ITEM EXPLANATION
l . The applicant has requested a change of prezoning of 2.5 acres located at the easterly
terminus of East "J" Street from P-C to R-1 -H-P. The applicant has also filed a tentative
subdivision map for 9 lots (South Bay Villas Unit #2) and petitioned for annexation.
2. The Initial Study (IS-76-13) of possible adverse environmental impacts of this project
was conducted by the Environmental Review Cortonittee which concluded on March 4, 1976 that
there would be no significant effects. The Planning Cormnission certified the Negative
Declaration on April 12, 1976 and recortunended approval of the prezoning.
3. The attached staff report for the Planning Cortonission meeting of April 12, 1976
contains additional information on this item.

A. BACKGROUND
1 . The applicant has requested a change of prezoning from P-C (Planned
Comnunity) to R-1-H-P (Single Family Residential , subject to the Hillside and
Precise Plan Modifying Districts) for 2.5 acres of property located at the
easterly terminus of East "J" Street (See Exhibit "A") . The property is currently
zoned A-1-8 in the County.
2. A tentative subdivision map (South Bay Villas N2) for 9 lots has also
been filed by the applicant and will be considered by the Planning Commission
at this meeting.
3. An Initial Study (IS-76-13) of possible adverse environmental .impacts
, of this project PCZ-76-C was conducted by the Environmental Review Committee
on March 4, 1976. The. Environmental Review Cortrnittee concluded that there would
be no significant effects and made a draft i�egative Decicaration wnich is
herewith fonvarded ror Planning Cortenission certification.
B. RECOMMENDATION
1 . Adopt a motion finding that in accordance with the fvegative Declaration
on :5-76-13 and the findings stated therein this project will have no significant
_ adverse envir�nmental impacts and certifying the Negative Declaration.
2. Adopt a motion recommending that the City Council approve the pre-
zoning of 2.5 acres to R-1-H-P (PCZ-76-C) .
C. DISCUSSION

� 2. Site Lharacteristics
The proposed prezoning area is triangularly shaped and contains approximately
2.5 acres (including all of "J" Street) with an average natural slope of 12%.
A condition of approval of the tentative map for the 40 acre property adjacent
on the south was that the applicant acquire the subject property for the

extension of East "J" Street. Some additional adjacent property also is being
acquired in order to provide for a reasonable lotting and development pattern,
given the topography of the area.
3. General Plan
The General Plan designates this area as Medium Residential Density, 4-12
dwelling units per gross acre. The proposed zoning would allow approximately
5 units per net acre. This is well within the General Plan density designation.
D. FINDINGS
1 . This prezoning constitutes good zoning practice in that it assists in
the preservation of the natural hillside areas by permitting urban development
while retaining a portion of the natural topographic features in the area.
2. The prezoning protects the public , health, safety and welfare by
directing urbanization to existing usable land adjacent to existing urban areas.
The attachment of the "H" Modifying District will minimize drainage, soil
, slippage and other geologic hazard problems corrunonly associated with mass grading
and construction on steeper slopes.
3. The proposed rezoning conforms to the General Plan. The R-1-4-P
zoning, if approved, would permit a density of 5 units per net acre. The
�General Plan desi9nates this area as "htedium Density Residential " 4-12 dwelling
units per gross acre.

CITY COUNCIL THE CHANGE OF PREZONIRG FROh1 P-C TO R-i-H-P FOR
2.5 ALRES LOCA7ED AT THE EASTERLY TERI4INUS OF EAST "J" STREET
WHEREAS, a duly verified application for change of prezoning was filed
, with the Planning Department by Shattuck Construction on March 16, 1976,
Application No. PCZ-76-C, and
WHEREAS, said application requested a change in prezoning for 2.5 acres
located at the easterly terminus of East "J" Street, more particularly described .
. in said application, from P-C to R-1-H-P, and
WHEREAS, the Planning Comnission set the time and place for a hearing on
said application, and notice of said hearing, together with its purpose, was
given by the publication in a newspaper of qeneral circulation in the City at
least 10 days prior to the date of said hearing, and
61HEREAS, a hearing was held at said time and place, namely 7:00 p.m. ,
April 12, 1976, before the Planning Comnission, and said hearing was thereafter
closed. �
' NOW THEREFORE BE IT RESOLVED AS FOLLOWS: :
_ 7. The Comnission finds that in accordance with the Neaative Declaration
on IS-16-13 and the findings stated therein this project will have no significant
' adverse environmental impacts and certifies that the Negative Declaration was
� prepared in accordance viith CEQA, 1970, as amended. �
2. From facts presented to the Camnission, the Comnission finds that
• 1 public necessity, convenience, general welfare and good zoning prectice require '
the change of prezoning from P-C to R-1-H-P for 2.5 acres located at the easterly
terminus of East "J" Street.
3. The findings of fact in support of said determination are as follows:
a. This prezoning constitutes good zoning practice in that it assists
in the preservation of the natural hillside areas by permitting
urban development while retaining a portion of the natural topo-

It is the finding of the Environmental Review Cortmittee that the project will not
haYe a significant effect on the environment for the folloriing reasons:
1. There is a general lack of significant natural or cultural
features on or near the site which could be adversely affected
by the project. The only overall resource of any importance
is the Snake Cholla (opuntia parryii serpentina) however, the
specimens on this property are of a poor quality and limited
volume. A smaller scale of the project and its location
adjacent to an established single family area preclude a
substantial adverse environmental impact .
2. The project is in conformance with all long term environmental
, goals of the City of Chula Vista and therefore will not attain
a short term goal to the expense of a long term goal . The

Coa�ervatioa Eleme;.ts of the General Plan.
' 3. The project does not involve the extension of any utility
facilities or public rights-of-way which could facilitate
growth. The project is rather a response to such facilities
which were required of South Bay Villas �1.
4. The project will not result in the generation of any
noise , air pollution, light, or other hazards or other
substances which would be hazardous to the welfare or healtn
of any human being.
NOTE: This evaluation is limited to the consideration of
prezoning, annexatior and tentative subdivision map. •

A. Background
This project involves the construction of 9 lots with single family
dwellings between East J Street and South Bay Villas nl . The project
site does contain Snake Cholla which is a rare and endangered specie .
B. Recommendation
Adopt this staff report, evaluation form and recommend that tt,e

no significant effect on the environment in accordance with .the
attached Negative Declaration and the findings therein .
� C. Project Setting
The project site is 1. 6 acres just south of the future extension of
East J Street to the east of the San Simon and Hillcrest Subdivision .
The site is relatively level and contains a considerable amount of
indescriminate fill . There are no significant geological hazards
on the site, the closest such hazard is the La Nacion earthquake
fault some 2000 ft. to the east . The soils on the property e�:hibit
undesirable qualities, which can be adequately treated during the
grading of the pro?erty and with adequate structural design of
foundations.
There are no archaeological sita on or near the property, a survey of
this area was conducted prior to the approval of South Bay Villas el
subdivision.
There are a fea� isolated Snake Cholla plants on the site, however ,
in comparison to the more dense higher quality stands to the east-
northeast which are being retained in open Space lots in Unit sl ,
the loss of these few examples of a rare and endangered specie, is
not considered to be significant.

The urban infi`astructure in this area is generally adequatc to support
development with the obvious exception of secondary school facilitics.
The existing capacity of Bonita Vista Junior High is 1190 students ,
. the attendance is however, 1530 . The Senior High has a capacity of
1485 with a current attendance of 1546 . It should also be pointed
out that this is one of the fastest growing areas of Chula Vista
with the probability of more students being generated be develo�ments
currently under construction prior to the completion of this project.
It is estimated however that only 2-3 students would be generated
from this project at the Senior and Junior High School .
D. Project Description
The project involves the subdivision of this site into 9 lots for
single family dwellings. The minimum lot size would be 6710 sq. ft .
with the average at 7738 sq. ft.
Grading of the property and installation of public improvements would
be accomplished in conjunction with South Bay Villas nl .
The property is partially in the City of Chula Vista and County
of San Diego. The area in the City of Chula Vista is zoned R-1-H-P,
while the portion in the County �s prezoned P-C. The project will
, therefore, involve not only the annexation of territory to the City
of Chula Vista but also re-prezoning from P-C to R-1-H-P.
Tne grading cf cne si�e will involve excavacion of iuGO cubic yards
= and the filling of 15 , 500 cubic yards . The maximum depth of cut
will be 7 ft. and the maximum dep'th of fill 15 ft.
E. Findings
