(GONZALEZ) IN ORDER TO ENHANCE HOA4EOWNERS`
RIGHTS TO ALTER THEIR LANDSCAPIi�G FOR BETTER
V�'ATER COI�'SERV.ATION
V�'HEREAS. Califomia is faced ��-ith the enormous challenee of ineetine the ���ater needs
of a arowing population H�ith a limited supply of�vater; and � �
V�'HEREAS, in April 2013, Go��emor Bro��m issued an esecutive order to stren�hen the
state's abilitv to manaee �vater and habitat effecti��elv in drouaht conditions and called on all
Califomians to redouble their efforts to conserve ���ater: and �
WHEREAS. in Januan� 2014. Govemor Jem� BroNm broueht attention to the current
deteriorating situation and declazed a drought emeroency; and �
WHEREAS. accordine to the Califomia Department of Water Resource`s 2013
Califomia Water Pan Update, residential landscape �aater uses account for 3�% of the stateti�ide
urban ��ater usase: and
�'�'HEREAS, residents H�ho belone to HomeoHmer`s Associations (HOAs); estimated at
1�-2�% of California-s population, aze not a1H�ays freelv able to curb landscape w�ater usaee and
become more efficient by replacine their lush, water-intensi��e la�tims �3�ith attractive, «°ell-
designed. and «�ater efficient landscaping because of HOA rules and penalties; and
WHEREAS; e�isting state regulations (Title 23 California Code of Reeulation
492.6(a)(1)(G)), prevent HOAs From enforcing azchitectural euidelines that prohibit droueht-
tolerant landscaping; but still leave some 6omeo��mers �vinerable to being penalized for
replacing ezisting turf�vith drought-tolerant landscaping; and
WHEREAS, .Assembly Bill 2104 (Gonzalez) addresses this issue b�� ensurine that
homeo«mers livine in commominterest developments �<<ill have the rieht to alter the landscapins
on their residential propert}� to better conserve ���ater without euidelines that prohibit; or have the
effect of prohibitine replacement of existine turf; and
N'HEREAS. adoptine Assembl�� Bill No. 2104 would also help ���ater providers; from
cities to ���ater districts, meet current state lati� requirements to come up with plans to cut back
durine droughts and reduce ���ater consumption b�� 20% by the vear 2020.
NOI�'. THEREFORE. BE IT RESOLVED b�� the Cit�� Council of the Cirv of Chula Vista
that it support Assembh� Bill No. 2104 and its provisions that strenethen an indi��idual
homeoN�ner`s right to replace eaisting turf �+-ith drou�ht-rolerant landscaping for better ���ater
conservation, and uree the California State Legislature to espeditiously adopt Assemblv Bill
2104.

BE IT FURTHER RESOLVED that the Cit�� Clerk is directed to send a copy of this
resolution to Assembly Member Lorena Gonzalez, and to the Honorable members of the State
Assembly tifio represent the San Diego region, to show the City Council's support for AB 2104.
