A4AKIIvG CERTAIN FI?�'DII�'GS A_ND APPROVII�'G THE AA4E?�TDED L.4_�TD USE PLAl�' OF THE LOCAL COASTAL PROGRAM AND DIRECTI?vG STAFF TO FOR�1'ARD THE SAA�fE TO THE CALIFORIvIA COASTAL COn4MISSlOi�' �VHEREAS. the Cit}� of Chula Vista (Cin�) and the San Dieeo Unified Port District (Pon District), in a collaborative effort «�ith the communit� beQan ���orl:ino on a comprehensive Chula Vista Ba��front Master Plan in 2002: and � \1'HEREAS; on September 2�, 2012; the Cit�� Council approved and adopted the Califomia Coastal Commission-certified Local Coastal Proeram (LCP); and WHEREAS. the azea of land. ��hich is the subject oFthis Resolution is diagrammaticallv represented in E�hibit A attached hereto and incorporated herein by this reference, and for the purpose of general description is the Chula Vista Ba��front generall�� located �i�est of Interstate �. south of the Sweet��ater Marsh; east of the San Diego Ba}�, and nonh of Palomar Street, includine n��o territor�� islands one �enerall�� located south of State Route �4 benveen Broadwav and Fifrh A��enue. and the other eenerallv located on the �rest end of Faivre Street: and R'HEREAS, California State law requires that coastal cities adopt a LCP and said LCP must be certified bv the Califomia Coastal Commission before the LCP can become effective and implemented bv the local jurisdiction; and �i'HEREAS; the LCP is composed of a Land Use Plan (LliP) and a Specific Plan; and WHEREAS. the LCP ���as certified bv the California Coastal Commission on Aueust 9. 2012: and . � «%HEREAS; subsequent to the adoption and certification of the LCP it «�as determined that the documents needed "clean-up" changes related to cenain corrections, clarification of languaee and processes to render them consistent ���ith current conditions and practices; and �l'HEREAS, the proposed changes do not cause substantial chanees to the objecti��es, policies, and reeulations contained in the documents nor the Coastal Act policies; and \�'-I-IEREAS, the proposed changes to the LUP component of the LCP documents aze show�n in strikeout and underline format and said document is on file in the Office of the Cin� Clerk and made a part hereof by this reference; and Resolution No. 2014-1�0 Pase No. 2 VdHEREAS, the Proposed LCP Amendment is contained in a document l:nown as Local Coastal ProRram Amendment on file in the Office of the City Clerk: and WHEREAS, the Development Sen�ices Director set the time and place for a heazine bv the Planning Commission on the proposed LCP Amendment, and notice of said hearin�. together ��-ith its purpose, was eiven b}� its publication in a ne��spaper of general circulation in the Cit}� and its mailing to property o��ner within the exterior boundaries of the LCP Area, at least ]0 da��s prior to the hearing; and WHEREAS, the hearing «�as held at the time and place as advertised; namely 6:00 p.m.; June ] l, 2014, in the Council Chambers, 276 Fourth Avenue, before the Planning Commission and the hearine ��as thereafrer closed: and WHEREAS, the Planning Commission considered all reports, e�idence. and testimonv presented at the public hearing with respectto the drafi LCP Amendment and Addendum; and �'HEREAS, at said public hearina the Planning Commission recommended through a vote of 5-0-2-0 that the Cit}� Council approve the Resolution considering the Addendum to the EIR, make tbe findings contained therein; and approve the Amendment to the LCP LUP; and WHEREAS; the Development Services Director set the time and place for a hearing of the City Council on the proposed LCP Amendment for July 22, 2014, and notice of said hearing, rogether with its purpose, ti�as given pursuant to Califomia Govemment Code 65091 and 6092 at least ten days prior to the hearing; and WHEREAS; the hearing N�as held at the time and place as advertised, namely on July ZZ; 2014. at 2:00 p.m. in the City Council Chambers, 276 Fourth Avenue, before the Cit}� Council and said hearine �i�as thereafter closed: and WHEREAS, the Cin� Council considered all reports, evidence, and testimony presented at the public hearing ��ith respect to the draft LCP Amendment and Addendum. I. NO�'; THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does herebv find and detemiine as follo���s: A. ENVIRONMENTAL DET�RMIT�'ATION That the proposed project has been reviewed for compliance �vith the Califomia Environmental Qualit�� Act (CEQA) and Cit}� Council has determined that the prqject ���as coaered in previously adopted Environmental Impact Report UPD#833�6-EIR- 6�B/SCH#200�081077. The City Council has further determined that only minor technical changes or additions to this document are necessary and that none of the conditions described in Section 15162 of the State CEQA Guidelines calline for the preparation of a subsequent document have occurred; therefore, the City Council has considered an Addendum to Environmental Impact Report UPD#833�6-EIR- 6�B/SCH#200�081077 in accordance ��,�ith Section ]�164 of the State CEQA Guidelines. Resolution I�'o. 2014-1�0 Pase No. 3 B. GE1�'ER�L PLAN .AND COAST.AL .ACT CONSISTEI�C1': That the proposed amendment to the Local Coastal Program, consisting of the Land Use Plan (LUP) and Specific Plan (SP); is consistent with the Cit�� of Chula Vista General Plan and the policies of the Coastal Act. 1'he proposed chan2es to the LUP and SP aze minor and unsubstantial and lea<<e all of the provisions of the LUP and SP intact. ��ith the chanees in place the pro��isions of the documents are still based on sound planning principles and practices that ��ill provide for the protection and consen-ation of sensiti��e natural resources. The provisions of the documents continue to allo��� the transfer of development from the S���eet�aater District to the Hazbor District. «�hich is a previoush- de��eloped and less sensiti��e area of the Ba}front, leading to the development of a project that will minimize potential nesative impacts. 7he pro��isions of the documents ���ill also contribute to pro��ide more direct access to the Bayfront and create better connection to the rest of the city and the region. This ��ill open up the Ba}�front for the enjo��ment of residents and �isitors. The provision of the LUP and SP H�ill be conducive to the development of the Ba}�front and the creation of a ��orld-class destination for residents and ��isitors. II. BE IT FURTHER RESOLVED that the Citv Council of the Citv of Chula Vista does hereby adopt the Proposed LCP Amendment contained in a document I:no��m as Local Coastal Pro�ram Amendment on file in the office of the City Clerk and incorporated herein by this reference. III. SUBMISSIO\' TO COASTAL COMI�4ISSION BE IT FURTHER RESOL\+ED. that the Citv Council does herebvi certifi� after a dul�� called and duly noticed public hearin� that the LCP is intended to be carried out in a manner fully in conformit}� µ�ith the California Coastal .Act of ]976 (Public Resources Code Section 30�]0(a)). BE IT FURTHER RESOLVED, that the Cin� Council finds that the LCP complies with the euidelines established b�� the Coastal Commission and contains materials sufficient for a thorough and complete re�ie�v (Public Resources Code Section 30�]0(b)).
