liability insurance for all special events on City-owned,
controlled or maintained property. The event organizer must procure insurance against claims
for injuries to persons or damages to property that may arise fromor in connection with the
permitted event, including those arising from the actions of the event organizer, his agents,
representatives, employees or subcontractors and must provide documentation of the same
before a final permit will be issued. Event organizers must meet the following minimum
requirements:
a.Provide a Certificate of Insurance evidencing General Liability insurance for bodily injury,
property damage, and personal injury on a per occurrence basis. Limits to be determined by
the City’s RiskManager based upon an analysis of the risks associated with the permitted
activity.
b.Any deductibles or self-insured retentions must be declared to and approved by the City.
c.The City of Chula Vista, its officers, officials, employees, agents and volunteersare to be
named as additional insureds with respect to liability arising out of the event.
d.Insurance is to be placed with licensed insurers admitted to transact business in the State of
California with a current A.M. Best’s rating of no less than A-V.
e.Provide that policy is primary and non-contributory to any other insurance available to the
City.
f.Provide minimum of thirty (30) days written notice of cancellation of the policy for any
reason, other than non-payment of premium.
g.Provide other insurance as deemed necessary by the City’s Risk Manager to address the risk
associated with the event (i.e. Liquor Legal, Fireworks, Automobile, Aviation, etc.)
h.If the event organizer is unable to meet the above requirements, it may be possible to purchase
event specific liability insurance via the City’s Officeof Risk Management. Issuance of the

insurance will be subject to underwriting criteria of the insurer and may not be available for
all types of events.
9.6.Common Grounds for Denial of Application
a.Application is submitted less fewerthan fifty forty-five(5045) days prior to scheduled event
start date.
b.Application is found to be incomplete or contain material falsehoods or misrepresentation.
c.Failure to meet insurance requirements.
d.Requested venue has already been reserved on the same date for another event/activity.
e.Requested venue cannot physically accommodate the proposed event due to the number of
anticipated attendees or size/nature of planned activities.
f.City staff cannot provide necessary services to ensure public safety or prepare/maintain venue.
g.Event organizer has violated the terms of previous event permits or damaged City property.
h.Event organizer has unpaid debts resulting from previous events (e.g. fees assessed for
permits, city services, damages, etc.).
i.If the Office of Communications denies a special event application, an appeal may be
submitted in writing to the City Manageror his/her designee.If the City Manager’s Office
upholds the denial of the application, a final appeal may be presented in person at the next
City Council meeting, by filing a speaker request in advance with the City Clerk’s Office.
10.7.Fees
a.A nonrefundable administrative fee must be submitted to the Office of Communications with
the special Special event Event permitPermit.
b.City departments that provide services that are made necessary by the event, before, during or
after the event, are authorized to assess charges for cost recovery of the services provided (i.e.,
street closures, street sweeping, crowd control, etc.).The permit will be circulated to City
staff where an estimate of fees will be determined based on the information provided by the
event organizer on the event application. The Office of Communications will total the
estimates and present the estimated costs to the event organizer.

c.Should the event organizer not be able to afford the estimated City service fees, an appeal may
be presented in person at the next City Council meeting, by filing a speaker request in advance
of the meeting with the City Clerk’s Office.
BLOCK PARTIES
Permits for block parties on City owned, controlled, or maintained property shall be issued upon
proof the established special event criteria have been met and subject to certain preconditions being
met as follows:
1.A request to the City for closing of a street for a block party will be referred to the City
Manager’s Officefor investigation and approval.
2.The City Manager’s Officewill determine feasibility of the requested closing by checking
with the Departments of Public Works, Police, Fire and other affected public utility agencies.
3.The closing of a street for block parties is permissible for local residential streets only.
4.No street shall be closed for a block party more than once in a three-month period.
5.Signatures for 80% of all households within the party area indicating their consent for the
closure must be submitted with the application on the Signature Authorization Form found
within the block party permit.
6.The criteria for approval should be related to:
a.The general convenience of the affected residents on the street
b.Traffic safety aspects involved
c.Any complications with scheduled street affected improvements such as gas, electricity, water,
re-surfacing, etc.
d.Any unusual impact in terms of provision of refuse collection

SCHEDULE RELATING TO SPECIAL EVENT PERMITS
WHEREAS, Chapter 2 (General Government Fees) of the C
includes a simplified definition of activities requiring a Special Event Permit and establishes the
fees therefor; and
WHEREAS, a cross-departmental Continuous Improvement team was assembled to
improve the Special Event Permitting process; and
WHEREAS, the Continuous Improvement team recommends refining the characteristics
of activities requiring a Special Event Permit as established in City Council Policy 102-06; and
WHEREAS, City Council Policy 102-06 has been amended to reflect the
recommendations of the Continuous Improvement team this same day; and
WHEREAS, in order to maintain consistency between the Master Fee Schedule and City
Council Policy 102-06, the Council wishes to amend Chapter 2 (General Government Fees) of
the Master Fee Schedule relating to Special Event Permits, as set forth in Exhibit 1, attached and
incorporated into this resolution by this reference, as if set forth in full; and
WHEREAS, the proposed fees to do not exceed the reasonable cost of providing the
associated services; and
WHEREAS, Article XIII C of the California Constitution requires a vote of the electorate
to increase any levy, charge, or exaction imposed by a local government, unless specifically
exempted; and
WHEREAS, pursuant to the provisions of Article XIII C, the proposed fees are exempt
from the vote requirement; and
WHEREAS, the proposed amendments to Chapter 2 of the Master Fee Schedule shall
become effective upon adoption of this Resolution by the City Council.

(ESTABLISHING COUNCIL POLICY RELATIVE TO USE OF
SPECIAL OFFICERS FOR POLICING NON-CIVIC SPECIAL
EVENTS)
WHEREAS, City Council Policy 762-02 (Establishing Council Policy Relative to Use of
Special Officers for Policing Non-Civic Special Events) was adopted in 1982 to address requests
for the City to provide Reserve Officers for special events, for which an entry or admission fee is
required; and
WHEREAS, the policy establishes that Special Officers will be provided in place of
Reserve Officers; and
WHEREAS, the City no longer has a Special Officer classification, limiting the
applicability of the policy; and
WHEREAS, in order to streamline the Special Event Permitting process, it is appropriate
to review, update, and consolidate City Council Policies relating to special events; and
WHEREAS, the Council wishes to repeal City Council Policy 762-02 (Special Events
and Block Parties), as set forth in Exhibit 1, attached hereto and incorporated herein by reference
as if set forth in full.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula
Vista, that it does hereby repeal City Council Policy 102-06 (Establishing Council Policy
Relative to Use of Special Officers for Policing Non-Civic Special Events) in its entirety.
