RESOLUTION OF THE CITl' COU?vCIL OF THE CITl' OF

BETV�'EEI�' THE CITY/HOUSING AUTHORITY AND
COMPLIAI�'CE SER\'ICES. LLC FOR AFFORDABLE
HOUSI?�'G MOI�TITORII�'G SOFTVIARE; AND (3)
AUTHORIZING THE CITY A4ANAGER/HOUSII�'G
AUTHORITY DIRECTOR OR HIS DESIGNEE TO EXECUTE
THE IivIT1AL AGREEA4ENT AI�'D AUTHORIZ[I�'G THE
PURCHASING AGENT TO E�ECUTE THREE ONE-1'EAR
OPTIOI�'S TO EJiTEI�'D 1'HE AGREEMEt�'T
VdHEREAS, as a condition of receivine Federal fundina from the U.S. Department of
Housing and Urban Development. the Cit�� is required to monitor its Communitv Development
Block Grant, and HOME In��estment Partnership assisted projects during the affordable renta]
housin� affordabilit}� period; and
WHEREAS, as the issuer of A4ulti-Famil�� Housine Re��enue Bonds, the Cit� is requued
to monitor its Califomia Debt Allocation Committee (CDLAC) funded projects during the
Qualified Compliance Period; and
V�'HEREAS, the Cin� of Chula Vista is required to monitor projects funded using Lo���
and n4oderate Income Housina funds in accordance ��ith Califomia Health and Safetv Code
Section 33000, et.seq; and �
A'HEREAS. the Cin� of Chula Vista has funds from the annual monitorina fees collected
from bond financed projects; and
R'HEREAS, the Cit�� is seel:ing professional consultant sen�ices to assist the Ciri in
monitorine its affordable housina stock: and
V�'HEREAS. the Compliance Sen�ices. LLC (`Consu]tanT')'s sofr���are is currenth� in use
by various public asencies and said s��stem is used to monitor over 600 affordable housine
properties, representine more than 6�.000 units. Cities that currentiv use the sofr���are and
related services include the Citv of Concord. Cin� of Escondido. Cit�� of Foster Cit��. Cit�� of
Fresno, Citv of Ha���ard. City of Hesperia, Cit}� of Santa Clara� and Contra Costa Count�; and
�b'HEREAS, Compliance Ser��ices, LLC (`Consultant") ���as selected due to its intimate
l:nowledse of and approach to monitorine affordable housine using a web-based reponin2
compliance reportine s}�stem, its estensive experience, and its abilit}� to complere the services in
a timelv manner: and

VdHEREAS, the City has used Consultants sofiN�are since 2010 and significant resources
have been dedicated to trainina cit�� staff and property owner/managers to effectively operate the
soft��aze: and
W"HEREAS, Consultant w�arrants and represents that it is esperienced and staffed in a
manner such that it can deliver the services required of Consultant to City in accordance with the
time frames and the terms and conditions of this Agreement; and
WHEREAS. based on Consultant's unique sofrware product and histon� of use by the
Cit}� as set forth above. the Cit}� desires to ���aive the competitive bidding requirements. and enter
into a two-part}� agreement N�ith Compliance Services, LLC to provide compliance monitoring
and reporting sofrware services (`'Agreemenf') in an amount not to exceed $15,000. with three
(.i) one-vear options to extend in amounts not to exceed $15,000 each year, for a maximum
authorized amount of$60,000. contineent upon availability of fundine.
NOW, THEREFORE, BE IT RESOLVED based on the t7ndings abo��e, the City Council
of the City of Chula Vista does hereby wai��e the competitive bidding requirements and authorize
the City manager or his designee to eaecute the Agreement in an amount not to exceed $15;000,
with three (3) one-year options to extend in ainounts not to exceed $15,000, for a ma�imum
authorized amount of $60;000; and authorize the purchasing agent to eaecute three (3) one (1)
year options to estend.
