As previously indicated, certain basic elements are required under state law. They are, first, that a license issued in no event is transferable under Section 9 .12 .180 . Secondly, that minors are prohibited to play and that games are open to the public, and that only the organization authorized to conduct a bingo game may operate it and no one shall receive a profit, and that any profits from the game must be kept in a special fund, that the person must be physically present at the game and that the total value of the prizes may not exceed $250 for any game, all under Section 9 .12 .190 . The other sections of the ordinance relate to the means for achieving the limitations mandated by the State Legislature pursuant to Section 19 of Article IV of the Constitution. The Chief of Police raised certain questions relative to the role of the Police Department in regulating the bingo games . He first questioned the time limitation prior to a game for investigation of an application . This has been changed from a ten day period to a "reasonable time" . It is the same provisions that we have in the massage parlor ordinance . The Chief does not disagree with the fee for an application which the County set at $55 and which may be on the low side for the cost of the inves- tigation . The renewal fee of $10 also seems to be reasonable . The term of the license has been raised to one year . With these changes, the Police Department finds the ordinance to be satisfac- tory . As previously indicated, the ordinance closely follows that of the County and the City of San Diego with the exeption that the appeal procedure for denial or revocation of a license has been altered to conform to the procedures used in the City of Chula Vista relative to business license denial or revocation. The City Council has directed that the ordinance be amended to limit the number of days during which bingo games may be conducted to 3 days during any 7 calendar days and require that any organi- zation applying for a license have been in operation for a two- year period . / 1 `��` �
