The City Council , at the meeting of March 2, 1976, considered a request to allow bulky retail uses in the industrial zones. The Council indicated that the request had merit and directed that the matter be referred to the Planning Comnission for appropriate action. , 2. The Code presently allows certain cormnercial uses within the industrial zones as "accessory uses". Section 19.04.006 of the Municipal Code defines "accessory use" as: "a use or structure subordinate to the principal use of a building on the same lot and serving a purpose customarily incidental to the use of the principal building." Other comnercial uses are allowed in the industrial zones subject to approval of a conditional use permit. These include such uses as service stations, restaurants, motels, etc. 3. The uses contemplated in this proposed amendment are uses that have a tendency to � overlap the coimnercial and industrial classification and adapt well to either zoning category, depending on surrounding uses. Whi.le bulky retail uses are technically retail in nature, the size and character of their operation is often more related to an indus- trial plant. Because these uses demand a substantial amount of land area generally 'with less public exposure, the industrial areas with cheaper land costs oresent a better business climate for the operation. 4. On June 14, 1976 the Planning Correnission voted 6-0 recormnending that the City Council adopt amendments to the Municipal Code as follows : (continued on supplemental page) EXHIBITS ATTACHED Agreement Resolution Ordinance X Plot Other Letter Res. RECOMMENDATION Adopt this staff report and evaluation form and forward the attached Negative Declaration to the Planning Commission and City Council with the recommendation that they find that the proposed Zoning Text Amendment will have no significant adverse environmental impact. ZOiIES � WHEREAS, on Narch 2, 1976 the City Countil direc[ed that the Planning Comnission consider amending the 14unicipal Code to allow bulY.y retail sales in the industrial zones, and i � HIIEREAS, the Lity Planning Cormission set the time and place for a hearing to consider a proposed anendnent to the Ptunicipsl Code, and • HHEREAS, a hearing was held at said time and place, nanely 7:00 p.n., June 14, 1976 in the Council Chamber, City Hall, 276 Fourth Avenue, before the � Planning Camission and said hearing was thereafter closed, and WHEREAS, the Lw�mission found that in actordance with the I;egative - , Declaration on Initial Study 15-76-32, the proposed zonin9 text amendment would not have any possible significant inpact on the environment and certified that the tlegative Declaration was prepared on conformance with CEQA, 1970, as amended. � IiON THEREFORE BE IT RESOLVED AS FOLLOWS: � • , � 1.
