The request is categorically exempt from environmental review since the building is less than 2,000 sq. ft. in size. The Planning Commission considered the request on June 25, 1975, and after holding a public hear.ing, was able to make the findings required to justify the rezoning, prirr�,r.- ily because the property is not considered suitable for residential development; there is minimal chance that C-0 zoning would expand in this area; and the proposed office use is small in scale. Application No. PCZ-75-E, and I•7HEREAS, said application requested a change in zoning for two vacant i lots, comprising 15,000 sq. ft. , at the northo-iest corner of East "L" Street _ ' and Telegraph Canyon Road, more particularly described in said application, from R-3 to C-O-P, and � 11HEREAS, this request is categorically exempt (Class 3c) from the � provisions of CEQA 1970, as amended, and . � i WHEREAS, the Planning Commission set the time and place for a hearing on � said application, and notice of said hearing, together viith its purpose, vias �' 'i given by the publication in a newspaper of general circulation in the City at � . , , least 10 days prior to the date of said hearing, and �I . From facts presented to the Comnission, the Concnission finds that public � ' necessity, convenience, general welfare and good zoning practice require the ; � � change of zone from R-3 to C-O-P for 15,000 sq. ft., comprised of tv�o vacant lots � - - at 376-380 Tel?graph Canyon Road. . '� - 2. The findings of fact in support of said determination are as follows; �t �, j ' a. It is reasonable to make aVailabte a small sit2 suitable for a ' i - small scale office development, even though there are vacant lands � :I nearby which are zoned for retail commercial use. �� ,, b. The site in question is considered unsuitable for residential � � , development, due to its small size and buildup of co.,�rcial uses � ;� and traffic i^ the area surrcurding th2 si�e. �I �b _ �i � c. The location of small scale commercial office uses on this site y; will not be detrimental to adjacer�t properties due to the access �� being away from the residences and the lower elevation oP the site. ' d. The application of the Precise Plan htodifying District is � � - • - considered appropriate to ensure that the scale of.developrtrent is _ fulty compatible with the area, and to ensure that the project complies with the policies of the Scenic fiighway Element. . e. The proposed zone cnange and subsequent land use does support the intent of the General Plan to: (1) locate concnercial activities on busy streets; (2) avoid noise and other external impacts on residential areas; (3) concentrate cortmercial developments in centralized areas. 3. The Planning Comnission recomnends to the City Council that said change of zone be granted. 4. That this resolution be transmitted, along with the application, to the City Council , and a copy of this resolution be transmitted to the applicant.
