ITEM EXPLANATION
In response to two requests for annexation and anticipating additional requests,
a prezoning action for 4.46 acres, comprising 10 residential lots, �aas initiated and
submitted to the Planning Co�mnission with a recortunendation for prezoning the area to
R-1 . (See attached BACKGROUND and APJALYSIS excerpts from the staff report to the
Correni s s i on. )

A. BACKGROUi�D
1 . In a letter dated July 3, 1975, the City ��anager informed o�mers of the
subject properties that the County had recently determined to eliminate fire
protection service to these and other properties not located within cities or
fire districts. Alternative courses of action to receive fire protection,
including annexation to the City, �•:ere outlined therein. It rias further stated
that the City Council had indicated that, if a formal decision to annex �•ias made,
. the City �•iould provide fire protection service pending completion ot tlie annexa-
tion process. Subsequently, "letters of intention" to anner. �•�ere received from
trio of the af`ected property owners within the L Street-Country Club Drive area
shot•m on Exhibit A.
2. 4lhile only two property o�,,�ners have submitted requests for annexation,
, it may be reasonably anticipated that the ormers of other parcels of land �•�ithin
the L Street-Country Club Drive area n7ay eventually follow suit on a piecemeal
basis. The Planning Department has included the said parcels of land �•rithin the
scope of tnis ptroposed orezoning in order to facilitate their future d�rlPX�tinn.
3. The Environmental Review Coordinator has found that PCZ-75-G is
categorically exempt from any env.ironmental review requirements as a Class 3a
exemption.
C. A��ALYSIS
1 . Existing development.
The property is developed o-iith single and tv,ro-family dwellings. County
zoning is presently T-20 " Temporary - used to prevent premature urban or
nonurban development until more precise zoning regulations are prepared. " The
Chula Vista General Plan designates the property as I•tedium Density Residential
(4-12 DU/llc. ).

5. Density.
The subject area is developed at a gross density _of one unit per 10,000+
sq. ft. of land area--w211 above the standard R-1 density of one unit per
7,000 sq. ft. As a consequence of the land use pattern, hoiaever, unless the
property is prezoned R-3 - hlultiple Family Residential , upon annexation non-
� conforming uses tiaill be created on at least t�•+o of the lots.
� 6. Character of area.
The character of the subject property is in keeping o-�ith tl�e ovei�all
character of the surrounding low density development. anrl sin�le family residen-
tial neighborhoods. h:otwithstanding the creation of nonconforrning uses, it is
believed the application of the R-1 zoning district is a logical and desirable
extension of the adjacent R-1 zoning districts and will be most effective in
maintaining the character of this property and its coinpatibility v�ith surrounding
areas.

WHEREAS, 4.46 acres of property, comprising ten residentially developed
� lots, loca[ed south of "L" Street and bounded on three sides by the Chula Vista
boundary line, is under consideration for annexation to the City of Chula Vista,
and
WHEREAS, an application for prezoning of subJect property to R-1 was •
initiated by the City Planning Comnission, and
WHEREAS, the Planning Comnission set the time and place for a hearing on
said application, and notice of said hearing, together with its purpose, was given
Gy the publication in a newspaper of general circulation in the City at least 10
days prior to the date of said hearing, and
l•lHEREAS, a hearing was held at said time and place, namely 7:00 p.m.,
August 27th, 1975, before the Planning Cortmission, and said hearing was thereafter
closed.
� NOW THEREFORE BE IT RESOLVED AS FOLLOIJS:
1. From facts presented to the Comnission, the Comnission finds that
. public necessity, convenience, general welfare and good zoning practive require
the prezoning to R-1 for 4.46 acres, located south of "L" Street as shown on the .
attached Exhibit A.
2. The findings of fact in support of said determination are as follows:
a. The density and character of the subject property is in keeping with
the overall character of the surrounding low density, single family
development; the extension of the adjacent R-1 zoni�ag district to
insure the maintenance and compatibility of this character is therefore
appropriate.
b. Application of R-1 zoning district regulations tn this property will
be effective in implementing the policies and concepSs of the General
� Plan as they relate to the preservation and enhance�t of existing and
sound residential areas.
c. The proposed prezoning conforms to the General Plan designation of
"Medium Density Residential , 4-12 DU/Acre."
3. The Planning Comnission recortmends to the City Council that said
prezoning be approved.
4. That this resolution be transmitted to the Lity Countil.
