HomeMy WebLinkAboutReso 1993-17086 RESOLUTION NO. 17086 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ESTABLISHING A COUNCIL POLICY ON SPECIFIC CATEGORIES OF DEVELOPMENT PROJECT ASSISTANCE OR FEE SUBSIDIES The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, at the regular meeting of March 23, 1993, the City Council adopted Resolution 17048 amending the Master Fee Schedule; and, WHEREAS, at that time Council stipulated that no fee adjustments take effect prior to a staff report being received and acted upon by Council on specific impacts of the Master Fee Schedule update; and, WHEREAS, at the joint Council/Agency meeting of April 27, said report was received, and Council wishes to act upon that report and thus fulfill the stipulations placed on adoption of the Master Fee Schedule; and, WHEREAS, staff has presented several options to address the impacts discussed in said report, with the recommended options compiled in policy form in Exhibit "A"; and, WHEREAS, the Council and Agency voted to amend Exhibit "A" relative to very low-income or lower-income housing projects undergoing major renovations and directed staff to bring forward further language relating to enforcement of said policy; and, WHEREAS, the attached policy has been updated to address said Council/Agency concerns. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby: 1. Adopt Policy 200-01 on specific categories of development project assistance or fee subsidies, as attached on Exhibit "A" or as it may be amended; and, 2. Find that the condition of effectiveness of Resolution 17048 has been met and therefore Resolution 17048 is in full force; and, 3. Direct staff to development alternatives for providing incentives for providing incentives, deferrals and/or fee subsidies to encourage investment within: a) Proposed High Technology/Bio-Technology Zone b) Proposed Border Environmental Zone Resolution No. 17086 Page 2 and that pending development of such alternatives, Council directs staff to bring forward any projects which may conform with the specifications of such zones for individual Council and/or Agency consideration. PURPOSE Establishing a policy for special consideration of various impacts of city fees. POLICY Category I. Vex~ Low-Income Residential For residential development proposals of less than twenty (20) dwelling units which 1. Are not part of a Planned Community development 2. Consist of new conslruction or major refurbishmeat (remodeling valued at or above $25,000} 3. Are determined by the city to serve Very' Low-Income housing needs (not in excess of 50% of median income), according to the median area income statistics compiled annually by the federal DeparUnent of Housing and Urban Development (HUD) for the San Diego metropolitan area, A grant of 25% of the total fees for each Very Low-Income unit for: 1. Electrical Permits 2. Plumbing Permits 3. Building Permits may be provided by the City against the cost of said fees. Depending upon funding availability and qualifications, said grant may be provided from the Redevelopment Agency Low-Moderate Income Housing Fund and/or Home Investxnent Parmership funds. Otherwise, said grant would take the form of a subsidy of that portion of the fees, with the associated costs absorbed by the General Fund. On a case-by-case basis, ff the City or Agency or Chula Vista Housing Authority determines that other incentives, subsidies or assistance of similar or greater value may be more appropriate, said incentives, subsidies or assistance may be provided in lieu of the aforementioned grant. No such assistance shall be granted in advance of completion of construction and the imposition of restrictions against title assuring the availability of the site for ide~tffied housing needs, absent a written agreement assuring to the City's and/or Agant3es satisfaction that the project will indeed meet the identified housing needs. B. Category II. Lower-Income Residential For residential development proposals of less than twenty (20) dwelling units which 1. Are not part of a Planned Community development 2. Consist of new consU~ction or major refurbishment {remodeling valued at or above $25,000) 3. Are determined by the city to serve Lower-Income housing needs (not in excess of 60% of median income), according to the median area income statistics compiled annually by the federal Department of Housing and Urban Development CHUD) for the San Diego metropolitan area, A grant of 10% of the total fees for each Lower-Income unit for: 1. Electrical Permits 2. Plumbing Permits 3. Building Permits may be provided by the City against the cost of said fees. Depending upon funding availability and qualifications, said grant may be provided from the Redevelopment Agency Low-Moderate Income Housing Fund and/or Home Investment Parmership funds. Otherwise, said grant would take the form of a subsidy of that portion of the fees, with the associated costs absorbed by the General Fund. Category P,I. Residential lmprovements/F. xpan~ion (General) For improvements to or expansions of existing residential dwelling units which do not increase the number of Equivalent Dwelling Units tEDUs) and which do not come under the purview of Category I or II, No special consideration of fees shall be given to such projects and any fee waiver requests shall be processed according to the current fee waiver ordinance and/or policies. D. Category IV. Business (General) No special consideration of fees shall be given to such projects and any fee waiver requests shall be processed according to the current fee waiver ordinance and/or policies. E. Granting Authority The City Council and Redevelopment Agency hereby delegate tile authority to the City Manager to make such grants or authorize such assistance puI~,~nt to this policy as may be less that $2,500, upon giving an informational memo to the Council and/or Agency. ff the amount of the grant or assistance is in ~zcess of $2,500, said grant or assistance shall be subject to consideration by the Council and/or Agency, depending on the funding sources of the assistance.
