INC. TO SERV'E AS THE OTAY RANCH PRESER\%E STEWARDBIOLOGIST. AND AUTHORIZII�'G THE CITY MAI�'AGER TO E�'ECUTE UP TO FOUR 1-YEAR EaTEi�'SIOI�'S. A1�TD ANI' RELATED DOCUAIEI�'TS Ii�i CONJUI�'CTION ��ITH IMPLEMENTING THE AGREEMEI�iT A'HEREAS; the Cit�� of Chula Vista (Cin) and the County of San Dieeo (Count}�)jointl}� adopted the Otap Ranch General Development P1an/Subregional Plan (GDP/SRP) in 1993, which sets forth the plans for development and open space within Ota�� Ranch; and WHEREAS. the GDP/SRP delineates an approximatel}� 11,000 acre area as the Otav Ranch Preserve s��stem (Presen�e) and includes the Otay Ranch Resource Manaeement Plan (RMP) Phase l, which identifies major policies and implementation measures to guide development and the protection of the biological and cultural resources w�ithin Otay Ranch; and WHEREAS, pursuant to provisions of the RMP Phase 1 a Preserve ONmer/Manaser (POA4) for the Presen�e must be selected and an RI�4P Phase 2 must be completed, which ���ould serve as the implementation plan providing the framework for the protection, manaeement; and monitorine requirements of the Preserve; and � WHEREAS; in 1996, the RMP Phase 2 «as completed and the Cit}� and the County desienated themseh�es as the Ota�� Ranch POA4 and ezecuted a Joint Powers Aereement to delineate their respective roles and responsibilities; and VIHEREAS. the Cirv and Counrv continue to serve as the Ota�� Ranch POM and aze responsible for implementing the RMP bv activelv managing and monitoring preser��e lands conve��ed to the Ota�� Ranch Presen�e s�stem: and WHEREAS. in March 2009. the Otav Ranch POA4 Preserve Manasement Team and Policv Committee directed POM staff to retain a Presen�e StewardBioloeist ro pro�ide the technical expertise to ad��ise the POM on the status of the Preserve; monitor the sensitive bioloeical resources existing �+�ithin the Presen�e, and implement basic ste���ardship in accordance H�ith the RMP: and �'HEREAS, on 1�9av 6, 2009, a Request for Qualifications was distributed to qualified bioloaical consultants in order to solicit candidates interested in servina as the Otav Ranch Presen�e SteH�ard/Biolo�ist: and � Resolution No. 2014-146 Pa�e No. 2 WHEREAS; through a Request for Qualifications solicitation and a subsequent competitive bid process; the Consultant (RECOt�') was selected based upon its proposed approach and demonstrated qualifications to perform the services outlined in the detailed scope of work: and V��HEREAS. in 2009, Cifi Council approved a two-party Agreement with the Consultant ('2009 Agreement") that authorized the Cit}� to rene��the 2009 Agreement on an annual basis, at the City's sole discretion, for four additional one-year terms; and WHEREAS; the 2009 Agreement contains a provision that allows the City Council to authorize subsequent renewals, at its discretion. beyond the 6ve-year term of the 2009 Agreement; and WHEREAS, the 2009 Aareement will terminate August 4, 2014, and an amendment to the 2009 Agreement is necessary to authorize continuation of the Consultant's biological management and monitoring sen�ices for an additional five years and to amend the per annum budget; and VVHEREAS; the Otay Ranch Preserve Management Team and Otay Ranch Policy Committee held duly noticed public meetings on April 21, 2014 and May 12, 2014, respectivel}�, at which they noted their continued support of the Consultant and directed staff to extend the Consultant's biological consulting sen�ices associated with the Otay Ranch Preserve Steward/Biologist for an additional fi��e years; and WHEREAS; in accordance N�ith CVMC 2.56.070, Consultant was solely selected to continue biological consulting services associated with the Otay Ranch Preserve Steward/Biologist based upon their experience and unique understanding of the Otay Ranch Preserve, and have consistently demonstrated that they possesses the qualifications required to continue the services outlined in the detailed scope of work; and WHEREAS, in accordance with Council Policy No. 102-05, the scope of services to be provided by Consultant is not similar in scope to those of separate contracts under which Consultant currently pro��ides sen�ices to the City. NOW, THEREFORL, BE ]T RESOLVED by the City Council of the City of Chula Vista, that it approve the Agreement between the Ciq� of Chula Vista and Recon Environmental, I�c. to serve as the Otay Ranch Presen�e Ste�vardBiologist, in the form presented; with such minor modifications as may be required or approved b}� the City Attorney; a copy of���hich shall be kept on file in the Office of the City Clerk. authorize and direct the Mayor to e�ecute the Aareement, and authorize the City Manager to eaecute up to four one-year estensions to the Agreement, and any related documents, in conjunction ti�ith implementing the Aereement on behalf of the Citv.
