ITEM EXPLANATION
A. BACKGROUND
1 . As a result of the approval of plans for a 3 story apartment building in the R-3-H
zone, Council asked that a zoning text amendment be prepared to establish a minimum
height for the R-3-H zone.
2. An Initial Study (IS-76-26) of possible adverse environmental impacts of this
project, PCA-76-3, was conducted by the Environmental Review Conm�ittee on May 6, 1976.
The Coimnittee concluded that there would be no significant effects and made a draft
Negative Declaration which was certified by the Planning Cortunission on May 24, 1976.
B. DISCUSSION
The R-3-H zone is the City of Chula Vista's highest density residential district and is
designed to pranote the development of residential towers or "high-rise apartments. " Not-
withstanding these factors, low profile apartments can be constructed on the zone as
there is no minimum hei9ht limit. The lower density R-3 zones permit building heights of
45 feet which can acco�nodate a four story structure. This, together with a consideration
of the overall scale of Chula Vista, argues for consideration of a 5 story structure as
"high rise. "

1 . Add a new definition for high rise buildings (Section 19.04.039) to read :
19.04.039 Building, High Rise
"Building, high rise"means any structure which is forty-six feet or
five stories or more in height.
2. Revise the R-3 zone (Section 19.28.060) as it relates to height regulations
for R-3-H structures, to read:
19.28.060 Height regulations.
A. Height regulations in the R-3 zone and R-3-M, R-3-T and R-3-G classifications
are as follows:
P!o principal building shall exceed either three and one-half stories or
forty-five feet in height and no accessory building shall exceed either two
stories or twenty-five feet in height, except as provided in Section 19.16.040.
B. Height regulations in the R-3-H zone are as follows:

WHEREpS, the City Council directed that the Planning Cortmission consider
the advisability of establishing'a mininun height requirement for apartments to be
constructed in the R-3-H zone, and
- � WHEREAS, the City Planning Lomnission set the time and place for a hearing
to consider a proposed amendnent to the Ftunicipal Code, and
WHEREAS, a hearing r�as held at said tine and place, namely 7:00 p.m.,
May 24, 1976 in the Council Chzmber, City Hall, 276 Fourth Avenue, before the
Planning Co�ission and said hearing e�as thereafter closed, and
KHEREAS, the Lo:miission found that in accordance vii[h the Regative Declaration
� on Initial Study IS-76-26 and the findings stated therein this anendment to the
Municipal Code will have no significant adversz enviromnental inpacts and certified
that the Negative Declaration Nas prepared in conformance with CEQA, 1970, as anendaG.
, - _ I;OW THEREFORE 6E IT RESOLVED AS FOLLO'AS:
1. From facts presented to the Planning Cormission, the Comnission finds
_ that public necessity, convenience, general rvelfare and goaJ zoning practice require
the adoption of the following amendments to the Iq�nicipal Code:
. a. Add Section 19.04.039 (Definitions) to read:
- 19.04.039 6uilding, high-rise.
"Building, high-rise" neans any structure which is forty-six
feet or five stories or more in height.
b. Revise Settion 19.28.060 (R-3 Apartment Residcntial Zone) to read: _

A. Background
This project consists of a zoning text amendment which clearly
defines "high-rise building" . The existing R-3-H regulations
will continue to apply 1•�ith the addi ' on of a 5 story minimum
building height requirement on riClciple structures in future
, R-3-H zones.
_ B. Recomroendation
Adopt this staff report and evalua�ion form and forward the
; attached Negative Declaration to the Planning Commission and '
City Council with a recommendation that they find that the zone
text amendment would have no possible significant impact on the
environment.
