P. Kiffe, are now proposing to construct a 3 story, 92 unit apartment building on their 2.15 acre property south of Center Street and north of �4emorial Park (locator attached to Res. PCZ-75-H). The proposed density requires a rezoning from R-3 (69 units possible) to R-3-H (117 units possible). The applicants are requesting the Precise Plan Modifying District in order to increase the percentage of compact parking spaces allowed from 10% to 17.7% and to guarantee that only 92 units will be built rather than the maximum number allowed in the R-3-H zone. A full discussion and analysis of the rezoning proposal is contained in the enclosed staff report to the Planning Comnission dated October 8, 1975. EIR-75-3 for an earlier 84 unit project and restaurant was adopted by the Planning Cortunission on August 13, 1975. Copies of the EIR were transmitted to the City Council on October 9, 1975 for your information and future certification. When the project was changed to 92 units, the Environmental Review Coirmiittee reviewed EIR-75-3 on September 25, 1975, found it to be satisfactory, and determined that a supplemental EIR would not be necessary. On September 10, 1975 the Planning Commission approved the architectural thene for a to;o story, 69 unit apartrent .canplex on tfie 2.15 acre site located immediately north of h�emorial Park (see locator) . Subsequently, the applicants decided to pursue a higher density for the property and therefore are requesting that the property be rezoned fro�n R-3 (1 unit/1350 sq. ft. - 69 units possiblej to R-3-H-P (1 unit/800 sq. ft. ; high rise; precise plan required - 117 units possible). The applicants are proposing 92 units or 42.8 DU/Acre. 2. The precise plan will be addressed in the fo1lo�Jing agenda item. 3. EIR-75-3 for an 84 unit apartment complex on the property ��as adopted by the. Planning Co� � ission on August 13, 1975. The neo� precise plan for 92 units �•�as revie��red by the Environmental Revieri Conunittee on Septenber 25, 1915, and it �ras determined that the higher density proposal oosed no net•� environmental impacts not already reported upon in EIR-75-3. Therefore, EIR-75-3, and the Planning Com�is- . sion adoption thereof on August 13, 1975, remains effective and no further action is necessary. E. FECCl��•1EtIDATIOi�. Adopi a motion recortmiending to the City Council approval of rezoning 2.15 acres of property located in the 30Q block of Center Street, north of hlemorial Park, from R-3 to R-3-H-P in accordance �aith the findings herein and o-iith development subject to approval of a precise plan. C. ANALYSIS. 1 . Surrounding zoning and land use: • North - C-C - Shopping Center South - R-3 - Memorial Park East - C-B - Auto garage; vacant property West - C-O-D - Vacant property 2. The site. � � The site is approximately square in shape, measuring 300' in depth by 317' in frontage along Center Street. The ground slopes moderately to the south, • draining into the I:e�:orial Park drainage and retention basin (see Exhibit A) . Adjacent to and east of the site proper is a 40'x174 ' strip, owned by tlie applicants, ahich would be used for access to Landis Avenue. 3. Zogob and C. P. Kiffc on September 11 , 1975, Application IVo. PCZ-75-H, and WHEREAS, said application requested a change in zoning for 2.15 acres located on the south side of Center Street in the 300 block, rrore particularly described in said application, from R-3 to R-3-H-P, and WHEREAS, the Planning Cosmission set the time and place for a hearing on said application for change of zone, and notice of said hearing, together with its purpose, �ras given by the publication in a nee�spaper of general circulation in the City at least ten days prior to the date of said hearing, and WHEREAS, a hearing Yras held at said time and place, namely 7:00 p.m. , October 8, 1915, Council Chamber, City Hall , 276 Fourth Avenue, before the . Planning Cortunission, and said hearing was thereafter closed. NOW THEREFORE BE IT RESOLVED AS FOI.LOWS: 1. From facts presented to -the Cortmission, the Comnission finds that public necessity, convenience, general o-:elfare and good zoning practive require the change of zone from R-3 to R-3-H-P for 2.75 acres loca.*.ed an the south side of Center Street in the 300 block. 2. The findings of fact in support of said determination are as follotiis: a. R-3-H-P zoning is consistent rrith sound land use planning principles in that higher densities are encouraged in areas rrhere public services already exist, by diversifying the housing supply in the dormtorrn area, and by providing the opportunity to expand the residential basc in the downtown area in support of the goal of rejuvenating the Central liusiness , District. b. Application of the "P" Preci�e Plan hbdifying District is necessary since the site is within the Livic Cen[er Design Control District and is directly adjacent to one of the City's major pu6lic parks as vrell as the downtoo-rn business district. It is appropriate and necessary to give the project careful review before the Planning Coranission and City �S,J Council to ensure that the developmen[ plans are aes[hetically and I � functionally comp�tihlc with thc dov,ntown arca and long range plans for ' t. The zone change from P.-3 to R-3-li-P maintains the existing cbnfornity to the General Plan designation of "Professional and Office tortrnercial ," rrherein apartments are allowed; the rezoning suppor[s � the General Plan policy to locate high rise apartment complexes in the area surrounding the Third Avenue Qusiness District, and the City's long range goal to diversify the housing base in the Lentral 6usiness District. 3. The Planning Comnission reco�mends to the City Louncil that said change of zone be granted. 4. That this resolution be transmitted, along �aith the application, to the City Council, and a copy of this resolution be transmitted to the applicant.
