ITEM TITLE: Ordinance - Approving Lozano Annexation
Resolution - 4lithdrawing the Lozano Annexation from the Bonita-Sunnyside
Fire Protection District

A. BACKGROUND:
The applicant has requested annexation of 0.374 acres si.tuated in the vicinity of
Via de Laurencio and Clair Avenue (see attached report) .
B. LAFCO ACTION � .
LAFCO approved the annexation on May 5, 1975 and authorized the City to annex the
territory without public hearing and election as provided in the Government Code
Sec. 54797.1 .
C. WITHDRAWAL FROM" FIRE DISTRICT
To avoid dual charges for fire protection serv,ices, the proposed annexation should
be a�ithdrawn from the Bonita-Sunn,yside Fire Protection District under the provisions
of Sec. 13952 of the Health and Safety Code as a subsequent withdrawal related to
the annexation.

Financial Statement:
Commission-Board Recommendation: The Planning Commission recormnended approval of
the annexation on March 12, 1975.
Department Head Recommendation:
Adopt a resolution withdrawing the Lozano Annexation
from the Bonita-Sunnyside Fire Protection District and authorize staff to submit this
withdrawal to the Clerk of the Board of Supervisors; also, adopt the ordinance
approving the Lozano Annexation.

3. Corsideration of request for Lozano Anner.ation of one lot on north
side of Via de Laurencio at Claire Avenue
, A. RE UEST
The .applicant proposes to annex approximately .30 Ac. situated in the vicinity
of Via de Laurencio and Claire Avenue.
B. BACKGROUt�D
The property has been prezoned R-1-10 (Ordinance �1363, October 5, 1471 ) .
C. LAND USE AND PARCEL COh�FIGURATION
The subject property, on which a single family home is under construction, is
contiguous to the city limits on its western boundary. Adjacent lots are
developed with single family units.
. D. SUITABILITY
� The annexation represents a justifiable and logal extension of present.city
boundaries and is ti•�ithin the City' s designated sphere of influence as deter-
. mined by purchased sewer capacity rights.
E. COMJ4ENTS FROF1 OTHER DEPARTFiEilTS
1 . Police Department.
No problems are foreseen in providing protection to, the subject property.
• 2. Fire Department.
Fire protection can be provided to the subject property vrith no increase
in personnel , equipment or special requirements.
3. Public Works.
Sewer services are available to the subject property and the Public 4lorks
Department does not anticipate any problems as a result of the annexation. .
No�aever, completion of any necessary public improvements and the extension
of the seo-rer in Via de Laurencio to the extension of the easterly property
line �vill be requirements of annexation. .
