FISCAL OPERATIO?�'S A4AI�'.4GER. :�\D AD\%A.�'CED PL.4\TI?vG MAN.AGER V�'HERE.AS, the Human Resources Department has created ne�� classifications to better reflect the needs of the Cih-s ��°orkforce and to pro�ide greater sen�ice to the communit��; and �'HEREAS, Chula Vista Cit�� Charter Section �00(a) requires that all neti� unclassified manaeement le�el positions be adopted b�� ordinance and a four-fifrh ��ote of the Council. NOW. THEREFORE. the Cit�� Council of the Cirv of Chula \'ista does ordain as follo���s: Section I. That Section 2A�.010 of the Chula Vista Municipal Code is herebv amended to read as fo1loH�s: 2.0�.10 Unclassified positions established. Severabiliri lf an�� portion of this Ordinance. or its application to any person or circumstance. is for am� reason held to be invalid, unenforceable or unconstitutional, by a court of competent jurisdiction, that portion shall be deemed se��erable; and such invalidity. unenforceabilit} or unconstitutionalitv shal] not affect the ��alidit�� or enforceability of the remainin� portions of the Ordinance, or its application to anv other person or circumstance. The City Council of the City of Chula Vista hereb}� declazes that it would ha��e adopted each section, sentence. clause or phrase of this Ordinance; irrespective of the fact that am� one or more other sections; sentences. clauses or phrases of the Ordinance be declared imalid, unenforceable or unconstitutional. Section III. Construction The Cit�� Council oFthe City of Chula Vista intends this Ordinance to supplement, not to duplicate or contradict, applicable state and federal law and this Ordinance shall be construed in light of that intent. Section IV. Effective Date This Ordinance shall take effect and be in force on the thirtieth day afrer its final passaQe. Section V. Publication The City Clerk shall certifi� to the passage and adoption of this Ordinance and shall cause the same to be published or posted according to la���.
