ITEM TITLE: Ordinance No. 1623 - Amending zoning map or maps established by
Section 33.401 of the Chula Vista City Code to change the zone on
approximately 1 .8 acres located 165 feet south of Kennedy Street
� from R-3-G to R-3-M-P - Second reading and adoption

BACKGROUND:
On May 6, 1975 Council introduced the ordinance rezoning the subject property
with the stipulation that the zoning shall .become effective at such time as the .
property adjacent on the north is annexed to the City. The ordinance should now
be placed on second reading and adopted.

Ordinance - Amending Zoning Ordinance to change zone on 1 .II2 acres located
1G5 feet south of Y.ennedy Street from R-3-G to R-3-ht-P

BACKGROIND: .
1 . The applicant' s request involves the development of their property in the
city into multi-family units under R-3-tq zoning (22± units per acre) . The request
to annex the 1 .59 acres of land in the County ��as approved by the Planning
Conmission on April 9, 1975 and has been submitted to LAFCO.
2. The Planning Corrunission found that the zoning �•�as justified and appropriate
for the area. A cor�plete copy of tfie staff report to the Commission is attached.
The density permitted under the proposed rezoning and prezoning on the subject
property is 69 units , 3 units fewer than possible under the existing R-3 zoning
in the County and the R-3-G zoning in the City.
, 3. The Planning Commission revie�aed the tJegative Declaration and certified that
it had been prepared in accordance with CEQA, 1970, as amended. The fJegative
Declaration is attached for Council revie�a and certification.

Commission-Board Recommendation: The Pldnning Cormission voted 6-0 on Apt'il 9, 1975
to certify the Initial Study and recorunend to the City Council the adoption of �
prezoning and rezoning of the 3,41 acre property to R-3-ti-P, with development of the
property subject to an approved precise plan conforming to the conditions set forth
in PCZ-75-C.
Department Head Recommendation:
Concur. In addition, rezoning of the 1 .82 acres from R-3-G to R-3-t•1-P should becane
effective only upon the annexation of the adjoining 1 .59 acres located in the County.
Therefore, the City Council should �•�ithhold the second reading of that ordinance until
the annexation is completed. '
