ITEM EXPLANATION
' 1 . The City Council at the meeting of February 3, 1976 discussed the advisability of
� establishing an R-3 district which would limit the residential density to one dwelling
unit per 3,500 sq. ft. of land. The Council then referred the matter to the Planning
Commission to determine if there was a need for such a zone.
, 2. On March 22, 1976 the Planning Comnission voted 5-1 recormnending that the City
Council adopt amendments to the Municipal Code for the establishment of the R-3-L
, zone permitting one unit per 3500 sq. ft. (see attached report) .

adopt the amendment to Sections 19.28.060, 19.28.070 and 19.28.090 of the Municipal
Code to add the R-3-L (low density multiple family residential ) zone in accordance
with Planning Cormnission Resolution PCZ-76-2.

2. PUBLIC HEARING: Consideration of amendment to establish R-3-L Zone Low
� Density Multiple Family
A. BACKGROUND
1 . The City Council , meeting in regular session on February 3, 1976, dis-
cussed the advisability of establishing an R-3 zonal district which would limit
� net residential density to one dwelling unit per 3500 square feet of land. The
, Council then referred the instant matter, the proposed R-3-L zone, to the Plan-
ning Commission in order to determine if there is a need therefor.
2. The following analysis addresses the nature and character of the proposed
R-3-L Zone, and suggests its theoretical and practical application under the
General Plan of the City of Chula Vista.
3. The Environmental Review CorrQnittee, meeting in regular session on
March 11 , 1976, found that the proposed R-3-L Zone and its district regulations
will not have any possible significant impact upon the environment and issued
the attached draft Negative Declaration.
B. ANALYSIS
• 1 . The R-3-L Zone would permit a maximum net residential density of one
dwelling unit per 3500 square feet of land. In General Plan terms the subject
zonal district would implement a density of about 12.5 dwelling units per net
acre, or about 10 dwelling units per gross acre, and is therefore a medium
density classification with regard to the density categories on the General Plan.
2. The R-3-L zone would permit the construction of two dwelling units on a
typical 7000 sq. ft. Chula Vsita lot, and four dwelling units on a building site
created through the merger of two adjoining lots. The R-3-L and the R-2 zones,
from a density standpoint, would therefore be similar. Llhile the R-2 permits the
establishment of only one single family dwelling or one duplex on each lot,
dwzlling groups, based upon the formula of two dwelling units per 7000 sq. ft. of
land, are permitted in this zone through Municipal Code Section 19.58.130 (see
the discussion under paragraph 5) .
3. While the R-3-L Zone would be an excellent "holding zone" in territories
where the application of the full R-3 Zone �aould be premature, such as the areas
in transition (twilight zones) of the Central Chula Vista Corrmwnity, it would not,
from a technical Euclidean-zoning standpoint, be a substantially better interim
zone than the R-2.
� 4. Notwithstanding the above factors, staff feels that the establishment of
the R-3-L Zone v�ould be a beneficial addition to the zoning regulations of Chula
Vista. The R-3-L Zone, despite its medium density characteristics, is still "R-3"
and would probably enjoy greater acceptance from owners of parcels of land which
are slated for high density residential development under the long range proposals
of the General Plan.

, 5. Furthermore, the R-3-L Zone would have greater flexibility than the R-2
• - Zone with respect to floor area and offstreet parking requirements and permitted
residential density. Althou9h both zones r�ould permit two dwelling units per
7000 sq. ft. of land, the aggregate number of units permitted in the R-2 is limited
by the number of minimum, 7000 sq. ft. building sites which compose thr_ parcel of
land in question. For example, if the said parcel were 21 ,000 sq. ft. in area, it
, could accommodate 6 dwelling units under the proposed regulations of the R-3-L Zone.
It could also accommodate 6 dwelling units under the R-2 Zone, since 21 ,000 sq. ft.
• equals three minimum 7000 sq. ft. R-2 building sites. However, if the parcel in
question were 24,500 sq. ft. in area, 7 dwelling units would be permitted in the
R-3-L zone, but only 6 urits could be constructed in the R-2 zone.
C. RECOI��ENDATION
1 . The Planning Department recorrunends that the Planning Cormnission find
that the creation of the R-3-L Zone, and its subsequent application to certain
residential areas in the Central Chula Vista Community. could promote the orderly
—implementation of the General Plan. .
2. Find that in accordance with the attached draft Negative Declaration,
and the findings therein, that the establishment of the R-3-L Zone will not have
any possible significant impact upon the environment, and certify that the
Negative Declaration has been prepared in accordance with the California Environ-
. mental Quality Act of 1970, as amended.
3. The D2partrent further reco�ranends ihut tiie Planning Commission recorrmend
that City Council enact the attached, proposed amendments to the Chula Vista
Municipal Code, and thereby establish the R-3-L Zone.

THE CITY COUNCIL THE ADOPTION OF AN AI+IENDMENT TO THE MUNICIPAL

WHEREAS, the City Council directed that the Planning Commission consider
� the advisability of establishing an R-3-L Zone which would limit net residential
density to one dwelling unit per 3500 square feet of land, and

WHEREAS, the City Planning Comnission set the time and ptace for a hearing
to consider a proposed amendment to the Municipal Code, and
WHEREAS, a hearing was held at said time and place, namely 7:00 p.m. ,
� March 22, 1976 ir. the Council Chamber, City Hall , 276 Fourth Avenue, before the
Planning Corrnnission and said hearing was thereafter closed, and
WHEREAS, the Cortmission found that in accordance with the Negative
Declaration on Initial Study IS-76-14 the proposed zoning text amendment would
• not have any possible significant impact on the. environment and certified that
the Negative Declaration was prepared in conformance with CEQA, 1970, as

amended.
NOl•! THEREFORE BE IT RESOLVED AS FOLLOWS:
� 1 . From facts presented to the Planning Cortmission, the Coimnission finds
lthat public necessity, convenience, general welfare and good zoning practice
I require that Sections 19.28.060, 19.28.070, and 19.28.090 of the Municipal Code
� be amended as set forth in Exhibit "A", attached hereto and made a part hereof.
2. The Planning Comnission recortonends to the City Council that said
amendment be adopted.
3. That this resolution be transmitted to the City Council .

and will therefore not attain short term to the disadvantage

A. Background
This project consists of a zoning text amendment to create a new
. low density multi-family zone. This R-3-L zone would have the
same basic regulation• as the R-3-G zone but would permit a
maximum density of 1 dwelling per 3500 sq. ft.
B. Recommendation
Adopt this staff report and evaluation form and forward the attached
Negative Declaration to the Planning Commission and City Council
with a recommendation that they find that the zone text amendment
would have no possible significant impact on the environment.

the permitted density and a higher level of land use regulation.
