ITEM EXPLANATION
1 . The applicant proposes to construct 24 duplex units in 12 buildings on 2.5± acres of
property located at the southeast corner of Palomar Street and Second Avenue. To make
this possible, he has requested that the property be rezoned from R-1 to R-2-T-P. The
rezoning request is accompanied by the proposed Precise Plan for the development. i
2. An Initial Study (IS-74-27) was prepared for a previous proposal for 42 apartment units,
for which a Negative Declaration was issued on July 3, 1974. The Environmental Review
Comnittee reviewed this Initial Study and found that the less intense project now contem-
plated would have no new impacts. The original Negative Declaration was certified by the
Planning Comnission on May 28, 1975 and is herewith forwarded for City Council certification.
3. The Coimnission found that the density proposed in the Precise Plan (see later agenda
item) falls within the range of the General Plan (4-12 DU/Acre), that the R-2-T-P zoning
represents a good transition between the R-3 zone to the west, the R-1 zone to the east,
and that the depth of the property is such that it does not lend itself well to R-1
development.
4. After holding a public hearing and taking testimony the Planning Corronission was able
to make the necessary findings to justify the rezoning and therefore recoirrnended approval
(see Resolution No. PCZ-75-D).

STAFF RECOMMENDATION: Concur with Planning Cortonission recoirmiendation for approval of
the zone change, and recortrtnend that Council find that in accordance with the Negative
Declaration IS-74-27 and the findings therein that the rezoning from R-1 to R-2-T-P will
not have any possible significant impact on the environment, and certify that the Negative
Declaration has been prepared in accordance with CEQA 1970, as amended.
