HomeMy WebLinkAboutReso 1993-17295RESOLUTION NO. 17295 A RESOLUTION OF THE CITY OF CHULA VISTA CITY COUNCIL AMENDING THE LAND USE DIAGRAM OF THE GENERAL PLAN FROM PROFESSIONAL AND ADMINISTRATIVE COMMERCIAL TO RETAIL COMMERCIAL FOR 5.8 ACRES LOCATED AT THE SOUTHWEST CORNER OF THIRD AVENUE AND "j" STREET WHEREAS, Plan amendment and, on December 2, 1993, a duly verified application for a General was filed with the City of Chula Vista by American Stores Inc.; WHEREAS, of the General Commercial for Street; and, said application requested an amendment to the Land Use Diagram Plan from Professional and Administrative Commercial to Retail 5.8 acres located at the southwest corner of Third Avenue and "j" WHEREAS, the Planning Commission held a public hearing on October 13, 1993, and voted 5-1-1 (Salas against; Tuchscher-conflict of interest) to recommend that the City Council approve the proposed amendment to the Land Use Element of the General Plan from Professional And Administrative to Retail Commercial; and, WHEREAS, the City Clerk set the time and place for a hearing on said application and notice of said hearing, together with its purpose, was given by its publication in a newspaper of general circulation in the city and its mailing to property owners within 1000 feet of the exterior boundaries of the property at least 21 days prior to the hearing; and, WHEREAS, the hearing was held at the time and place as advertised, namely 7.00 p.m. November 2, 1993 in the Council Chambers, 276 Fourth Avenue, before the City Council and said hearing was thereafter closed. WHEREAS, from the facts presented to the City Council, the Council has determined that there does not appear to be a shortage of either commercial office or retail commercial acreage in the area; and, WHEREAS, the commercial retail designation is consistent with the land use pattern established along the Third Avenue commercial corridor. NOW, THEREFORE BE IT RESOLVED THAT based on the findings and recommendations of the Environmental Review Coordinator, the City Council does hereby adopt the Mitigated Negative Declaration issued on IS-93-43. BE IT FURTHER RESOLVED that the City Council finds that the amendment is consistent with the goals and objectives of the Chula Vista General Plan and does Resolution No. 17295 Page 2 hereby amend that portion of the Land Use Diagram of the General Plan from Professional and Administrative Office to Retail Commercial for 5.8 acres at the southwest corner of Third Avenue and "J" Street as shown in Exhibit "D".
